Abstract

The role of witnesses in a criminal act is very important in order to reveal the truth. The existence of a suspect witness (justice collaborator) is an effort in tackling drugs. However, justice collaborators also need legal protection because of their position as witnesses and perpetrators. The purpose of this study is how the legal protection of the perpetrator's witness who cooperates (justice collaborator) in uncovering narcotics crimes is associated with the theory of justice by applying an approach method that uses the positivist conception of legis. Based on the data collected, the rules for applying criminal sanctions for witnesses of perpetrators who cooperate (justice collaborators) have yet to find a clear and definite meeting point. It is regulated in Decision Number 297/Pid.Sus/2020/PN.Sgm that according to the Panel of Judges the defendant during the trial was unable to show facts that could reveal the existence of new actors in his case, let alone the defendant gave convoluted information that could complicate the trial, so that the defendant cannot be declared as a witness to the perpetrator who cooperates (justice collaborator) as stipulated in the Circular Letter of the Supreme Court (SEMA) Number 4 of 2011 concerning the treatment of the Whistle Blower and Justice Collaborator.

Abstract

Abstract: Criminal law is identical as miserable law, considering that criminal law is a means of last resort. Even though in its application, punishment must still prioritize the humanitarian element. Criminal law in Indonesia requires reform, because the substance of the Criminal Code is outdated and no longer in accordance with the objectives of criminal law as a means of protection and public welfare. This normative legal research uses a statutory and conceptual approach with prescriptive analysis techniques. The results of the research show that the Draft Criminal Code uses pro-Pancasila ideas and strategies as the philosophy of the Indonesian nation. Various forms of reform such as criminal alternatives, the development of the idea of balance, even the recognition of customary law which, although not written, upholds religious values, morality and humanity. Legal politics based on Pancasila, ideally contained in the formation of the concept of Indonesian criminal law, is an important substance and becomes a framework for the nation's morality from the threat of continued development of crime as a result of the evolving era.Keywords: Political Law, Criminal Law Reform, PancasilaAbstrak: Hukum pidana identik sebagai hukum yang menyengsarakan, hal ini mengingat hukum pidana merupakan sarana pengobat terakhir. Meskipun dalam penerapannya, pemidanaan harus tetap mengedepankan unsur kemanusiaan. Hukum pidana di Indonesia memerlukan pembaharuan, karena substansi KUHP telah usang dan tidak lagi sesuai dengan tujuan hukum pidana sebagai sarana perlindungan dan kesejahteraan masyarakat. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan dan konseptual dengan teknik analisis preskriptif. Hasil penelitian menunjukkan bahwa Rancangan Kitab Undang-Undang Hukum Pidana menggunakan ide-ide serta strategi pro-Pancasila sebagai falsafah bangsa Indonesia. Berbagai bentuk pembaharuan seperti alternatif pidana, pengembangan ide keseimbangan, bahkan pengakuan atas hukum Adat yang sekalipun tidak tertulis, menjunjung tinggi nilai religius, moralitas dan kemanusiaan.  Politik hukum dengan berasaskan pada Pancasila, idealnya terkandung dalam pembentukan   konsep   hukum pidana Indonesia, merupakan substansi penting dan menjadi kerangka moralitas bangsa dari ancaman terus berkembangnya kriminalitas sebagai dampak dari zaman yang terus berkembang.Kata Kunci: Politik Hukum, Pembaharuan Hukum Pidana, Pancasila

