Abstract

Companies often terminate employment relationships with their employees because the company’s conditions are not good, employees have reached their retirement age, etc. After terminating an employment relationship, employers are required to pay severance pay to employees as regulated in the employment law. However, there are still many companies that do not pay the severance pay or even only pay half of the severance pay which should disappoint their employees. This research aims to find out what the regulations regarding the rights and obligations of the parties are based on labor law. This research uses a normative research method using a statutory and regulatory approach related to this research and a case apporach in the Pontianak District Court Decision Number 25/Pdt.Sus-PHI/2021/PN.Ptk. Based on the research that has been carried out, employers have violated Article 156 of Law Number 13 of 2003 concerning Employment and are required to pay the severance pay after terminating their employment. The conclusion of this writing is that it is hoped for the employees and employers will comply with the rights and obligations that have been agreed before starting the employment relationship, including the agreement on severance pay so that conflict cannot be occur and the welfare of the parties can be achieved.

Abstract

Modern human life is closelyarelated to legal acts, transactions and agreements. This article reviews the concept of agreementaaccordingy top Articlep 1313 rofpthep Civilp Code, emphasizing that the term "law of agreement" covers all forms of engagement. The definition of agreement, both in the context of customary and civil law, involves legal relationships between individuals or groups with a focus on property law. Along with the development of customary law in Indonesia, there was dualism in land law before Law Number 5 of 1960, which reflected the relationship between legal alliances and land. In the context of the Minangkabau Customary Law Community, the article examines their special position with customary rights as the highest land rights. The matrilineal kinship system in Minangkabau also displays the concept of inheritance which involves material and non-material elements.

Abstract

The background to this investigation is the rise in piracy and piracy of soccer streaming services, which are often exploited for individual and collective benefit. Such infringements result in significant losses for the copyright licensors of soccer streaming services. This type of research includes documents, books, legal research results, law journals, and library searches using the Internet. This type of research is qualitative research that uses a descriptive analytical format and a prescriptive legal approach. Specifically, legal research is analyzed based on legal norms and legal norms. In terms of Islamic criminal law, the criminal penalty for copyright infringement on a football streaming service is amputation if the stolen goods reach the Nishab. On the other hand, according to positive law, the penalty is a maximum of four years imprisonment and/or a fine of up to one billion rubles (one billion rupiah). Abstract

In light of the current global phenomenon, Indonesia is welcoming an increasing number of foreign cultures with ease. This can't be denied alongside the advancement of the inexorably fast globalization time and mechanical improvements that are progressively assisting people with having the option to acquire data rpidly and without any problem. Although it isnot against the law for foreign cultures to enter Indonesia, there are still a lot of Indonesians who are unable to distinguish between these cultures. This leang ds to a decline in nationalism values and a fear of a shift in national ideology, such as Pancasila, which is influencedby foreign cultures. has the potential to jeopardize the existence of the state and nation. The more youthful age is one of the variables that is enormously impacted by the section of this unfamiliar culture assuming it is inappropriate to answer and channel the approaching unfamiliar culture. There are currently a number of distinct generations of young people, beginning with generation X, also known as Millennials, and generation Z, each of which possesses its own set of characteristics. In this case there is a concern that there will be changes and shifts in culture and ideology with the influence of foreign culture and ideology entering Indonesia in the midst of the industrial revolution 4.0 which can threaten the sovereignty and existence of ideologies that are embedded in the Indonesian generation. This study uses qualitative research methods with the aim of seeing the character of each generation of the nation to be able to see and accept the impact of foreign cultural and ideological influences that enter Indonesia which will later have an impact on how to overcome and anticipate shifts in the nation's ideology, namely Pancasila from foreign cultural influences and external ideology that can threaten the sovereignty of Pancasila ideology.

Abstract

LPSK, sebagai lembaga yang berdiri berdasarkan Undang-Undang Nomor 13 Tahun 2006 yang diubah menjadi Undang-Undang Nomor 31 Tahun 2014 tentang Perlindungan Saksi dan Korban, memiliki tugas dan wewenang untuk memberikan perlindungan dan bantuan kepada saksi dan korban. Namun, kendala dan tantangan muncul terutama terkait dengan pemenuhan hak korban, seperti restitusi dan kompensasi. Penelitian ini bertujuan untuk menganalisis peran Lembaga Perlindungan Saksi dan Korban (LPSK) dalam melindungi saksi dan korban kekerasan seksual di Indonesia. Metode penelitian yang digunakan adalah analisis dokumen resmi, termasuk undang-undang, regulasi, laporan LPSK, dan kebijakan terkait lainnya. Hasil analisis tersebut memberikan pemahaman mendalam tentang kerangka kerja dan implementasi perlindungan saksi dan korban Dalam laporan tahunan LPSK, terlihat peningkatan jumlah korban kekerasan seksual yang mendapatkan restitusi. Meski demikian, evaluasi terhadap prosedur pengajuan restitusi perlu dilakukan agar lebih transparan dan cepat. Selain itu, LPSK perlu melakukan advokasi yang lebih efektif terhadap aparat penegak hukum untuk memastikan pemberian fasilitas restitusi sesuai dengan kebutuhan korban.

