ABSTRACT Legal aid institutions or aid advocates as the legal defenses in legal aid programs for the underprivileged were always expected to defend the legal interests of the underprivileged, eventhough the Supreme Court of the Republic of Indonesia through the Directorate General for the General Courts only provide limited funding. The research method was qualitative using the obtained data directly from the sample and the population through in depth interviews. The data analysis technique was descriptive which is intended to obtain clear and good overview, and able to provide detailed data as possible related to the research object. Result of the study shows that judicially formal, legal aid activities in the general sense means that the activities of legal services to every person who lodged the case is included as a part of the positive law in Indonesia. It can be seen in Act No. 14 of 1970 about the Supreme Court and Article 254 HIR that is set on the right to obtain legal services for every person who lodged the case whether he/she is rich or poor

ABSTRACTPrevention of crime through the criminal law, an activity that preceded the determination of criminal acts and determination of the sanctions that can be imposed on the perpetrators of the crime or offense. Sanctions in criminal law is suffering as a reward of his actions that have hurt other people or society. Correctional as a coaching system that is essentially an activity that is multi dimensial, this is due to the recovery efforts unitary relationship of life, life and livelihood is a very complex issue. For it is necessary guidance to prisoners and correctional clients within a framework.However, in reality the convict after finished serving a prison sentence instead of a deterrent but instead repeat criminal offenses (recidivism). So in this case unquestionable effectiveness of coaching inmates in prisons class II B Merauke.This study juridical sociological. This research was conducted in the Penitentiary Class II B Merauke, namely data sources of primary data through observation and interviews and secondary data, legislation, books related to the research.Development patterns prisoners committed at the Correctional Institution Class IIB Merauke, divided into two (2) areas of the coaching personalities include: development of religious awareness, fostering awareness of state and nation, fostering intellectual abilities (intelligence), development of legal awareness, coaching integrate themselves with the community. Fostering Independence which include: skills to support the efforts of independent, skills to support the efforts of small industries, the skills developed in accordance with the talent of each, skills to support the efforts of industrial or agricultural activities (plantations) using technology associate.

So important is the problem of children so that all nations across the world, has a great attention to the child. The issue of child protection criminal is very important because after the child offender is the next generation and the future of a nation.with the criminal justice system, Indonesia has had its own laws, namely Law No. 11 Year 2012 on Child Justice , Where this law has been designed as a means of dealing with cases of children in court. That is inevitably a central point of children who commit criminal acts lies in judge reseach aims to determine.Implementation of State Merauke court criminal sanctions against children as a criminal and what factors were taken into consideration in imposing sanctions judge with criminal using empirical juridical , Which is expected to address issues. In implementation factors that are considered by the judge in order for sanctions that include the factor of juridical and non-juridical factors. While the juridical and practical probleme relating to the application of sanctions pertaining to juvenile criminal procedural law and procedural law in general. While the actions of judges in the future have the same goal in realizing the objective of sentencing with the perspective of child protection and child welfare.

Development policy for the currentis put emphasis on the concrete efforts so as to motivate the public to actively participate in the implementation of development towards independence of the civil society. This research have a purpose to know a strategic approach to participatory rural appraisal (PRA) to realize the independence of the transmigration community in Marga Mulia Village.This research was held in the Marga Mulia Village, Semangga District. The researh used a qualitative method. Data collection techniques consists of literature review and field studies through a process of observation, interviews and documentation. Data analysis included data reductation, data presentation and conclussion.The results showed that the participatory rural appraisal (PRA) approach in Marga Mulia Village, Semangga District don’t yet optimal. The people is not yet fully involved in the development process of the village.The emphasis on participatory rural appraisal (PRA) approach requires active community involvement in the development stages of planning, implementatages of planning, implementation, monotoring and evaluation. The involvement of the society wasion, monotoring and evaluation. Legal actions by governments can be either setting or set, which is a legal act of the government public-sided or unilateral (eenzijdige publiekrechtelijke handeling) binding or generally applicable in accordance with the legislation that became the basic settings. Governmental authority in the land sector may be delegated by the government to local government. Status of the Local Government act as enforcers state that is not genuine because it was given (outsourced) authority to it by the Central Government. Local authorities in the land sector stipulated in Government Regulation No. 38 of 2007 on government affairs division between the Government, Provincial Government and Local Government / town. In the government regulation authority given to the government of the provincial and district / city in terms of communal land is the establishment of communal land, this is done through the establishment of local regulations. The purpose of this study is to know about the implementation of regional autonomy and ap customary land release in Merauke.This research is a normative law. This study uses several approaches to obtain information on the issues raised, among others, the approach of the law (statute approach), approach the concept (conceptual approach), the historical approach (hisrorical approach) and the philosophical approach (philosophy approach). This type of research is qualitative research using this type. Data analysis techniques used in legal research is the analysis of qualitative data, which is a procedure for research that produces descriptive data analysis.The study concluded local government authority is the formal power that comes from the law, but local governments do not have full power to the release of customary land but customary law which have full power to the release of customary land.