Abstract

Abstrak: Notaris mempunyai kewajiban untuk menjaga kerahasian terkait akta yang dibuatnya, oleh karenanya UUJN memberikan perlindungan terhadap Notaris melalui Pasal 66 yang menentukan bahwa untuk kepentingan Penyidikan, Penuntut Umum dan Hakim dengan persetujuan MKN dapat mengambil fotokopi Minuta Akta dan/atau surat-surat yang dilekatkan pada Minuta Akta atau Protokol Notaris dalam penyimpanan Notaris dan memanggil Notaris untuk hadir dalam pemeriksaan yang berkaitan dengan Akta atau Protokol Notaris yang berada dalam penyimpanan Notaris. Penelitian ini bertujuan untuk mengetahui serta menjelaskan tentang kedudukan MKNW dalam sistem hukum Indonesia dalam memberikan surat persetujuan terhadap pemeriksaan Notaris dalam proses Penyidikan. Jenis penelitian yang digunakan adalah yuridis normatif dengan pendekatan undang-undang, pendekatan konseptual dan  pendekatan sejarah. Hasil penelitian ini adalah bahwa MKNW memenuhi unsur-unsur sebagai Badan/Pejabat Tata Usaha Negara yang diatur dalam UU PTUN dan UU Administrasi Pemerintahan. MKNW menjalankan urusan pemerintahan berdasarkan UUJN. Selainjutnya Surat persetujuan MKNW terhadap pemeriksaan Notaris dalam proses Penyidikan juga memenuhi unsur-unsur sebagai Surat Keputusan Badan/Pejabat Tata Usaha Negara yang diatur dalam UU PTUN dan UU Adminitrasi Pemerintahan.Kata Kunci: Majelis Kehormatan Notaris Wilayah, kedudukan MKNW, Pengadilan Tata Usaha Negara, Notaris, Penyidikan. Abstract: Notaries should maintain the confidentiality of the deed and the Notary Protocol that is to be stored based on the provisions of the Law on Notarial Position (UUJN) and the Notary Position Code of Ethics. In essence, the UUJN protects Notaries through Article 66 of the UUJN which stipulates that for the investigation, the Public Prosecutor and Judge with the approval of the Notary Honorary Council (MKN) can have a copy of the Minutes of Deed and/or letters attached to the Minutes of Deed or the Notary Protocol in the Notary's storage.  Additionally, it also can summon the Notary to be present in the inspection related to the Notary Deed or Protocol that is in the Notary's storage. This study aims to explain the position of the Regional Notary Honorary Council (MKNW) in the Indonesian legal system related to the MKNW approval letter for the examination of a Notary in the Investigation process. This study also explains the court's Absolute Competence in examining, deciding, and resolving lawsuits against the MKNW approval letter. This research used normative juridical through utilizing the law, conceptual, and historical approaches in conducting the data. The sources of legal materials in the study are secondary data consisting of primary, secondary, and tertiary legal materials. The result of this study indicates that MKNW fulfills the elements as a State Administrative Agency/Officer based on the provisions of the Law on State Administration and the Law on the State Administrative Court. This also shows that the MKNW approval letter for the Notary Examination in the Investigation Process fulfills the elements as a State Administrative Decree. Furthermore, based on the provisions in the Government Administration Law and the State Administrative Court Law, it can be determined that the lawsuit dispute related to the MKNW approval letter against a Notary examination in the Investigation process is the Absolute Competence of the State Administrative Court in order to examine, decide and resolve the disputes. The suggestion derived from this study is the hope that there will be administrative efforts that can be taken by a Notary to resolve the problems related to objections to the MKNW approval letter against a Notary examination in the Investigation process. In addition, it is hoped that the Supreme Court will be able to stipulate the Supreme Court Regulations concerning Guidelines for Judicial Body Dispute Resolution. In this case, the settlement of lawsuits against the MKNW approval letter is the Absolute Competence of the State Administrative Court.Keywords: Regional Notary Honorary Council, MKNW Position, State Administrative Court, Notary, Investigation

Abstract

For maintaining the existence and preservation of natural resources, in this case namely the Provincial Government of South Kalimantan has organized a groundwater conservation program. However, this policy must in accordance with the provisions of Islamic teachings because this district is inhabited by the majority of the Muslim community. The research aims to describe the overview of groundwater conservation policy in the Provincial Regulation of South Kalimantan Number 5 of 2018 on Groundwater Management and an ecological fiqh perspective on the groundwater conservation policy. This study uses the literature study method with a normative juridical approach. Its’ legal material is the Provincial Regulation of South Kalimantan Number 5 of 2018 on Groundwater Management and other related regulations. The results showed that the groundwater conservation policy in South Kalimantan was carried out with three programs, namely: groundwater protection and preservation, groundwater conservation and groundwater conservation, and determination of groundwater conservation zones. The policy is implemented by involving community participation. The groundwater conservation policy of South Kalimantan Province in terms of Ecological Jurisprudence is a form of embodiment of the teachings of environmental wisdom that can strengthen intellectual and spiritual aspects, including the concept of monotheism.

