Abstract

In addressing the issue of discrimination against albino individuals, a specific and comprehensive approach and strategy are needed to prioritize human rights protection principles such as equality, equity, mutual respect, and inclusivity among individuals. This approach is known as "anti-discrimination advocacy." This research aims to examine the legal status of vulnerable albino groups, the fulfillment of albino individuals' human rights, and to design anti-discrimination advocacy strategies as a means of protection for the vulnerable albino community. This research utilizes a qualitative approach, combining normative-empirical research methods and in-depth interviews. Sample selection is conducted through purposive sampling techniques. The research findings indicate that albino individuals have not been explicitly recognized in legislation. The fulfillment of the human rights of albino individuals, especially in terms of physical and sensory limitations related to the right to life, education, health, and employment, remains suboptimal. Therefore, government involvement is necessary to ensure human rights protection for albino individuals, including their recognition in specific legislation, particularly in Law of the Republic of Indonesia No. 8 of 2016 on Persons with Disabilities.

Abstract

There are still fights that continue to occur among students in groups that are free from the supervision of law enforcement, in this case the police. The police must be able to make preventive efforts so that brawls do not occur among students in groups in areas by monitoring areas prone to conflict, providing direction and assistance to schools, parents and the local community. By carrying out supervision and direction, it is believed that brawls among students can be limited. The problems in this research are, first, how is law enforcement by the Karawang Regency regional police against perpetrators of brawls between students linked to Regulation Number 2 of 2002 concerning the State Police of the Republic of Indonesia? , secondly, what factors hinder police law enforcement efforts against perpetrators of brawls between students in the Karawang Regency area? This research uses subjective exploration and in this research the author uses a standard juridical methodology with the main information used being selected information, namely information obtained from writing research, and supporting information in the form of books, papers, articles, legal guidelines, etc. The results of the research are law enforcement efforts against perpetrators of brawls/fights between students in the Karawang area, especially the resolution of brawls, assisted through reformatory and non-punitive efforts, corrective intervention efforts have been completed including schools and students related to the fights and the variables that influence them. Then there are 4 (four) inhibiting factors, namely, law enforcement itself, limited facilities or agencies, lack of active role in prevention efforts from the community and the culture of fighting which has become a habit among students.

Abstract

The reform resulted in changes to the 1945 Constitution, changing the Indonesian constitutional system, including dividing power horizontally functionally, namely the Executive, Legislative and Judiciary Institutions. All three have different powers according to their functions. This is to reinforce the system of checks and balances against the three institutions, but also not to interfere in the affairs of other institutions outside of their powers and functions. The removal of Judge Aswanto is one example of the Legislature's involvement in Judicial affairs, the article being that the removal of Judge Aswanto often annulled laws made by the legislature so that the removal was full of political interests. In this research, it examines and analyzes the dismissal of judges at the constitutional court by the People's Representative Council of the Republic of Indonesia in connection with Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the Constitutional Court with a normative juridical research type so that the approach taken is a statute approach, historical approach and conceptual approach. As for the author's view, the decision to remove judge Aswanto from the House of Representatives as a legislative institution shows that the judiciary has lost its value as an independent institution. That the independence of judges should start with transparent appointments and dismissals with due regard to judicial accountability. Furthermore, the judicial power or in this case as an institution of judicial power must be free from any political interests in carrying out its duties and return the concept to Law Number 7 of 2020.