The present research was aimed to identify how controlling function was implemented in the APBD (Local Budget) and their obstacles encountered and efforts to perform in solving problems of good governance realization.        Method used was gualitative-descriptive method by analyzing and interpreting primary and secondary results of interviews and observation obtained in the research.Based on results and analyses, it was found that controlling function that the DPRD (Local Legislative Assembly) on the APBD in Merauke districk regency had not been optimally performed yet. This was true in planning/arrangement stages of the APBD ( Local Budged Draft ), the mechanism that the executives adopted had not fully accommodated public aspirations to be stated by the DPRD as the general policies and directions (AKU) of the APBD. In the APBD discussion, available budgeting posts, in fact, had not considered priority scale of public needs as resulted from discussed mechanism referring of the previous-year APBD and they tended to be based on agreements between the executives and legislative and less fulfilled the performance-based budgeting principles. In the realization stage of APBD, controlling performed through field monitoring activities and work-metting (evaluation) actually had encountered technical and juridical obstacles. Meanwhile, controlling the Responsibility Report (LPJ) of regent as evaluation measure faced political aspects differences in maintaining the credibility of authority for the sake leadership existence. Also, it neglected technical aspects that should be directed to the APBD management ang exploitation to measure performance results of apparatus (executives) in order to realize good governance.The research recommends that to optimize controlling function of the DPRD in the APBD realization, warking standard on prioritized development to identify its synchronization with implemented budgeting posts on the APBD and monthly regular monitoring toward government pervormance to early detect available deviation are required.The empowerment of the DPRD members is performed through understanding better budgating posts in development sectors and routine budged that the executive propose. Improved controlling function of the DPRD (Local Legislative Assembly) on the Responsibility Report (LPJ) of Regent should be performent through governments pervormence assessment that ultimately leads to good governance indicated from minimum deviation of realized APBD in Merauke districk.

Communication ethics based on high emotional intelligence can encourage the achievement of quality academic atmosphere. This aim of the research was to find out the relationship between students’ emotional intelligence with communication ethics in creating academic atmosphere.This research was a correlational descriptive study conducted in Musamus University of Merauke. The samples consisted of 67 students, lectures, and head of university. The research used mixed methods. The result of the research indicate that there is significant relationship between students’ emotional intelligence and their communication ethich in creating academic atmosphere (P-values = 0.000).Emotional intelligence dimension which give the most significant influence is social skill or to make relationship with other people, i.e 74.9%, and the least significant influences is managing emotion dimension or to manage emotion, i.e 20.9%. simultaneously, the influence of emotional intelligence on communication ethics is 69.1% and the remaining 30.9% is influenced by other factors.In creating an academic atmosphere the role of university is not only to improve students IQ (intelligence quotient), but also to improve the EQ (emotional quotien).