Abstract

Abstract: The legality of a company, an enterprise, or a business entity is compulsory to be accomplished before the establishment. The legality is represented by the company registration. This research aims to explore and analyze the legality, analyze the legal consequence, and describe the registration procedures for a company that has been registered after the Law of Mandatory Company Registration was repealed. The method of this research is normative legal research using the statute approach and conceptual approach. As the results of this study, it is found that a company registered after the repealing of the Mandatory Company Registration Law is still legal for the law. However, the company should reregister to obtain the maximum benefits from the country. A Limited Partnership (Commanditaire Vennootschap), General Partnership, and Limited Liability Partnership (Matschaap) that have been registered in the district court after the repealing of the Mandatory Company Registration Law must be reregistered through an enterprise management system by using an online single submission (OSS). The regulations in the Law of Mandatory Company Registration and other related regulations are no longer valid according to the regulations in Job Creation Law Article 116 chapter VI section 9Keywords: Implications; Mandatory Company Registration; Job Creation Abstrak: Legalitas badan usaha merupakan hal yang wajib dipenuhi sebelum mendirikan usaha. Legalitas tersebut tercermin dengan di daftarkannya badan usaha. Penelitian bertujuan untuk untuk mengkaji dan menganalisis legalitas hukum, menganalisis konsekuensi hukum yang timbul, serta untuk mengkaji dan menjelaskan mekanisme pendaftaran perusahaan yang telah terdaftar pasca pencabutan UUWDP. Jenis penelitian yang digunakan adalah yuridis normatif, pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach). Hasil penelitian dapat di jelaskan bahwa perusahaan yang telah terdaftar setelah UUWD dicabut oleh UUCK, perusahaan tersebut tetap legal dimata hukum. Akan tetapi idealnya perusahaan tersebut di daftarkan ulang untuk memperoleh manfaat yang maksimal dari Negara. Perusahaan yang berbentuk persekutuan komanditer, persekutuan firma dan persekutuan perdata yang telah terdaftar di pengadilan negeri setelah UUWDP dicabut harus melakukan pendaftaran ulang melalui sistem administrasi badan usaha dengan mengimplementasikan online single subsmission. Regulasi undang-undang wajib daftar perusahaan dan aturan turunannya tidak berlaku lagi sesuai dengan ketentuan Pasal 116 bab VI bagian kesembilan UUCK.Kata kunci: Implikasi; Wajib Daftar Perusahan; Cipta Kerja

Abstract

Abstract: The issues related to political dowry are interminable. This interminability is the result of an indication of political dowry every time a general election or local election is held. Based on that background, this article describes the political dowry’s detailed problems. In the beginning, the writer describes the definition of political dowry and its differences from political cost, the reasons for the restrictions, and the law enforcement on political dowry. It ended with some efforts to prevent political dowry. It is found that the definition of political dowry is different from political cost. The regulations restrict the practice of political dowry, but not for the political cost. The political dowry is restricted by law because it is against the national law’s interest, which is the interest to have qualified and fair general elections and local elections. Heretofore, there is no legal punishment for the practice of political dowry due to the difficulty to prove the practice. There are some efforts to prevent the practice of political dowry: First, giving intensive supervision from The General Election Supervisory Agency (Bawaslu) and its subdivisions; Second, revising the regulations in the Law of the Local elections for nominating the candidates; Third, revising the regulations in the law of political parties for nominating the candidates of the president and local government; Fourth, assigning the time limitation for the political parties to accept the political cost; and Fifth, enhancing the legal awareness of all parties involving in the practice of general elections or local elections.Keywords: Political Dowry; Political Cost; General Election; Local Election Abstrak: Isu mengenai mahar politik sepertinya tidak ada habis-habisnya. Isu tersebut menyeruak karena adanya indikasi praktik mahar politik itu terjadi setiap penyelenggaraan pemilu ataupun pilkada. Dilatarbelangi oleh keadaan tersebut, melalui karya ilmiah ini akan digambarkan seluk beluk dari masalah mahar politik tersebut. Pada bagian awal akan menggambarkan pengertian dari mahar politik  dan perbedaannya dengan ongkos politik (cost politics), lalu dilanjutkan dengan alasan dilarangnya praktik mahar politik itu, penegakan hukum dalam perkara mahar politik, dan diakhiri dengan upaya untuk mengatasinnya. Dari penelaahan yang dilakukan diketahui bahwa pengertian mahar politik itu tidak sama atau berbeda dengan ongkos politik, yang dilarang dalam legislation adalah praktik mahar politik, ongkos politik tidak dilarang. Alasan praktik mahar politik itu dilarang dalam legislation adalah karena perbuatan itu menyerang kepentingan hukum negara, yakni kepentingan dalam rangka terlaksananya pemilu ataupun pilkada yang adil dan berkualitas. Sejauh ini belum ada penjatuhan pidana terhadap praktik mahar politik, di mana hal tersebut dikarenakan sulitnya membuktikan praktik tersebut. Beberapa upaya yang dapat dilakukan untuk mengatasi praktik mahar politik itu adalah: partama, mengintensifkan pengawasan Bawaslu dan jajarannya; kedua, merevisi aturan tentang pencalonan dalam Undang-Undang Pilkada; ketiga, merevisi aturan tentang rekrutmen pencalonan presiden dan kepala daerah dalam   Undang-Undang Partai Politik; keempat, menetapkan batas waktu partai politik boleh menerima ongkos politik; dan kelima, meningkatkan kesadaran hukum semua pihak yang terlibat dalam penyelenggaraan pemilu atau pilkada.Kata kunci: Mahar Politik; Ongkos Politik; Pemilu; Pilkada