Abstract

Penerapan asas dominus litis merupakan hal baru di Indonesia. Hal tersebut dikarenakan penarikan tuntutan oleh Jaksa Penuntut Umum tersebut tidak diatur dalam peraturan di Indonesia. Penelitian ini membahas mengenai dasar penarikan surat tuntutan oleh Jaksa Penuntut Umum dalam kasus tindak pidana kekerasan dalam rumah tangga yang dilakukan oleh Valencya dan penerapan asas dominus litis dalam penarikan surat tuntutan oleh Jaksa Penuntut Umum dalam kasus Tindak Pidana Kekerasan dalam Rumah Tangga yang dilakukan oleh Valencya. Penelitian ini menggunakan metode pendekatan yuridis normatif dan pendekatan kasus (case approach), spesifikasi penelitian preskriptif analisis. Sumber data yang digunakan data primer dan data sekunder, data yang terkumpul disajikan dengan uraian yang sistematis dengan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa peraturan perundangan di Indonesia mengenai penarikan surat tuntutan tidak diatur dalam peraturan perundang-undangan. Namun hal tersebut dapat dilakukan oleh Jaksa Agung selaku Penuntut Umum tertinggi yang mengendalikan perkara penuntutan di Indonesia. Jaksa Agung memiliki dasar hukum yaitu Pasal 35 huruf c Undang-Undang Nomor 11 Tahun 2021 Tentang Kejaksaan Republik Indonesia untuk menerapkan asas oportunitas dalam suatu perkara serta penerapan hukum progresif.

Abstract

Pelecehan seksual memang sudah dianggap sebagai sesuatu perbuatan yang tidak asing lagi terjadi dikalangan masyarakat, berbagai tindakan banyak yang terjadi dalam di Indonesia dalam hal pelecehan verbal maupun non verbal. Salah satu jenis pelecehan yang sudah dianggap biasa terjadi adalah pelecehan seksual non fisik yaitu tanpa sentuhan dengan perbuatan seksual dengan melihatkan keinginan seksual terhadap lawan jenis atau merendahkan harkat dan martabat seseorang berdasarkan seksualitas, banyak masyarakat menyepelehkan perbuatan kini dalam hal ini para pelaku dapat terjerat atau dimintai pertangung jawaban berdasarkan Undang – Undang Nomor 12 tahun 2022 Tentang Tindak Pidana Kekerasan Seksual (UU TPKS). Metode yang di gunakan dalam penelitian ini menggunakan yuridis normative dengan pendekatan konseptual dan perundang-undangan maupun pendekatan kasus. Dapat disimpulkan bahwa pembahasan ini tentang kasus pelecehan seksual non fisik di Indonesia memang masih menjadi problematika dilingkungan masyarakat akan tetapi dengan adanya undang – undang Nomor 12 tahun 2022 (UU TPKS) masyarakat dihimbau agar bisa melapor pihak penegak hukum jika mengalami kejadian tersebut serta adanya peraturan ini supaya para pelaku agar tau akan bagaimana konsekuensi atas perbuatanya.

Abstract

Abstract: Recently, criminalization has been rampant in Indonesia. One of the actions is counterfeiting money, namely counterfeiting, storing, circulating, importing, selling, spending and so on. The purpose of this research is to inform about criminal threats for perpetrators of money counterfeiting. The method used in this research uses normative juridical with a conceptual and statutory approach as well as a case approach. It can be concluded that this discussion addresses society's problem with counterfeit money. The existence of a policy in Article 36 paragraph 3 in conjunction with Article 26 paragraph 3 of the Law of the Republic of Indonesia Number 7 of 2011 concerning Currency provides more sanctions.

Abstract

Sahnya sebuah perkawinan adalah sesuatu hal yang sangat krusial yang berkaitan erat dengan akibat-akibat perkawinan. Suatu perkawinan dikatakan sah maka kedudukan hukum mengenai akibat perkawinan ini terutama mengenai keturunan (anak) dan harta akan menjadi tegas dan jelas. Harta yang diperoleh selama perkawinan berlangsung mempunyai hubungan hukum dengan kedua belah pihak yang telah melangsungkan perkawinan. Begitupun juga dengan keturunan yang lahir dalam ikatan sebuah perkawinan yang sah juga mempunyai hubungan hukum dengan orang tuanya.Kendatipun sudah diatur secara tegas dan jelas dinyatakan dalam Undang-undang Nomor 16 Tahun 2019 tentang Perkawinan, dalam Pasal 2 ayat (2) menyatakan bahwa tiap-tiap perkawinan dicatat menurut peraturan perundang-undangan yang berlaku. Namun dalam kenyataannya masih banyak perkawinan yang dilakukan hanya sesuai ketentuan ajaran agama masing-masing dan belum dicatat pada pegawai yang berwenang/belum memiliki bukti Akta nikah. Penyebabnya bermacam-macam seperti pernikahan poligami yang belum mendapat izin dari isteri pertama, perceraian yang dilakukan diluar pengadilan dan juga kurangnya kesadaran untuk mencatatkan perkawinan karena mereka beranggapan menikah yang penting sah menurut hukum agama dan tidak perlu dicatatkan.

