Abstract

The role of pesantren in the development of civil society in this era of globalization needs to be re-examined. Along with the various challenges in this era, certain steps required to reconstruct the strengthening of the role of pesantren. Pesantren which has been able to play a role of educating the students should be developed with greater emphasis on strengthening civil society more comprehensively. Based on data and analysis, the authors conclude that: First, schools in addition to religious education institutions, also has the potential for the development of civil society in public education by taking various measures. Second, the schools in conducting educational development of civil society in the community can take two ways: (1) perform variety useful and beneficial activities to the surrounding community (2) to make educational planning directed at the ability and skills of the students respond to the needs and demands communities of origin. Third, the main role of schools in developing Islamic religious education should continue to be empowered and developed primarily related to entrepreneurship and independence, as well as efforts to integrate the religious knowledge and development of civilization in this era of globalization. Peran pesantren dalam pengembangan civil society di era globalisasi ini perlu untuk dikaji ulang. Seiring dengan adanya berbagai tantangan di era ini, langkah-langkah tertentu diperlukan untuk merekontruksi penguatan peran pesantren ini. Pesantren yang selama ini mampu berperan mendidik para santri hendaknya dikembangkan dengan lebih menekankan pada penguatan civil society secara lebih komprehensif. Berdasarkan  data dan analisis,  penulis menyimpulkan bahwa: Pertama, pesantren di samping sebagai lembaga pendidikan agama, juga memiliki potensi untuk melakukan pengembangan pendidikan civil society di masyarakat dengan melakukan berbagai upaya. Kedua, pesantren dalam melakukan pengembangan pendidikan civil society di masyarakat dapat menempuh dua cara: (1) melakukan berbagai akvititas yang berguna dan bermanfaat bagi masyarakat di sekitarnya (2) dengan membuat perencanaan pendidikan yang diarahkan pada kemampuan dan ketrampilan para santri dalam merespon kebutuhan dan tuntutan masyarakat asalnya. Ketiga, peran utama pesantren dalam melakukan pengembangan pendidikan agama Islam hendaknya terus diberdayakan dan dikembangkan terutama terkait enterpreneurship dan kemandirian, serta upaya memadukan antara pengetahuan agama dan kemajuan zaman di era globalisasi ini.

Abstract

Pemberdayaan masyarakat pesantren berbasis wirausaha ini pada prinsipnya untuk menjembatani permasalahan yang sering dialami santri, khususnya alumninya. Banyak alumni pondok pesantren, meski secara keilmuan relatif berhasil dan diakui di masyarakat, bahkan cenderung ditokohkan di daerahnya masing-masing, namun dalam segi perekonomian, mereka mengalami masalah. Oleh sebab itu diupayakan langkah tertentu, khususnya pemberdayaan potensi entrepreneurship. Pelaksanaan pemberdayaan potensi entrepreneurship yang dilakukan di tiga pondok pesantren di wilayah Kecamatan Kaliwungu Kabupaten Kendal, yaitu PP Miftahul Falah, PP ARIS dan PP ASPIR, setidaknya, dapat menggapai beberapa poin yang dapat menjembatani beberapa permasalahan di atas. Pertama, dengan mengikuti kegiatan ini, para peserta tergugah untuk melakukan kreasi, inovasi dalam merespon kebutuhan masyarakat sebagai sumber perekonomian. Kedua, ada kesadaran dari para peserta bahwa setiap barang dapat dimanfaatkan secara optimal. Ketiga, pentingnya pemanfaatan waktu secara lebih intensif untuk menghasilkan sebuah barang yang bernilai ekonomis dan dapat menjadi peluang income bagi mereka. Keempat, ada kesadaran dari para peserta akan arti pentingnya pemanfaatan lahan-lahan kosong agar lebih berdayaguna dan lebih produktif.

Abstract

Radicalism is a process initiated from the ideas and teachings that stem from individual stages. Hence, the early detection effort in deradicalization by involving women can run effectively, regarding the fact that women play a vital role in the family, particularly in shaping the character of children. Unfortunately, women's role in preventing or promoting and participating, terrorism, and political violence seem to be neglected. This qualitative study attempts to examine the role of women in preventing radicalization and at the same time promoting and participating in alleviating terrorism and political violence. The findings of the study reveal that the role of women in the deradicalization can be done in a number of strategies, although not restricted, such as reduction of gender inequality and disparity, giving women a greater role to participate in a multi-field of the social realm, strengthening the well-being to prevent radicalization, making women as leaders who hold moderate and tolerant values in education, especially within, though not limited, the family environment, and initiating peace through women’s reproductive functions.

