Abstract

Perlindungan konsumen di masa pandemik covid -19 merupakan hal yang perlu di perhatikan, terutama mengenai refund tiket pesawat di Masa Pandemik covid -19 ini sebagaimana dengan adanya kebijakan baru yang dikeluarkan oleh pemerintah mengenai larangan mudik Idul Fitri Tahun 2020, dampak dari larangan tersebut yaitu gagalnya keberangkatan calon penumpang sebagai pihak konsumen, dampak dari hal ini maka sebagai pelaku usaha wajib melakukan upaya ganti rugi yang biasa disebut dengan refund tiket, di dalam Peraturan Menteri Perhubungan Nomor 25 Tahun 2020 dijelaskan mengenai pengembalian tiket berbentuk voucher dan tidak menggunakan uang tunai, dengan adanya sistem baru mengenai pengembalian tiket pesawat tersebut hak-hak konsumen harus diteliti sesuai dengan Undang-Undang Perlindungan Konsumen yaitu Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, sebagaimana dengan tujuan penulis yaitu untuk mengetahui bagaimana hak-hak konsumen pada masa pandemik covid -19 ini mengenai refund tiket pesawat serta perlindungan konsumen berdasarkan Undang-Undang Perlindungan Konsumen sebagaimana agar mengetahui jawaban tersebut penulis menggunakan metode penulisan yuridis normatif dengan data sekunder. Hasil dari penelitian, bahwa hak-hak konsumen di Indonesia pada masa pandemik covid -19 ini memang mendapatkan refund tiket pesawat namun berbentuk voucher dan memiliki jangka waktu pemakaian dalam hal ini maka hak-hak konsumen sangat dibatasi dengan adanya waktu berlaku voucher, dengan adanya surat rekomendasi yang dikeluarkan Badan Perlindungan Konsumen Nasional tersebut maka terbukti masih adanya keresahan di pihak konsumen mengenai hak-haknya terhadap refund tiket pesawat, terutama hak kenyamanan dan hak untuk di dengarkan pendapatnya yang tentunya sudah diatur di dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.

Abstract

From the Welfare State perspective, the state is also referred to as a social services state or an agency of services. The form of social services from the state in the context of realizing general welfare is that the government in building international cooperation must always consider national interests through community participation. This study aims to evaluate the practice of forming international agreements concerning people's participation, and analyzing how the RIA method can increase people's involvement in the formation of international agreements. Writing this article applies normative legal research methods, with statutory, conceptual, and comparative approaches. The research results show that the involvement of the House of Representatives as a form of people's participation in the formation of international agreements can be said to be quite minimal. In contrast to some countries such as Germany, the House of Representatives or parliament must be provided with information regarding the negotiation process that is being carried out by the Government. Likewise in the United States, Parliament can participate in the negotiation process on international agreements for certain fields. Even though Article 2 of the Law on International Agreements mentions a mechanism for consultation by the government regarding international agreements that concern the public interest. However, there is no further explanation of whether the Consultation mechanism is voluntary or an obligation for the executive. Therefore, one of the methods that can be applied to increase public participation, especially through the involvement of the House of Representatives is to apply the RIA method.

Abstract

This study analyzes the duality of the provisions for imposing administrative sanctions or criminal sanctions for taxpayers who do not register themselves to be given an Taxpayer Identification Numbers or do not report their business to be confirmed as Taxable Persons for VAT Purposes, causing state losses because it can lead to legal uncertainty and injustice. This paper is a doctrinal research that analyzes primary and secondary sources of law with statutory, conceptual, and analytical approaches. The results of the research show that the Law on General Provisions and Procedures for Taxation already regulates administrative sanctions for taxpayers who do not register themselves to be given a Taxpayer Identification Number or do not report their business to be confirmed as a Taxable Persons for VAT Purposes, causing state losses, namely by granting a Taxpayer Identification Number and inauguration of a Taxable Persons for VAT Purposes as a position and issuing Notice of Tax Underpayment Assessment along with administrative sanctions. Based on the principles of establishing laws and regulations and the legal principles of hulprecht, una via, ultimum remedium, and nullum delictum, nulla poena, sine praevia lege poenali, because there are provisions for the imposition of administrative sanctions, for legal certainty and justice the provisions of Article 39 paragraph (1) letter a of the General Provisions and Tax Procedures Act should be abolished so that there is no duality in the imposition of sanctions for the same violation.

Abstract

The President has taken a policy to dissolve state institutions, most recently through Presidential Regulation Number 112 of 2020, which dissolved 10 non-structural state institutions. This is suspected as a decisive step to create effectiveness in the legal system within the state institutions. Factually, there are currently too many regulations being created by state institutions, causing an overlap of duties and authorities, and inefficiency due to self-entanglement, making each state institution difficult to operate. Therefore, there is a need for a reduction in state institutions to achieve regulatory reform that is results-oriented, not just procedural. This is based on the goal of legal development, which is not only inherent in substance but also in legal structure and culture. The purpose of this research is to understand, examine, and analyze the President's considerations for the dissolution of non-structural state institutions and to analyze the implications of the dissolution of non-structural state institutions on the formation of regulations and legal order in Indonesia. This research method uses normative legal research with a legislative approach and a conceptual approach referring to literature studies. The conclusion of dissolving non-structural state institutions is aimed at improving bureaucratic performance by minimizing overlapping duties and functions that result in the waste of authority and budget inefficiency. Additionally, there is a need for further regulation at the legislative level regarding non-structural institutions to establish fixed procedures from formation to dissolution, similar to the concept of regulating state ministries in Law No. 39 of 2008 concerning State Ministries.