Abstract

Nowadays, the intellectual property rights (IPR) have received great attention from countries related to the utilization of IPR that can be of high economic value. In the blueprint of the ASEAN Economic Community 2015 also contains that ASEAN wants to realize a single market with free traffic flow, among other things, to the field of Intellectual Property Rights (IPR). The problems in this research are firstly, how is the system of intellectual property rights (IPR) protection in the framework of trade liberalization in ASEAN Economic Community ?; and secondly, what are the implications of the application of the intellectual property rights system within the framework of ASEAN to the regulation of intellectual property rights (IPR) in Indonesia?. This research is a legal research that is juridical normative with legal history and legal comparison approaches, emphasizing on secondary data obtained from literature study and supported by primary data in the form of interviews obtained from field research. The specification of this research is descriptive analytical. The data collected were analyzed by qualitative juridical. The results of this study are; Firstly, the legal protection system of Intellectual Property Rights in ASEAN in the framework of trade liberalization through the ASEAN Economic Community 2015 is based on the ASEAN Intellectual Property Rights Action Plan 2011-2015/ASEAN IPR and ASEAN Charter. Furthermore, the two legal instruments are within the content of ASEAN Intellectual Property Rights Action Plan 2011-2015 and the Preamble of ASEAN Charter and Article 1 (points 5, 6 and 11). The ASEAN Charter contains the concept of Welfare State law in which the purpose of the provisions of such law shall be one of them in the framework of the interests of the welfare of ASEAN society as existing in the concept of the welfare state; and Secondly, in the framework of the realization of the ASEAN IPR Action Plan 2011-2015 in the ASEAN Economic Community, then Indonesia has adjusted by amending several regulations of legislation which are within the scope of intellectual property rights such as the Law no. 19 of 2002 with the Law no. 28 of 2014 on Copyright and the Law no. 15 of 2001 with Law no. 20 of 2016 on Trademarks and Geographical Indications to deal with the era of global trade.

Abstract

Elections are an arena for political contestation in the country. to determine the direction of policy that will be chosen by the leader resulting from the results of the election itself. So our involvement in elections is very necessary so that citizens have political rights, namely the right to vote. So we should have to vote in determining the future leader, because one vote of our choice means a lot for Indonesia in the next five years. Islam as a religion, has clearly provided guidelines for us in determining potential leaders in accordance with the Shari'a, as a real illustration of this is reflected in the behavior of the Prophet Muhammad Sallallahu 'Alahi Wassalam and his companions which until now has been applied and improvised by the leaders around the world. This research tries to analyze the concept of Imam Al-Mawardi's thinking in viewing and determining choices in the 2024 elections for leaders who are in accordance with Islamic guidance based on the criteria expressed by Imam Al-Mawardi. This research is qualitative research using a normative-empirical approach based on library research data (literature review). Based on existing analysis, it shows that the criteria possessed by candidates for head of state in the 2024 elections are clearly visible and are in accordance with the views expressed by Imam Al-Mawardi.

Abstract

This research aims to find out the law behind the use of the brand of bottled drinking water Aqua by the business owner of UD refill drinking water depot. Laras. This research was conducted in Cipar-Pari Timur Village, Sultan Daulat Subdistrict, Subulussalam City. The subjects in this study were refill water depot business owners and their workers. In accordance with the results of interviews with the object of research, it is known that the reason behind the use of the Aqua brand is the lack of knowledge of the owner of the refill drinking water depot on the existence of brand rights, besides that it is also because the owner of the refill drinking water depot does not provide gallons for refills at the drinking water depot so that people use the gallons they have before to fill in the refill drinking water depot. Distributors or Aqua bottled drinking water business owners are also more assertive in maintaining assets that are already owned, so that there are no events that can harm them.