Abstract

In contrast to the secular economy of capitalism and socialism, Islamic Economy is the one built on syariʻah bases, norms and divine transcendent values  in the divine revelation, the al-Qurʻan and the ḥadiṡ. In order to understand the essence of syariʻah, it is necessary to conduct shifting paradigm from a literalist approach merely  focusing on textual and legal meaning to a substantialist approach seeking to capture the moral  ideas and   the original meaning of the syariʻah beyond  the text,  which are trans-historical or transcendental being  and universal (general principle).  This paradigm shifting occurs as  the text is limited while the reality is infinite. Among the substantialist  approaches offered is  the use of maqashid syariʻah and mashlaḥah.  Maqashid syariʻah refers to the essence of God's intention (Law Giver), which is the most essential formulated into five elements, they are: حفظ الدين  (the religion keeping), حفظ النفس  (the soul keeping), حفظ العقل  (the intellect keeping), حفظ النسل (descendant keeping) and المال حفظ (the wealth keeping). Then, hierarchically, maqashid in classical theory is developed into 3 levels: الضرورية  (primary needs /basic  necessity), الحاجية  (secondary needs), and التحسينية  (tertiary needs). Under the argument of maqashid syariʻah,  this Islamic economic concept must be developed, therefore  on the one hand the Islamic economy will not lose its divine morality, but on the other hand it can also develop dynamically, progressively and even ready to handle the  contemporary economic problems. Based on the explanation above, this research is focused on what is the basic philosophy that is the basis of the formulation and development of Islamic economics? This research data is library. The data collection method uses the documentation method, namely: collecting, then reviewing the data collected. After the data is collected, the data is analyzed by reducing data, presenting data in narrative form, and drawing conclusions. This study concludes that the Islamic Economy is closely related to the maqashid syariʻah namely ḥifẓ al-mal. Maqashid syariʻah is the basis for the development of the Islamic economy because it aims at the goal of creating human welfare and happiness by balancing the circulation of property fairly and balanced both personally and socially. Understanding of maqashid syariʻah is a necessity in berijtihad to answer various economic problems. Understanding of maqashid syariʻah is not only needed to formulate macroeconomic policies, but also policies that are microeconomic. In the economic context, maqashid syariʻah has a dual role, namely: as a means of control as well as a social engineering tool to realize human equality. He provides a rational philosophical basis of economic activity. Without the maqashid syariʻah, the understanding and practice of Islamic economics will be narrow, rigid, static, and slow. Islamic economics will lose the spirit and substance of its shari'a. But on the contrary, with the maqashid syariʻah the Islamic economy develops elastic, dynamic, in accordance with the character of the Shariʻah Islam which is universal and relevant for all space and time

Abstract

Riba is an economic activity that is prohibited by the Qur’an. Chronologically, the ban has been outlined clearly. On the other hand, bank interest that become one pillar of the existence of financial institutions is rated synonymous with usury. Financial institutions have become a pillar of economic growth. The problem is why the Qur’an forbids usury, whereas various economic activities ‘need’ the existence of interest that are identical to the usury. This study found two findings. First, the prohibition of riba in the Qur’an have preceded other forms of restrictions are more morally intolerable that broadly impacts a major disadvantage in the community. On the other side of the Qur’an strongly encourages the public Makkah to help the poor and orphans around him. Second, the prohibition of riba in the Qur’an has relevance to the real sector of the economy. Therefore, the economy based on usury will naturally ignore the underlying transaction which is the basis of the real sector. As a result of the investors (capitalists) certainly fortunate while the money manager/entrepreneur is still no clarity, so that the position is unbalanced, unjust. The usurious economic system can lead to gaps world community economic growth constantly.

Abstract

The Qur'ān was revealed with justice and equality for human beings regardless of their sex, race, social class, and ethnicity, as cardinal principles and intrinsic values in Islamic sharī'ah. If this is the case, modern Muslim society with Islamic law is necessarily of equality and justice. However, their family laws which are grounded on assumptions of past centuries and have little bearing on contemporary realities have not reflected gender relations. Inequality that occurs within the context of Muslim family laws is one of the subtle but most pervasive areas of discrimination against women. It has resulted in a different set of dynamics that help create new demands in favor of change of laws. This study explores the reform strategy through legal mobilization in the Muslim family laws around the world. The findings of the study reveal that the substantive and pluralistic legal mobilization is important to Muslims, and the reinterpretation and renewal of laws have been mobilizing debates among both proponents and opponents, framed by orientations to the modernists who advocate reinterpretation of the original sources and the traditionalists who insist on literal adherence to the received doctrinal corpus.

