Abstract

Considering the important role of historical, cultural, social, and attitudinal aspects in the study of law, there has been a shift from instrumental law to constitutive law. While instrumental law considers law beyond the social and cultural spheres, constitutive law integrally embraces law, politics, ideology, and action. Legal consciousness is an important asset for marginalised people who are at high risk of discriminative treatments in occupational and social life. Not only will they are legally aware of their rights and obligations at works, they will have adequate knowledge of where and how to name, blame, and claim in case mistreatment do occur. Legally proficient will allow them build legal protection which is not adequately provided by the authorized bodies.

Abstract

Fatwa of DSN-MUI No.77 / DSN-MUI / V / 2010 issued on June 3, 2010 states that selling and buying gold with non-cash payment is allowed (mubah) as long as the gold is not as the official medium of exchange (subtituting money) either through purchase or ordinary selling murabaha.This fatwa is controversial among scholars. Some argue that this fatwa is in contrast to the hadiths explaining that it is not allowed to sell an usury item with other item unless it is cash. It also should not be selled by loan although the items are in different types and sizes. The authors are interested in doing research with a focus on two issues, namely: the method of istinbath in a fatwa of DSN law on non-cash trade in gold and its relation with National Sharia Board Fatwa No.77 / DSN-MUI / V / 2010 On Selling and Buying Gold Non-Cash with four Imam sect.

Abstract

The development of tariqat in Indonesia is historically and sociologically related to the climate and culture of the people who in the past was formed by rural culture. However, in recent developments, in South Kalimantan for example, the assumption is very different. Although, this tariqat is usually described as traditional, backward, and associated with the countryside, it is not entirely true. With its tradisional nature, the tariqat become attractions for scholars. Those with rational thingkings entering this world with diverse motivations. There are two complementary sides. On the one hand, rational intellectuals/scholars enter into the tariqat and give a new baseline. On the other hand, the members of the tariqat also renew themselves. Motivations that drive the interest to this tariqat are doctrinal, rational, moral, and psychological. This motivation does not stand alone; it is intertwined and supports each other, in the internalization of the tariqat into the consciousness of the individual.

Abstract

Cultural Values Urang Banjar research has not been done. This study refers to the dimension of cultural values being addressed Troompenaar. According Troompenaar cultural values have seven dimensions: individualism - Communitarism, specifik Relationship - Diffuse relationship, Universalism - Particularism, Neutral Relationship - Emotional Relationship, Achivemenent - ascription, Sequential time - Synchoronous time, and the Environment. Results of research conducted Troompenaar in Indonesia, indicating Indonesia is in the category Communitarism, Diffuse relationship, Particularism, Neutral Relationship, ascription, Synchoronous Time and Outter Direction. This study uses primary data collected through questionnaires which had been prepared previously by the indicators Troompenar dimensions of cultural values. The total sample was 192 people. The research focuses on is the Banjar, and its relation to the cultural values of Banjar. The conclusion of this research are (1) The value of Banjar culture included in the category of universalism with a percentage of 78.13 percent, Komunitariasme with the percentage of 79.17 percent, with the percentage Emotional 73, Specification with the percentage of 54.17 percent, with the percentage of 76.04 percent Achievement, synchronous with the percentage of 69, 79 percent, and Outter direction with the percentage of 83.33 percent; (2) There was a difference or shift in cultural values in society Banjar with Indonesian cultural values, from particularism into Universalism, from Neutral became Emotional, of Diffuse be Specific, and of ascription becomes Achievement; (3) The difference in the value of Indonesian culture and cultural values Urang Banjar indicate that changes peoples lives, especially people Banjar ongoing and will never stop, because no one masyarakatpun that stops at a certain point all time. The difference or shift in cultural values that occurred in Banjar Urang an ongoing process of social change in society Banjar.

Abstract

The Islamic teachings contain various moral and ethical values which is very important in todays modern era because Islam always concerns with the balance between body and spirit, inward and outward, spiritual and the material, between world and hereafter. Islam can provide moral and ethical values in the development of science. With religion, it is expected that man does not forget himself after successfully developing science, and aware that the science he developed is an ongoing effort within the framework of worship. Therefore, through science, humans will find the ultimate truth that is God. Science is one of the strategic doors to bring people closer to God through intensive and serious effort to consider the universe to the perfection of human life, both physically and spiritually. Through the integration of science and religion developed in PAI (Islamic Education), it is expected to produce the learners who have a scientific attitude, scientific responsibility, capability of utilizing science and become ululalbab.

Abstract

Indonesia is a country that is predominantly Muslim, so that Muslim consumers certainly get the protection of the goods and/or services in accordance with Islamic law. Because the protection of the rights of every citizen of Indonesia. Khiyar is one form of consumer protection in Islam. Surely, khiyar as one of the forms to protect the rights of Muslim consumers are contained in the Consumer Protection Law. This thesis aims to determine: (1) Existence khiyar in Law No. 8 of 1999 on Consumer Protection, and (2) Analysis of the existence of khiyar in Law No. 8 of 1999 on Consumer Protection. This research is a normative law (normative legal research), namely legal research conducted by examining the legal material. The approach taken in this study is the statute approach and the conceptual approach. Based on the method used produced the conclusion that the existence khiyar in Law No. 8 of 1999 on Consumer Protection, contained in article 4, which khiyar ‘aib and khiyar syarath with the right to safety (article 4 letter a), khiyar majlis and khiyar tayin with the right to choose (article 4 letter b), khiyar tadlis and khiyar ‘aib with the right to be informed (article 4 letter c and h), and khiyar ruyah with the right to be heard (article 4 letter d ). Existence khiyar in article 4 of the Law No. 8 of 1999 on Consumer Protection in terms of the Islamic economic law in accordance with the rules of fiqh, maqasid shariah, and fiqh.

Abstract

This study focused on the figure of KH Muhammad Ridwan Baseri who is popularly known as Guru Ridwan Kapuh. This figure is a charismatic ulama in Hulu Sungai Selatan regency, South Kalimantan, in the study of Sufism. This research is a field research using descriptive analysis and sociological approach which refers tobehavioral aspects implemented in Al-Hidayah located in Kapuh Simpur, Hulu Sungai Selatan. This studyexplained thatGuru Ridwan Kapuh is the descendantof Datu Kalampayan, and the student of Guru Sekumpul Martapura. Sufism gives a strong color to Guru Ridwans life. He teaches the book of tasawuf in accordance with the present context, for example mahabbah, trust, ascetic/zuhud in the present context.