Abstract

This research aims to determine and analyze the validity of Decision Number: 27/KPTS/Cb29.5/2022 through Decision Number 80/G/2022/PTUN.MKS regarding the imposition of blacklist sanctions in the procurement of goods and services . This research uses normative legal research methods. The use of normative research methods in this research effort is based on the suitability of theory with the research methods required by the author. The results obtained are presented descriptively. The object of the dispute issued by LKPP is proven to contain a juridical defect in the substantive aspect, therefore, because the State Administrative Decree issued by a State Administrative Body or Official must not contain a juridical defect from the element of statutory regulations either from the sub-aspects of authority, formal procedural , or substantial, if it contains a juridical flaw in one aspect, then the State Administrative Decree must be declared null and void, so that there is sufficient legal grounds for the Panel of Judges to grant the Plaintiff's claim.

Abstract

This research delves into the dynamics of resolving land disputes over customary rights among indigenous communities in Fakfak Regency, West Papua Province. The study addresses the historical context of customary rights in Fakfak, examining the growth and development of land disputes within this framework. Theoretical exploration encompasses the principles and concepts of customary rights within indigenous societies, accompanied by an analysis of relevant legal foundations and regulations in Papua Barat. Employing a multidisciplinary approach, the research scrutinizes common causes of land disputes and evaluates the role of social and political conflicts in these disputes. The study investigates various dispute resolution methods, assessing their advantages and shortcomings. Special attention is given to the active participation of indigenous communities in the resolution process, exploring factors influencing their involvement. Cultural and social dynamics affecting land dispute resolution are analyzed, identifying challenges and external factors complicating the process. The research concludes with recommendations for improvement, offering insights into effective dispute resolution strategies. Case studies from Fakfak Regency provide concrete examples, contributing to a comprehensive understanding of the subject. The findings have implications for policies and practices related to customary land dispute resolution.

Abstract

With current technological developments, various new innovations have emerged in various aspects in various parts of the world. Then the aspect that is most affected by changes in the current technological era is the agreement or contract. Where changes to the agreement or contract lie in the medium where conventional contracts innovate into electronic contracts. Electronic contracts are often used in electronic transactions because they are more efficient. Positive law regarding electronic contracts is regulated in Civil Law and Law Number 19 of 2016 Amendments to Law Number 11 of 2008 concerning Information and Electronics. These two regulations explain the legal requirements for implementing a contract and the validity of a contract. The legal requirements for a contract are explained in Article 1320 of the Civil Code, namely that there is an agreement from both parties, the agreement must discuss a certain matter, the parties must have the skills to make an agreement, the agreement must have a valid reason, and the agreement must discuss a matter. certain. If the agreement meets these four conditions then the agreement is considered valid. Then, referring to Article 5 and Article 6 of the Electronic Information and Transactions Law, an electronic contract is declared valid if the electronic information in it can be guaranteed and its existence can be proven. The differences in the legal requirements for the two are not too different, only the electronic media is the difference. However, in its implementation, the Electronic Information and Transactions Law needs to strictly regulate the validity of electronic contracts.

Abstract

Legislation in Indonesia is coercive and all-embracing. The tax sector is no exception. Both individuals and corporate entities have an obligation to pay taxes. As a taxpayer, it cannot be denied that there are opportunities to commit tax crimes. This article aims to analyze tax evasion as a means of tax crimes committed by company directors when viewed from the business judgment rule doctrine. This research uses normative juridical legal research by collecting secondary data. The results of this research show that directors can be held personally responsible if they are proven to have committed tax evasion on behalf of the company and cannot be protected by the business judgment rule doctrine.

Abstract

In international business transactions carried out by Indonesian business actors, both on an UMKM and large scale, with foreign business actors, there are those who do not make anchor agreements regarding the sales and purchases they make, and only use purchase orders and the sender's email as their sales and purchase agreements. However, when a dispute arises and is tried in an Indonesian court regarding a purchase order, this has different meanings and interpretations by legal and economic experts, so a uniform interpretation of purchase orders is needed that has legal certainty. In this regard, there is legal certainty regarding the purchase order, namely the Supreme Court jurisprudence No.1506 K/Pdt/2022. This jurisprudence can be used by parties in protecting international sales and purchases that are tried in Indonesian courts.