Abstract

Abstract: The problem of gender inequality is a significant concern in the dynamics of Islamic law. The meaning of the verses of the Qur'an in this matter is strongly influenced by the social constructs surrounding it. This article aims to find Bisri Mustofa's thoughts in Al-Ibrīz li Ma'rifah Tafsīr al-Qur'ān al-'Azīz about verses with the theme of gender and women. This paper uses a descriptive qualitative method. The data collected were analyzed using the theory of hermeneutic philosophy and the theory of gender equality by Mansour Fakih. This article finds that Bisri Mustofa's interpretation tends to be gender-biased due to the Javanese culture surrounding it.Keyword: gender; tafsīr; al-Ibrīz; Javanese culture Abstrak: Problem ketimpangan gender menjadi perhatian utama dalam dinamika pensyariatan Islam. Pemaknaan ayat-ayat al-Qur'an dalam masalah tersebut sangat dipengaruhi oleh konstruk sosial yang mengitarinya. Artikel ini bertujuan untuk menemukan pemikiran Bisri Mustofa dalam kitabnya yang berjudul Al-Ibrīz li Ma'rifah Tafsīr al-Qur'ān al-'Azīz tentang ayat-ayat Al-Qur'an dengan tema gender dan perempuan. Tulisan ini menggunakan metode deskriptif-kualitatif. Data yang terkumpul dianalisis menggunakan dua teori; teori filsafat hermeneutika, dan teori kesetaraan gender Mansour Fakih. Arikel ini menemukan bahwa penafsiran Bisri Mustofa cenderung bias gender. Kecenderungan ini disebabkan oleh budaya Jawa yang melingkupinya.

Abstract

وجدنا كثيرا من القضايا والفتاوى في المعاملات المالية المعاصرة تستند في إصدارها إلى الحاجة، فيقول المفتي: هذا العقد جائز لوجود الحاجة إليه، ويقول المفتي الآخر هذا العقد لا يجوز لانعدام الحاجة إليه. يقول هؤلاء المفتون بهذا الإطلاق دون أن ينظروا إلى ضوابط وشروط الحاجة. فالحاجة إجمالاً تفيد التيسير والترخيص، ولكن ليس كل حاجة تفيد التيسير والترخص بحيث هناك الضوابط والشروط للحاجة لتنزل منزلة الضرورة في تحليل المحرم. خلال هذا البحث وجد الباحث أن شروط إعمال الحاجة هي: أن تكون الحاجة بالغة درجة الحرج والمشقة غير المعتادة، وأن تكون الحاجة متحققة يقينا أو ظنا، وأن تكون الحاجة متعينة، وألا يكون في الأخذ بالحاجة مخالفة لقصد الشرع، وألا يعارض الحاجة ما هو أقوى منها. ثم قام الباحث بتحليل هذه الشروط على مسألة أثر الحاجة في المساهمة في الشركات المساهمة المختلطة فوجد أن هذه الشرو لم تتوفر في هذه المسألة.

Abstract

 During the co-19 pandemic there were many obstacles in the economy, inevitably also in the Banjarmasin City area of South Kalimantan Province, various efforts were made to maintain the course of the economy in this region, all strategies were carried out, but it seems that there is still one contract system that can still survive, namely the Bahaupan contract system which is a contract system owned by the Banjar community in Banjarmasin City. This research is empirical research with a legal sociology approach, through the medium of direct observation and interviews in the field to economic entrepreneurs during the Covid-19 pandemic. Some of the results found are: Akad Bahaupan can still be used during the Pandemic, entrepreneurs use the latest methods in managing their businesses during the Pandemic, and still always increase prudence in carrying out economic activities. Dimasa pandemi covid-19 banyak sekali terjadi kendala dalam perekonomian, tidak terelakkan juga pada wilayah Kota Banjarmasin Provinsi Kalimantan Selatan, berbagai upaya dilakukan untuk mempertahankan jalannya perekonomian di wilayah ini semua strategi dijalankan, akan tetapi nampaknya masih ada satu sistem akad yang masih dapat bertahan, yaitu sistem akad Bahaupan yang merupakan sistem akad yang dimiliki oleh masyarakat Banjar di Kota Banjarmasin. Penelitian ini bersifat penelitian empiris dengan pendekatan sosilogi hukum, melalui media observasi dan wawancara langsung di lapangan kepada para pengusaha ekonomi dimasa pandemi covid-19. Adapun beberapa hasil yang ditemukan adalah: Akad Bahaupan masih bisa digunakan dimasa Pandemi, para pengusaha menggunakan cara-cara terbaru dalam mengelola usahannya dimasa Pandemi, dan tetap selalu meningkatkan kehati-hatian dalam melangsungkan kegiatan perekonomian.