Manajemen strategi tidak hanya diterapkan pada sektor swasta namun juga telah diterapkan pada sektor publik. Penerapan manajemen strategi pada ke dua sektor tersebut sebenarnya tidaklah terlampau jauh berbeda, hanya saja pada institusi sektor publik tidak menekankan pada tujuan organisasi untuk mencari laba namun lebih kepada pelayanan untuk masyarakat. Tahapan manajemen strategi diawali dari perumusan strategi, implementasi strategi dan evaluasi strategi. Penerapan manajemen strategi sektor  publik merupakan salah satu jalan yang terbaik untuk mencapai good governance. Dalam upaya mewujudkan kinerja organisasi pemerintah yang lebih baik dalam memberikan pelayanan kepada masyarakat penerapan manajemen strategi bagi organisasi sektor publik menjadi hal yang sangat penting untuk meningkatkan efektivitas kinerja organisasi sektor publik.Hal tersebut menuntut organisasi sektor publik untuk berpikir strategis, mampu menerjemahkan inputnya menjadi strategi yang  efektif,  serta  mengembangkan alasan  yang diperlukan untuk meletakkan landasan pelaksanaan strateginya. Pegimplementasian manajemen strategi dalam organisasi sektor publik diharapkan dapat membantu organisasi tersebut dalam mewujudkan visi dan misinya. Meskipun orientasi hasil yang ingin dicapai dengan adanya penerapan manajemen strategi antara sektor privat dan sektor publik agak sedikit berbeda, namun ke dua sektor tersebut tentu menghadapi kondisi lingkungan yang berbeda yang menjadi hambatan tersendiri dalam proses penerapan manajemen strategi. Untuk mengatasi hambatan yang terjadi salah satunya dengan menggunakan pendekatan analisis SWOT (strength, weakness, opportunity, and threats).. Dalam tulisan ini akan membahas secara konseptual dari aspek teoritis tentang penerapan manajemen strategi dalam pengukuran kinerja organisasi sektor publik, dan juga akan membahas kendala-kendala yang terjadi dalam pengukuran kinerja organisasi sektor publik.

Penyerapan anggaran belanja pemerintah memiliki peranan penting dalam percepatan pertumbuhan ekonomi dan pembangunan pemerintah. Ada beberapa faktor yang menjadi penghambat penyerapan anggaran, seperti: lemahnya perencanaan anggaran atau daya serap rendah yang mencerminkan perencanaan program yang tidak matang, sehingga sering dilakukan revisiyang dapat memperlambat pelaksanaan anggaran karena dianggap tidak valid dan akuntabel. Faktor penghambat lain yaitu proses pembahasan anggaran yang terlalu lama sehingga memperlambat proses eksekusi dilapangan. Lambatnya proses tender juga harus diperbaiki dan disosialisasikan lebih luas agar pejabat pembuat komitmen dan kuasa pengguna anggaran lebih memahami ketentuan pengadaan barang dan jasa serta pelaksanaan anggaran.Untuk mengurangi tingkat keterlambatan penyerapan anggaran, diperlukan beberapa strategi baik dari pihak satuan kerja terkait maupun Bendahara Umum Negara (KPPN), seperti : perencanaan anggaran yang baik, pelaksanaan anggaran yang efektif dan efisien, pencapaian kinerja yang optimal, monitoring dan evaluasi, penerapan SOP yang baru, peningkatan kualitas SDM dan sarana prasarana, dan sosialiasi serta bimbingan teknis terkait anggaran kepada satuan kerja. Strategi ini dilakukan guna pembangunan pemerintah yang optimal, efisien dan efektif.

Manajemen komplain penting bagi rumah sakit karena melalui komplain pasien dapat dijadikan sebagai informasi untuk memperbaiki kualitas pelayanan kesehatan yang diberikan. Penelitian ini bertujuan untuk mengetahui dan menganalisa manajemen komplain dalam pelayanan kesehatan serta mengidentifikasi faktor-faktor yang mendukung dan menghambat di Rumah Sakit Umum Daerah Merauke. Metode penelitian yang digunakan adalah metode kualitatif. Pengumpulan data ditempuh melalui pengamatan, wawancara dan dokumentasi terhadap informan yang terlibat langsung dalam pelaksanaan kegiatan tersebut. Proses analisis data meliputi reduksi data, penyajian data, dan penarikan kesimpulan.Hasil penelitian menunjukan bahwa manajemen komplain di Rumah Sakit Umum Daerah Merauke belum menunjukan hasil yang baik. Hanya ada kotak saran sebagai alternativ menerima keluhan yang masuk secara tidak langsung, dan dalam penanganannya belum maksimal. Hal ini terbukti dari masih lambatnya pengelolaan serta tidak adanya penyampaian informasi dari rumah sakit kepada pasien bahwa keluhan yang masuk sudah ditangani.Yang menjadi faktor pendukung dalam manajemen komplain di RSUD Merauke adalah adanya SOP dan fasilitas komplain. Sedangkan yang menjadi faktor penghambat adalah sumber daya manusia yang masih lemah dan sosialisasi tentang komplain yang belum berjalan.