Abstract

his research is focused on the regulation of implementing guarantee for halal products in Indonesia and crucial issues related to them. This research is normative juridical research using a statute approach. The conclusions of this study include; first, there are several crucial issues and topics relating to the implementation of guarantee of halal products in Indonesia, namely halal certification, mandatory and voluntary in halal certification, criminal provisions, and halal product guarantee management institutions. Second, the regulation of halal product guarantees when viewed from the Statute Approach can be analyzed using three legal principles: (1) lex superior derogat legi inferiori concludes that all rules for guaranteeing lower halal products are replaced by the higher ones; (2) lex specialis derogat legi generali confirms that the JPH Law is a specific regulation that regulates the guarantee of halal products; and (3) lex posterior derogat legi priori requires that the rules for guaranteeing halal products as contained in the JPH Law replace the guarantee rules for halal products that existed in the previous period.

Abstract

This paper discusses the contribution of maṣlaḥah mursalah Imam Maliki to the development of sharia economic law. Maṣlaḥah mursalah is one of the methods of determining Islamic law initiated by Imam Malik. Based on the author's search, there are at least two conclusions about the contribution of the maṣlaḥah mursalah Imam Malik method to the development of Shariah economic law. First, maṣlaḥah mursalah as one of the approach model in ijtihād becomes very vital in the development of sharia economic law and siyāsah iqtiṣādiyyah (economic policy). Because the new problems in the emerging economics in this global world continue to grow, which textually found no proposition in the Qur'an and al-Sunnah. Secondly, the need for fatwas, especially in the fatwa of DSN-MUI, which is based on maṣlaḥah mursalah (kemaslahatan) becomes very urgent. The demands of the times have required the Muslim jurists to see the complexity of the contemporary problem and choose a more convenient (taysir) and avoiding difficulties (al-ḥaraj); And the emergence of new cases requires the existence of ijtihād by considering this maṣlaḥah mursalah aspect.[]Tulisan ini membahas tentang kontribusi maṣlaḥah mursalah Imam Maliki bagi pengembangan hukum ekonomi syari’ah. Maṣlaḥah mursalah merupakan salah satu metode penetapan hukum Islam yang digagas oleh Imam Malik. Berdasarkan penelusuran penulis, setidaknya ada dua kesimpulan mengenai konstribusi metode maṣlaḥah mursalah Imam Malik terhadap pengembangan hukum ekonomi Syari’ah. Pertama, maṣlaḥah mursalah sebagai salah satu model pendekatan dalam ijtihād menjadi sangat vital dalam pengembangan hukum ekonomi syari’ah dan siyāsah iqtiṣādiyiyah (kebijakan ekonomi). Sebab persoalan baru di bidang ekonomi yang muncul dalam dunia global ini terus berkembang, yang secara tekstual tidak ditemukan dalilnya di dalam al-Qur’an dan al-Sunnah. Kedua, kebutuhan fatwa, terutama dalam fatwa DSN-MUI, yang didasarkan atas maṣlaḥah mursalah (kemaslahatan ) ini menjadi sangat urgen. Tuntutan perkembangan zaman mengharuskan para ahli hukum Islam melihat kompleksitas masalah kontemporer dan memilih pandangan yang lebih memudahkan (taysir) dan menghindari kesulitan (al-ḥaraj); dan munculnya kasus-kasus baru mengharuskan adanya ijtihād memper­timbangkan aspek maṣlaḥah mursalah ini.

Abstract

This study tried to the analyze practices mudharabah fund management in Islamic banking from the perspective of normative and philosophical. Mudharabah is interesting to examine, because the beginning of a substitute interest (riba) is the contract of profit sharing, one of which is based on mudharabah. Mudharabah is also rated as the contract representing equity in the transaction. However, in reality, the application of this mudharabah  is not so simple, there are some problems inside it. The research found some results, among other things: First, the contract of mudharabah is one of contracts that is used by the Islamic bank to manage the funding and financing in order to avoid the practice of interest (riba). Second, ideally, mudharabah  becone  the mainstay products of Islamic banking, both in terms of funding or financing. Because, with the principle of partnership, the two parties are equally benefited. Thirdly, in fact, the bank and the customer will not want for various losses. While the mudharabah practice allows for this. Therefore, it requires tactical steps to minimize the impact of such losses. One of these steps is to conduct the training to prospective mudharib intensively for in terms of professionalism and confidence (trust) it. Further, it requires accompaniment for the candidate of capital manager (mudharib).

Abstract

Fiqh paradigm shift in modern legal system necessitates acceptance of Jurisprudence of the diversity and plurality of the multiperspective such as democracy, human rights, the constitution, guarantee basic rights, and the realities of modern social life. As a product of legislation, modern Islamic law will be loaded with the demands, orientation, interests and voices of various parties to solve the various problems that arise. This paper is going to examine how the role of the scholars of Islamic law in modern legislation. This is related to the change in the legal paradigm of classical Islamic law based on individual ijtihad be based national parliament legislation which necessitates relevance ruling political authorities / parliament as the embodiment of a new meaning ijtihad definitively.
