Abstract

Information technology plays an important role for the present and the future which in itself changes people's behavior. Information technology contributes to the law of evidence in Indonesia with the recognition of electronic evidence. In 2016, the Constitutional Court of the Republic of Indonesia issued the Constitutional Court Decision Number 20/PUU-XIV/2016 which had a juridical impact on changing the definition of legal electronic evidence. This decision is considered contrary to the spirit of the ITE Law and causes a blurring of norms regarding the legal position of electronic evidence. The purpose of this study is to examine the legal regulation of the position of electronic evidence and the legal consequences of the Constitutional Court's decision Number 20/PUU-XIV/2016. This research is classified as qualitative research with a normative juridical method, so that the sources used come from library data, both primary, secondary, and tertiary legal sources. The results of this study state that the legal arrangement for the position of electronic evidence in Indonesia in the ITE Law has changed since the Constitutional Court Decision Number 20/PUU-XIV/2016 which has provided an interpretation of the phrase electronic information and/or electronic documents in article 5 paragraph (1) and paragraph (2), and article 44 letter b of the ITE Law regarding the provisions of legal evidence and has implications for the function of electronic evidence in criminal law, namely the emergence of legal uncertainty over the validity of electronic evidence in court and the occurrence of differences in interpretation in law enforcement.

Abstract

In 2021, the government start discussing licensing for foreign investors to search for sunken ship cargo objects (BMKT) under Indonesian waters. This study focuses on normative juridical research by reviewing regulations regarding foreign investment in the lifting of sunken cargo objects (BMKT) in Indonesia and permits for trying to lift sunken cargo objects (BMKT) in the regions. The results obtained are that the regulations have not been specifically regulated, for foreign investment itself it is still running in accordance with the applicable general investment regulations, but specifically for foreign investment in the Lifting of Submerged Ships (BMKT) it is still not optimal and business licensing in The regional government for the Lifting of Sunken Ships (BMKT) for foreign investment is also still not optimally regulated, but Government Regulation No. 6 of 2021 shows that the role of local governments in providing business permits is quite significant through the regional apparatus of the Investment and Integrated Services Agency. One Gate, as well as local governments can provide business licensing matters in accordances with the needs of the region

Abstract

This article examines how the implementation of the Regulatory Impact Assessment in assessing the regulations issued by the Indonesian government regarding the use of domestic products in the procurement of goods / services, namely the application of these rules in the practice of government procurement of goods / services as well as in State-owned enterprises. Analysis of the Impact of Regulations on the Use of Domestic Products can show that the crucial point of the Regulation for the Use of Domestic Products is that there are no rules regarding criminal sanctions if the use of domestic products is not applied in the procurement of goods / services by government agencies or BUMN. In fact, criminal sanctions are needed to be an effort to maintain compliance from government agencies or BUMN in implementing these regulations. Without criminal sanctions it will be difficult to obtain maximum application of the rules and compliance is also difficult to achieve.

Abstract

Prinsip Bank Syariah berlandaskan pada nilai-nilai keadilan, kemanfaatan, keseimbangan, dan keuniversalan sebagaimana disebutkan dalam Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah. Namun dalam pelaksanaannya terjadi tindak pidana yang dilakukan oleh pegawai bank seperti yang ditangani oleh Ditreskrimsus Polda Sumatera Barat. Selain menimbulkan kerugian bagi korban, juga dapat memberikan citra buruk terhadap Bank. Sehingga diperlukan adanya penyidikan dalam mengungkap kejahatan khusus yang hanya dapat dilakukan oleh pihak internal Bank.

Abstract

Pasal 81 Undang-undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak mengatur pemberian sanksi berupa denda terhadap pelaku tindak pidana kesusilaan dengan korban anak. Penelitian ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Penjatuhan Pidana Denda Terhadap Pelaku Tindak Pidana Kesusilaan Dengan Anak Sebagai Korban Di Pengadilan Negeri Lubuk Basung adalah dikumulasi dengan pidana penjara. Kisaran denda pada tahun 2020 adalah Rp 10.000.000,- sampai dengan Rp 25.000.000,- dikarenakan pelaku adalah anak sedangkan dengan pelaku orang dewasa dijatuhi denda Rp 100.000.000 subsider 2 bulan penjara. Pada tahun 2021 masih terdapat kisaran denda yang sama dengan tahun yang sebelumnya dikarenakan pelaku adalah anak. Jadi dalam hal ini pidana denda diancamkan, dan sering kali sebagai alternatif dengan pidana kurungan atau penjara. Efektifitas Penjatuhan Pidana Denda bagi Pelaku Tindak Pidana Kesusilaan Dengan Anak Sebagai Korban terhadap rasa keadilan bagi korban di Pengadilan Negeri Lubuk Basung berdasarkan jumlah maksimal pidana denda yang diatur dalam pasal 82 tersebut terbilang sangat besar namun dalam praktek dijatuhkan jauh dari jumlah maksimal. Denda diharapkan dapat diberikan bagi korban secara langsung namun dalam pengaturannya pidana denda yang di pungut oleh jaksa tidak berdampak apa-apa bagi korban anak karena pidana denda yang di jatuhkan kepada terpidana bukan diberikan kepada korban dan keluarga korban melainkan denda tersebut akan dipungut oleh jaksa dan diserahkan kepada negara, sehingga denda yang dipungut oleh jaksa tersebut menjadi penghasilan negara bukan pajak.
