Abstract

The  aim of the research  to create the model of social construction of textile labor about  Demonstration and view of labor relations that is expected.The method used is  qualitative method with phenomenology tradition.  The research subjects are  10 labor consist of 4 textile labor and 6  labor activists in  Kabupaten  Bandung, in  criteria that the informant have ever and always get  involved  in every demonstration. Through  depth interviews and observation, gained the informant ‘s statements  of experiences, comprehension, behavior and  communication meaning The research has been being carried out  since  2006. The result of the research  indicates that labor’s comprehension about demonstration is not only the secret and main weapon to  fight for their better fate. The labor realize that demonstration is important but it is not the only way to express of  their aspiration. Bipartite communication (labor-industrialist)  in form of  negotiation is better way. Demonstration is done  when  there is a deadlock  situation in  communication and negotiation between labor and industrialist. Demonstration  also happen  when the governments on the industrialist side or it ignore the labor’s need. Labor demonstration is   social link of a long history: Class politic; exploitation; domination of bourgeois; fight of practical interest, ideology and culture in productive relations. The reason of the textile labor demonstration is caused of wage system and  basic needs as human being, family and collective. Industrialist’s awareness of labor’s  life improvement is still low. Communication meaning  of demonstration: communication gap, exploitation, discrimination, pressure and powerlessness of labor.

Abstract

   The decision to implement the privatization of State Owned Enterprises (SOEs) in Indonesia was essentially due to the circumstances that they are not considered self-reliant and not perform, and therefore privatization is an alternative course of action to reform SOEs.  The privatization of the SOEs, however, raises the question whether the private management of SOEs as a business entity can still preserve the public interests.  Based on the abovementioned arguments, the purpose of this  research are:  first, to formulate the state’s management strategies based on company law in order to enhance the role of SOE’s as a mainstay of Indonesia's economic development; second, to formulate the function of golden shares in the privatized SOEs and its implication with the principle of justice in developing the Indonesian economy; and third, to formulate the regulatory privatization perspective of the SOEs as the driver of Indonesia’s economic development in realizing the aspiration of a welfare state.         This research  uses a normative juridical approach, namely to assess and examine logically the legal aspects of the underlying strategy of SOE management and their application in-concreto.  Therefore, the specification of the research is descriptive analytic.  In this study the principal data is the secondary data, while the primary data obtained are employed as supporting the secondary data.  Subsequently, research data were analyzed qualitatively.Based on the analysis and deliberation, the obtained conclusions are as follows: First, the SOE's role as a mainstay of Indonesia's economic development  has not been implemented as expected due to the existence of the various provision in the Act of SOE’s that give multi-interpretation in the management of SOE’s. Therefore the role of the SOE’s, so as to support Indonesia’s economic development, has not optimally achieved. Second, the function of the golden share  has yet to fulfill a sense of justice to the community as stated in Article 33 paragraph (2) and (3) of the 1945 Constitution fourth Amendment during the privatization of SOE’s because it has not being used in accordance with its intention.  Third, the government must strictly regulate the privatized shares of  not more than 49 %.

Abstract

This research was aimed to find the construction of self involvement meaning and the motive in information literacy movement, it was also to explore the experience of information literating and communicating from individuals that were involved in Komunitas Literer Bandung. Apart from participation observation and literature studies, data was gained from series of deep interviews with 15 individuals involved in Komunitas Literer Bandung that were divided into three groups, which are initiators and owners, organizers, and the members of Tobucil N Klabs, Rumah Buku/Kineruku, Zoe Cafe and Library, Potluck Coffee Bar and Library, and Ultimus.   The result of the research indicated that individuals involved in Komunitas Literer Bandung have constructed several meanings of self involvement, where motivation and hope were the aspects that urge their involvement. Establishing, developing and taking advantage of homy information literating places; making spesific literation activities; and having unique information literation regulations were their way of information literating. Furthermore, they established and developed kinship communication and partnership communication, through interpersonal communication, small-group communication, and online commmunication. This research also found that individuals involved in Komunitas Literer Bandung not only absorbed knowledge, but also expressed themselves, by becoming a part of the community, to build and construct knowledge  as a process of becoming a literate society; smart, critical and etical independent life-long learners.

