Abstract

Philosophically, the State as a forum for realizing national ideals requires a basis that can bring together the various characteristics of Indonesian society. Therefore, a Government of the Republic of Indonesia was formed which was able to protect the entire Indonesian nation and all of Indonesia's blood to prosper the people. The commitment of the Founding Fathers to the special and special rights of regional origin was proven by its inclusion in the Law. The 1945 Constitution of the Republic of Indonesia is hereinafter referred to as the 1945 Constitution. Research objectives: to analyze the importance of recognizing special and special regions within the Unitary State of the Republic of Indonesia based on the 1945 Constitution. Research Method: normative legal research type, data collection method in the form of secondary data with primary legal materials, in the form of statutory regulations and various proclamations. Meanwhile, secondary legal materials are in the form of literature that is relevant to the object under study. This research uses a statutory and historical approach. Qualitative descriptive data analysis method through data display, data reduction and drawing conclusions. The results of the research show: the importance of recognition of special and special regional government systems in Indonesia because recognition is a basic human need in an expanded spectrum, regions within the Unitary State of the Republic of Indonesia want to receive fair treatment from countries that are different from other regions due to historical background factors , culture and position.

Abstract

A franchise is an agreement regarding how to distribute products and services to customers. The party providing the license called the Franchisor, permits another party, called the Franchise, to run a product and service distribution business using the Franchisor's name in a certain area for a certain period of time. This business must be operated in accordance with the procedures and methods determined by the Franchisor. The Franchisor also provides support to the Franchisee, and in return, the Franchisee pays initial fees and royalties. In order to create a franchise business model that is in line with Islamic principles, it is necessary to apply the sharia value system as an ethical basis for business, aimed at preventing ethical violations in business (moral hazard). This research aims to examine the process of determining royalty fees for brand use within the framework of a franchise system, with a focus on the perspective explained in the DSN MUI Fatwa No:114/DSN-MUI/IX/2017. A review of the MUI's (Indonesian Ulema Council) fatwa and views on intellectual property rights and franchise practices shows the importance of complying with sharia principles in franchise agreements. These principles include clear profit calculations, profit sharing based on proportional ratios, and commitment to risks and losses. This case study focuses on the Kebab Goceng Franchise in Medan City, using a qualitative approach, including in-depth interviews and document analysis as data collection methods. The research results show that the Kebab Goceng franchise in Medan City has not implemented the DSN MUI Fatwa No: 114/DSN-MUI/IX/2017 in determining royalties. This determination is based on the criteria of fairness, mutual agreement and business sustainability. However, there are challenges regarding the interpretation and practical application of this fatwa.

Abstract

Penelitian ini mengkaji perlindungan hukum yang diberikan kepada penerima pinjaman online di Indonesia berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Bertujuan untuk menganalisis perlindungan hukum terhadap penerima pinjaman uang online terutama dalam mekanisme penagihan pinjaman ilegal yang tidak memiliki izin dari Otoritas Jasa Keuangan (OJK) dan menguji keabsahan perjanjian antara pemberi dan penerima pinjaman online berdasarkan Pasal 1320 dan Pasal 1338 KUH Perdata. Melalui pendekatan penelitian normatif dengan menggunakan bahan kepustakaan, dapat disimpulkan bahwa perlindungan konsumen dalam praktik pinjaman uang online harus memperhatikan prinsip-prinsip transparansi, perlakuan yang adil, keandalan, kerahasiaan data, dan penanganan pengaduan yang efisien. Selain itu, pentingnya menjaga kepastian hukum dan menghormati perjanjian yang telah dibuat, serta peran OJK dan aparatur penegak hukum dalam menindak pelaku usaha ilegal juga menjadi fokus dalam penelitian ini. Hasil penelitian ini diharapkan dapat memberikan kontribusi dalam menjaga hak dan kepentingan penerima pinjaman uang online serta mendorong pematuhan terhadap peraturan hukum yang berlaku.

Abstract

The aim of this research is to determine the modus operandi of criminal acts in the health sector (study of decision Number 90/Pid.Sus/2023/PN Mks) and the judge's legal considerations in handing down decision Number 90/Pid.Sus/2023/PN Mks. This research was conducted using a type of normative legal research with the approach method in this research being the statutory regulation approach. The conclusions of this research are: 1) The modus operandi carried out by the defendant who was a distributor of pharmaceutical preparations without a distribution permit in Decision Number 90/Pid.Sus/2023/PN Mks was by buying the drug from his friend secretly or secretly, then hiding it. the medicines are taken to their home first and the aim is to distribute them to consumers and make a profit from selling pharmaceutical preparations without a distribution permit. 2) The judge's consideration in imposing a criminal sentence on the perpetrator in Decision Number 90/Pid.Sus/2023/PN Mks is based on both juridical and non-juridical considerations. The judge's imposition of sanctions is based more on the facts of the trial and valid evidence and takes into account demands of the Public Prosecutor. The sentence imposed in the form of imprisonment for 1 (one) year and 10 (ten) months on the defendant is sufficient to have a deterrent effect on the perpetrator so that he does not repeat his actions again.

