International Journal IhyaUlum al-Din is an Indonesian journal of Islamic Studies published biannually by the State Islamic University (UIN) Walisongo Semarang Indonesia. Abstract

The purpose of the discovery of Islamic law must be understood by the mujtahid in order to develop legal thinking in Islam in general and answer contemporary legal issues whose cases are not explicitly regulated by the Koran and Hadith, especially those related to the field of muamalah. In reviewing the matter to be determined by law, the Indonesian Ulema Council Fatwa Commission is based on the Qur'an and Sunnah as its main source. In this context, there are several methods used by the Indonesian Ulema Council Fatwa Commission. First, every Fatwa Decree must have a basis on the Book of Allah and the Sunnah of the Apostle that is not bad, and not contrary to the benefit of the people. Second, if it is not found in the Book of Allah and the Sunnah of the Apostles, the Fatwa Decree should not contradict ijma ', qiyas that mu'tabar, and other legal arguments, such as ihtisan, maslahah mursalah, and saddu al-dzari'ah. Third, before making a decision before deciding on a fatwa, it must first be carefully studied for each problem presented to the MUI at least a week before the trial. If the problem is clear the law (qath'iy) let the commission convey it as it is, and the fatwa will fall after the text is known from the Koran and the Sunnah. Whereas in the case of khilafiyah occurring among the schools of thought, what is stated is the result of tarjih after observing the jurisprudence of muqaran (comparison) using the rules of ushul fiqh muqaran related to scholarship.

Abstract

In contrast to the secular economy of capitalism and socialism, Islamic Economy is the one built on syariʻah bases, norms and divine transcendent values  in the divine revelation, the al-Qurʻan and the ḥadiṡ. In order to understand the essence of syariʻah, it is necessary to conduct shifting paradigm from a literalist approach merely  focusing on textual and legal meaning to a substantialist approach seeking to capture the moral  ideas and   the original meaning of the syariʻah beyond  the text,  which are trans-historical or transcendental being  and universal (general principle).  This paradigm shifting occurs as  the text is limited while the reality is infinite. Among the substantialist  approaches offered is  the use of maqashid syariʻah and mashlaḥah.  Maqashid syariʻah refers to the essence of God's intention (Law Giver), which is the most essential formulated into five elements, they are: حفظ الدين  (the religion keeping), حفظ النفس  (the soul keeping), حفظ العقل  (the intellect keeping), حفظ النسل (descendant keeping) and المال حفظ (the wealth keeping). Then, hierarchically, maqashid in classical theory is developed into 3 levels: الضرورية  (primary needs /basic  necessity), الحاجية  (secondary needs), and التحسينية  (tertiary needs). Under the argument of maqashid syariʻah,  this Islamic economic concept must be developed, therefore  on the one hand the Islamic economy will not lose its divine morality, but on the other hand it can also develop dynamically, progressively and even ready to handle the  contemporary economic problems. Based on the explanation above, this research is focused on what is the basic philosophy that is the basis of the formulation and development of Islamic economics? This research data is library. The data collection method uses the documentation method, namely: collecting, then reviewing the data collected. After the data is collected, the data is analyzed by reducing data, presenting data in narrative form, and drawing conclusions. This study concludes that the Islamic Economy is closely related to the maqashid syariʻah namely ḥifẓ al-mal. Maqashid syariʻah is the basis for the development of the Islamic economy because it aims at the goal of creating human welfare and happiness by balancing the circulation of property fairly and balanced both personally and socially. Understanding of maqashid syariʻah is a necessity in berijtihad to answer various economic problems. Understanding of maqashid syariʻah is not only needed to formulate macroeconomic policies, but also policies that are microeconomic. In the economic context, maqashid syariʻah has a dual role, namely: as a means of control as well as a social engineering tool to realize human equality. He provides a rational philosophical basis of economic activity. Without the maqashid syariʻah, the understanding and practice of Islamic economics will be narrow, rigid, static, and slow. Islamic economics will lose the spirit and substance of its shari'a. But on the contrary, with the maqashid syariʻah the Islamic economy develops elastic, dynamic, in accordance with the character of the Shariʻah Islam which is universal and relevant for all space and time

Abstract

Religious ceremonies that are usually carried out by Javanese are inherited from the ancestors. There are two types of religious ceremonies in the form of salvation in Javanese society, namely life cycle salvation ceremonies and Islamic religious holidays. The research aims to find an understanding of the traditions of religious ceremonies and social processes for Muslims in Karangrayung District, Grobogan Regency. Data collection methods were obtained through observation, interviews, documentation and literature study. After that, the data is analyzed qualitatively-descriptive-interpretative. The results showed that there were seven religious ceremonies and social processes which until now were still commemorated by the Karangrayung people, namely: Sura (Muharam), Rajaban selametan, Mauludan selametan, Selametan Ruwahan, Selametan Likuran, Selametan Bodonan, and Selametan Besar which were held on the 10th Zulhijjah. The perception of the people of Karangrayung on religious ceremonies and social processes is a form of virtue that is recommended by Islamic teachings that contain values: 1) charity, 2) ukhwah Islamiyah, 3) help, and 4) share with others

Abstract

The Division of the inheritance of the most crucial of them, there is a difference of religion between the heirs and the muwarriṡ, both the difference when muwarriṡ was still alive or when a heir has died. Indonesia, Islamic law as contained in the compilation of Islamic law (KHI), have determined that religious differences can be a hindrance to each other can be inherited. Along with the development of the times, the provision in the KHI was not considered relevant to the needs of today's society, so the necessary progressive efforts to respond to the problem of Islamic inheritance laws in Indonesia. Complexity and plurality of society Indonesia demanding the Islamic jurist to do the renewal of the law, as the religious court judges has been made in resolving the different religious inheritance matters by using the rechtsvinding function justified by positive law and compile Islamic law, when there is no law that governs. The renewal of the law in the form of the granting of the estate to the heirs of muwarriṡ Muslims from non-Muslims and the granting of probate wajibah to non-muslim heirs of muwarriṡ of Islam. This is done for the sake of Justice and benefit of tegaknya in human life.

Abstract

The laws contained in the Qur'an still exist that require interpretation and have the potential to develop. Abstract

Each prophet is given a miracle according to the needs and conditions of his people. If the previous prophet was sent by Allah SWT only for certain people, a certain period, and strengthened by materialistic miracles such as the staff of Moses and others, then scientific miracles are very relevant to the people and the present age. This is the greatest scientific miracle in the history of human life. Allah wants every piece of information conveyed by the Koran to materialize someday. When an event and event occurs in accordance with the Koran, the miracle is revealed. So this scientific miracle is always new every time. In the present era, the truth of Islamic science began to unfold. These scientific truths will one day attract humanity to acknowledge the greatness of the Almighty God. By using qualitative descriptive methods, based on the results of research on the texts of the Koran and the Sunnah conducted by modern Muslim and non-Muslim scientists, who come from various fields of science, it is concluded that there is a harmony of scientific facts between the Koran and Hadith with science and this discovery reinforces the truth of both