Abstract

Inter-faith marriage, such as Islam-Catholic marriage has been a certain reality for we cannot deny its existence in the society even though some people think of it as unusualness. The principal interpretation of each religion, the rule of law, and the potential of horizontal latent conflict in the community marginalize that marriage. However, it is interesting that the practice exists and becomes a choice for couples who want to get married. This study attempts to explore the communication patterns of the inter-faith couples. Using social phenomenology approach, the researcher applied in-depth interview to elaborate the comprehension of ten informants from Javanese involved, especially the comprehension on their account of their marriage and their communication experience authentically in the adaptation process during the marriage. The result of the research shows two inter-faith account in practice; understanding and social justification account. The former means a love-based account which states that someday everybody will accept the reality, while the latter means a love-based motive and there is a belief that there is nothing different in that marriage. Every inter-faith marriage doer has low-fidelity religious affiliation or they may have a pluralistic theological interpretation with minimal resistance from significant other. The researcher also reveals that communication experience is an inseparable inter-subjective experience in conflict management and decision making process to reach the agreement on some problems they have, such as the wedding ceremony, the religion symbols in their house, the religious education for their children, the daily ritual and religious celebration, and also the problem in communicating their family identity to their neighborhood.

Abstract

Global warming and climate change in the world cause the degradation of environmental quality.  This problem is a modern and complicated and source by development activity and policy of the state related environmental protection and management. International corporation through the international convention is one of effort can be done to solve that problem and implemented by the United Nations Framework Convention on Climate Change. Indonesia legal system regulate the ratification of the international convention, this process face a lot of difficulties for imply especially ini environmental matter. Regional autonomy give opportunity and also challenge for implementation of international convention in unity state for guarantee the sustainable development for present and next generation.Descriptive Analytical methodology is used for this research in order to gain a comprehensive idea about climate change and environmental law. The law and regulation approach used is legal normative, systematic conducted toward the related constitution. Technique of data collection was done through literature study and field research to collect primary and secondary data.International convention related to climate change ini Indonesia can not be apply effectively in local/ regional, because of there is no regulation related to ratification thought international convention related to environmental matter in law and regulation shape for local government refer to comply the local policy related to it. In order to sustainable development implementation, law related to environmental protection and management must be the umbrella provision for every activities in Indonesia including compliance and enforcement environmental law related to climate change for protection environmental function  for   present and next generations.

Abstract

The research used the qualitative method through the case study of Nyai leadership in the Dinniyah Boarding School, Lampung. The results of the research show that: 1) The leadership strategy of Nyai consisted of : planning, cross- sector networking/cooperation, good relationship, socialization of boarding school, and visits to other boarding schools, 2) The function of Nyai communication involved giving information, getting relationship, conveying message, educating, changing attitude/behavior, persuading through Islamic preaching. 3) The leadership communication technique of Nyai consisted of : persuasive, dialogue, coercive, participative, and transcendental, 4) The communication pattern developed by Nyai was oral communication which tend to formal communication pattern and persistent to obidince or religion norms and The leadership communication model of Nyai in the boarding school was the discipline, autonomy, harmony, and relationship based leadership communication model as well as the conceptive and creative leadership of Nyai.

Abstract

Matrimonial property has the economic value that can become a guarantee object for the credit contact, whereas the husband and wife bound in legal marriage have equal rights and obligations upon their matrimonial property. There was three identified problems as follows : (1)  is about the equal position between husband and wife based on principle of justice in credit contract which may lead to the liability in the settlement of their debt, (2) with regard to the legal certainty of their matrimonial property as a guarantee for their credit contract when a marriage was terminated, (3) a perspective of matrimonial property related to the development of national property law.This research applies juridical normative and descriptive analysis approaches. This research undertaken by library research and field research as the supporting data. For analysing data, it was used in normative qualitative method.The result of this research showed that, firstly, the equal of rights and duties between husband and wife on matrimonial property given the rights to conclude credit contract with matrimonial property as a gurantee object. Secondly, husband and wife that conclude credit contract with matrimonial property should fulfill for the payment of their debt as a legal certainly for creditors, no matter if the marriage was terminated. Thirdly, matrimonial property that is used as the guarantee object must be subjected as the unity property and as a part and parcel of their property as long as debts is paid.

Abstract

The development of smallholder’s oil palm plantations rapidly since the last two decades have brought to extensive impact on social change in rural communities in the West Pasaman, mastery pattern changes that result in changes in an increasingly complex social stratification and changes in form and function of social institutions and lifestyles.This research was conducted in Nagari Kinali using the qualitative approach, data collection through observation, interview and documentation study. The focus is the impact of smallholder’s oil palm to changes in social stratification, social institutions and attitudes of rural socioeconomic conditions.The results showed that the presence of smallholder’s oil palm resulted in change of stratification of the people who increasingly prominent and complex patterns of land tenure based on the emergence of rich peasants, small farmers and agricultural laborers. In a social institution widespread changes in family to the nuclear family, work patterns that are of mutual aid to the use of farm workers, kinship-based socialization is replaced by formal education and no longer existense of surau as an educational institution boys.