Abstract

This research uses normative research methods supported by empirical research. By examining the positive laws that apply in Indonesia and analyzing data obtained directly from the field or facts that occur in society. The aim is to find out how the legal regulations, the implementation of deletion and the factors that become obstacles/obstacles and solutions to the deletion of parties in Notarial deeds which are indicated as nominees occur in Indonesia. The research results show that legal regulations in Indonesia still do not have specific regulations regarding the removal of parties in Notarial Deeds who are indicated as nominees. However, in practice, deletions in a Notarial Deed can refer to Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notaries. Researchers hope that there will be special rules regarding the procedure for writing off a Notarial Deed, based on Court Decision regulations. So as not to create legal uncertainty in implementing law in Indonesia.

Abstract

A rental agreement is a mutual agreement that creates rights and responsibilities fot the parties involved in the agreement. Rental activities for apartment units in Batam City are often conducted verbally or through informal written agreement and ingnoring the inclusion of force majeure clauses so that there is no legal certainty for the parties. The research method used in this study is a combination of normative research and empirical research, which involves primary data through interviews and then correlating it with secondary data, such as statutory regulations and theories used in the study. The research findings indicate that there is Article 45 of Law Number 20 of 2011 which regulates the occupation of apartment units through written agreements made in the presence of authorizes officials and also Article 28 of the Government Regulation of the Republic of Indonesia Number 14 of 2016 concerning Imprementation of Housing and Settlement Areas addresses the inclusion of force majeure clauses. However, these provisions are often overlooked due to factors such as knowledge, age, social factors, and economic circumstances that influence people’s daily decision-making.

Abstract

The Indonesian government has promulgated Government Regulation Number 35 of 2023 concerning General Provisions for Regional Taxes and Regional Retributions (refers to PP General PDRD Provisions), which is the implementing provision of Law Number 1 of 2022 concerning Financial Relations Between the Central Government and Regional Governments (hereinafter called as the HKPD Law). This research raises two promblem statements, the determination of tax payable when the rights to land and/or buildings are transferred based on the PDRD General Provisions PP, and the notary's obligations regarding the confidential principle of office in the PDRD General Provisions PP. This research is normative legal research, with a statutory approach and a conceptual approach, where the data analysis is qualitative, carried out through legal science interpretation. The research results show that the determination of what is owed by BPHTB when the rights to land and/or buildings are transferred based on the PDRD General Provisions PP still raises legal concern, both at a theoretical and practical level. The notary's obligation to comply with the confidential principle of office in the PP does not have a basis because the HKPD Law does not regulate this obligation. Hence, this obligation can be overridden

Abstract

There are still many land disputes in Indonesia and the government is implementing a PTSL program to ensure legal certainty of land rights. It cannot be denied that negligence can occur when the government continues to issue land title certificates when the land is still in dispute, so the goal of legal certainty will not be achieved. This research raises two problem formulations, the principle of caution in issuing land rights certificates that are in dispute under the PTSL program, and the responsibility of BPN for issuing land right certificates that are in dispute. This research is normative research, with a statutory regulation approach, and used secondary data, namely primary legal materials in the form of statutory regulations, secondary legal materials are from books and journals, and tertiary legal materials is legal dictionaries. The research show that the application of the precautionary principle is realized by implementing administration based on information, complete documents and prepared with care and thoroughness. BPN is responsible for through land administration actions of issuing decisions to cancel legal products in accordance with PTUN decisions which have permanent legal force and can be subject to administrative sanctions and the imposition of compensation.

Abstract

Notary is a public official who has the authority to make authentic deeds and has other authorities as defined in this Law or based on other Laws. Notary is a position that has been regulated in the Legislation. However, there are times when a notary will end his term of office either by stopping at his own request and in the UUJN it is also stated that a notary who stops at his own request must report to the MPD and indicate who will be a substitute Notary for submitting the protocol. The method used in this thesis is an empirical research method. In this research, an understanding was obtained that if a notary stops at his own request, all protocols will be submitted to a replacement notary and appointed by the MPD. However, in the implementation that occurred in the cities of Padang and Padang Pariaman, the handover began with a Notary who stopped at his own request and was notified to the MPD that the MPD would process a letter from the Indonesian Ministry of Law and Human Rights. In its implementation, submission of notary protocols in the cities of Padang and Padang Pariaman did not go smoothly. Due to time delays in the process of issuing ministerial decrees, the handover of the notary protocol to a replacement notary is delayed and does not comply with the time period allowed according to UUJN. As long as there is no such decision, the notary cannot issue a copy of the deed for those who need it. However, in practice in the cities of Padang and Padang Pariaman these obstacles can be overcome by providing understanding to the parties or notaries who will retire.

Abstract

Restitution is compensation given to victims of criminal acts who have suffered both materially and physically, mentally or emotionally as a result of the perpetrator of the crime. The right to restitution is regulated in Government Regulation No. 3 of 2002. This right can be in the form of return of property, payment of compensation for loss or suffering, or reimbursement of costs for certain actions. Generally, the right to restitution is given to victims of serious crimes. However, not all victims receive this right fully, as happened in case No. 1712/PID.SUS/2021/PN.TNG, where the child victim was sexually assaulted, causing the victim to become pregnant and give birth to a child. This research was conducted using normative research methods with a statutory and case approach. This research data is of secondary type with primary and secondary legal materials which will be analyzed qualitatively. The research results show that the convicted person who is unable to fulfill the restitution demands will be subject to substitute imprisonment that does not exceed the threat of the main punishment and the state compensates a certain amount of restitution to victims of sexual violence according to the court's decision through the victim assistance fund.
