Abstract

The affirmation of state idea that based upon the law proves that the law is put in an important position in the life of the state as the embodiment of the sovereignty of law. Therefore, every attitude, policy, action or behavior of tools and citizens in the life of the nation obey the applicable rules or laws. It is applied equally to every citizens, no exception to the President as head of state and government. Before the changes to the 1945 Constitution, the President and/or Vice-President can be dismissed for reasons that are political, not judicial. It is happened to President Abdurrahman Wahid that was dismissed from office by the Assembly by not using the constitution of the Republic of Indonesia of 1945 as the legal basis but using TAP MPR number III year 1978.

Abstract

Married siri is carried out by the community, with various shapes and reasons. Scholars who allow their marriage Sirri when harmony and marriage requirements are met, the opportunity for most citizens of the community to do this practice, even in another form that ignores harmony and the terms of the wedding itself. When the mayor is absent or does not approve, they were reluctant to marry guardian judge, but chose to do it Sirri marriage outside legal procedures. They forget that marriage is a strong bond, which binds husbands and wives inwardly and outwardly with certain consequences, both to the couple itself and to children offspring.

Abstract

Products qaul al-qadim law and qaul al-Jadid indicate a change in the product of ijtihad. This paper will address these two problems: How is the social setting ofqaulal-qadim and qaul al-Jadid birth? How is the sociological aspects of the changes of ijtihad al-Shafii? The results of this paper show that the social setting that surrounds al-Shafii both in Iraq and Egypt, does not affect ijtihad al-Shafii methodologically. However, the differences between the circumstances of the Iraq-Egypt potential as new in the spirit of ijtihadqaul al-Jadid by examining the old methods of ijtihad in qaulqadim.

Abstract

Munculnya Perda-perda berbasis syari’ah demikian memunculkan pro dan kontra di masyarakat. Bagi kalangan yang pro-perda berbasis syari’ah, lahirnya perda-perda tersebut dianggap sebagai terobosan untuk menjamin tertib masyarakat, baik dari sisi hubungan antar individu, maupun keterjaminan “moral” individu tersebut di masyarakat. Bagi kalangan yang kontra dengan Perda ini, mereka mengargumenkan bahwa pembentukan Perda berbasis syari’ah dinilai berlebihan, bahkan ada yang menyatakannya secara terbuka bahwa perda-perda tersebut bertentangan dengan peraturan perundang-undangan yang ada. Perda barbasis syari’ah tidak dapat langsung dikatakan baik atau tidak menurut hukum, begitu juga tidak dapat dikatakan sejalan atau bertentangan  dengan peraturan perundang-undangan yang ada. Ada beberapa parameter yang dapat dilakukan untuk melakukan penilaian, yaitu dengan cara Eksekutif Review yang dilakukan oleh Kementrian Dalam Negeri, Judicial Review dilakukan oleh Mahkamah Agung dan Legislatif Review oleh Lembaga Legislatif.

Abstract

The issue of polygamy is a hot issue that to be debated continuesly. One side polygamy is claimed as exploitation and hegemony of male to female. On the other hand, polygamy is seen have normative reference and it considered as one of the solutions to solve the problems of in infidelity and prostitution. The Indonesian government has been reform the rules of polygamy. In KHI, although it adheres to the principle of monogamy, but the government is still open opportunity for polygamy. However, this rule of KHI is critized bythe dayah scholars of North Aceh. The overview of Ulama dayah is that polygamy rules made by the government out of the Shari’a corridors. Also that issueto be politicied and adopt the rules of the west to complicate polygamy practise and legalized prostitution. Therefor, this study aim to examine and analyze the rules of KHI regarding polygamy from sharia aspect, social, cultural, welfare and others. Also, analyze and critize the views and thoughts of dayah scholar about the rules of polygamy in KHI.

Abstract

Autenticity of  istihsan as syara` argument disputed by scholars. Group of Hanafiyah, Malikiyah, and most Hanabilah scholars use istihsan as an argument, but Syafi`iyah, Zhahiriyah, Mutazili, and Shia scholars reject istihsan. The dispute happened because the difference of interpreting of istihsan. The scholars who use as argument interpret istihsan as turned away from will of qiyas to more powerful qiyas or specialized qiyas because there is stronger evidence thereof, meanwhile, scholars who refuse define istihsan as all things considered good by the mujtahid by his wits. Substantively all scholars, both who use and who reject istihsan using it in some law conclusion, although scholars who reject not call it as an istihsan. They categorize it as a qiyas.
