Abstract

Civil servant candidates (CPNS) recruitment is an important series of activities in order to have a Civil Servant with integrity, professionalism, neutral, free from political intervention, free from corrupt, collusion and nepotism (KKN) practices, and is able to provide public services to the community as well as to be a role model to promote national unity based on Pancasila and the 1945 Constitution of the Republic of Indonesia. Therefore, in the selection process the organizers need to carefully prepare everything to minimize the possible legal polemic. Issue related to threshold policies that suddenly change was fully discussed in the last civil servant enrollment test (CPNS) 2018. That change cannot be separated from the discussion of legal aspects when there are some CPNS participants who feel disadvantaged. Basically policy is made to be in line laws and regulations, thus Ministry for the Empowerment of The State Apparaturs Regulation (Permenpan) 37/2018 and Permenpan 61/2018, policies should provide a sense of justice, legal certainty and usefulness.

Abstract

Zakat is an important part of a wealth distribution system given by God in a fair and detailed manner for the benefit of humanity. Islamic principles of fiscal policy aim at developing a society based on the balanced wealth distribution by placing material and spiritual values at the same level, equally. One of the goals of zakat expenditure in Islamic fiscal policy is to provide for the needy and poor people in addition to paying the zakat collectors.

Abstract

BNI Syariah is one of Indonesia's national sharia banks. In its operations, BNI Syariah implements several contracts, namely the Mudharabah Contract, the Wadiah Contract, and the Ijarah Contract. This study is focused on the discussion of the Ijarah Contract by taking BNI Syariah Branch Palu, Central Sulawesi as the research object. Islamic banking has good prospects. This is supported by two factors, they are the population which is predominantly Muslim and the strong support of the Government. But at the same time, there are number of challenges faced by this type of banking. The aspects of funding and the quality of Human Resources (HR) are two elements that are often referred to the serious problems faced by Islamic banking, especially when compared to conventional banking. Another factor is that Islamic banking has not had a clear business model scheme yet. Moreover, Islamic banking products are still not fully understood by a larger public. In other words, citizens who truly understand the principles and products of Islamic banking are still very limited. In relation to the operations of the BNI Syariah Bank Branch Palu, there are two segments that are practiced in the bank intermediation. Those two segments are the consumptive segment and the productive segment. Both of these segments face the same problem in their implementation, it is socialization. This study found that there was a correlation between the lack of socialization and the low interest of the people in Palu regarding the Ijarah product. In other words, lack of socialization has caused BNI Syariah Branch Palu products to be widely unknown to the public.

Abstract

The implementation of a syndicated contract between Islamic financial institutions and conventional financial institutions according to National Sharia Council – Indonesian Ulama Council (DSN-MUI) is permitted under one condition that the documents are arranged in such a way in order to avoid administrative mixture between the halal and the ribawi. Using a separated account for the two parties; make one document for Islamic financial institution and so does for conventional financial institutions, separately. In contrast to syndication by fellow Islamic financial institutions where the accounts of contract documents and other documents can be arranged in one document.

Abstract

The formation of laws and regulations, must determine the rules for the formation of invitation regulations or statutory regulations (gesetzgebungslehre), which are approved by the juridists. Every legal product must have a legal juridical basis (juridische gelding). This juridical basis is very important in making special laws and regulations. In addition, the relevant Regional Regulation will also provide legal umbrella / legal certainty for stakeholders (executive, legislative, vertical institutions, community, and other parties) who are involved directly or indirectly in the involvement. In order to provide protection to the people in the regions from natural disasters, non-natural disasters and social disasters.

Abstract

Summons in the civil procedural law is to submit to the parties formally and properly related to the case in court, in the delivery procedure of a summons once the parties are not found, then the village head or Lurah is given the mandate to deliver it to the litigant. The results of research conducted on the village in Palu do not even have a procedure for accepting and submitting willingly, it is caused by the ignorance of the village regarding the obligation to submit summons, besides the village feels has no interest in the bailiff’s primary task. Analysis of village’s legal responsibility in the summoning function can be categorized as collective responsibility on the subject side, whereas from the other side, object side, it is a type of absolute accountability.

Abstract

This research is motivated by the existence of Islamic microfinance institutions in Palu City. In general, Islamic microfinance institutions named Islamic Cooperatives or Finance House (BMT) has enormous potential to empower community economy, particularly from the lower middle class. Since this institution is not only to raise funds, it also can channel it to meet people’s needs especially institutions’ member as well as for the communities’ in general. As time goes by, there is only one unit out of several units of Islamic Cooperatives or BMT in Palu that is still actively carrying out its operational activities, while the rest are already inactive. Therefore, this study tries to raise the issue of how the problems faced by Islamic microfinance institutions (Kopsyah BMT) in the city of Palu.

Abstract

Since the 1970s, studies of the Islamic economy have developed rapidly. Various topics around Islamic economics are discussed, ranging from Islamic economic philosophy, Islamic economic system, Islamic criticism of conventional economics, Islamic economic history and thought, to the Islamic financial system. There are several factors that encourage the development of Islamic economic scholarship, some of them are: personal motivation to promote Islamic economics, sponsorship from academic and non-academic institutions as well as organizations, Muslim societies, Muslim student associations, and also the dedication of publishers. As time goes by, Islamic economics bears many figures with various Islamic economic schools. According to the writer's findings there are at least five schools of contemporary Islamic economic thought, they are (1) Baqir al-Sadr, (2) Mainstream, (3) Alternatives, (4) Hamfara, and (5) Murabitun.
