Abstract

Mixed marriages in Indonesia often causeproblems. One of them is regarding the mixingof assets which causes the degradation of therights of Indonesian Citizens (WNI) in terms ofland ownership. This is because before theissuance of the Constitutional Court DecisionNo. 69/PUU-XIII/2015, the applicableregulations did not provide an opportunity forIndonesian citizens to make a separation ofassets agreement after a mixed marriage tookplace. In fact, not everyone understands thelegal consequences of mixed marriages so theydo not make a marriage agreement before themarriage takes place. With the issuance of theConstitutional Court Decision No. 69/PUUXIII/2015, it is now possible to make a marriageagreement after the marriage takes place(Postnuptial Agreement).The purpose of thisstudy is to analyze the problems of landownership rights that arise in mixed marriagesin Indonesia and the solutions created in orderto realize justice for all Indonesian citizenswithout exception. The research method uses anormative or doctrinal legal approach that usessecondary data or literature. The results of thestudy show that the provisions regarding landownership for Indonesian citizens with mixedmarriages before the Constitutional CourtDecision No. 69/PUU-XIII/2015 has caused alot of polemics because it is considered to becontrary to the values of justice for Indonesiancitizens, especially those who enter into mixedmarriages without making a marriageagreement before the marriage takes place.Based on the Constitutional Court's decision,there has been a change in the provisionsregarding marriage agreements in mixedmarriages that allow for a marriage agreementto be made after the marriage takes place(Postnuptial Agreement). This is one solutionto the problem of joint property in mixedmarriages for those who have not made amarriage agreement before the marriage takesplace. So that justice can be realized for allIndonesian citizens

Abstract

The marriage process for TNI soldiers is not as simple as for civilians in general. As a TNI soldier who will get married, they need permission from their superiors first, in accordance with the mandate of Article 63 of Law Number 34 of 2004 concerning the Indonesian National Army which is further regulated in the Regulation of the Commander of the Indonesian National Army Number Perpang / 50 / XII / 2014 concerning Procedures for Marriage, Divorce and Reconciliation for Soldiers, but in practice there are still discrepancies in the implementation of the marriage procedures for TNI soldiers. One of the cases that occurred was in case number 22 / Pdt.G / 2022 / PN Sbg where the Panel of Judges declared the validity of the marriage of a TNI soldier named Alm. FH with MS who married without following the procedures as stipulated in the TNI internal regulations. The next problem in the case of marriage without following the procedure is regarding inheritance law, which is to determine the heirs or the party most entitled to receive inheritance from the property of a deceased person. This study examines the marriage procedures for TNI Soldiers and the inheritance rights of children from the marriage of TNI Soldiers as per the Sibolga District Court Decision Number 22/Pdt.G/2022/PN Sbg. This study uses a doctrinal research method through legislation and books and journals to obtain clear data using a legislative approach and a case approach. The results of the study indicate that the marriage procedures for TNI Soldiers are still based on Law Number 1 of 1974 concerning Marriage and Government Regulation Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 concerning Marriage. In decision number 22/Pdt.G/2022/PN Sbg, there was an error in determining the inheritance where the Panel of Judges stated that the land on Jalan S/Jalan T, as the inheritance of the parents of Plaintiff I, Plaintiff II, Plaintiff III Counterclaim/Defendant I, Defendant II, Defendant III etc., and the late. FH namely Alm. CH and Almh. IS. whereas if there are heirs of class I, then heirs of class II, III, and IV will be closed so that they do not get a share. Therefore, in this study, it is expected that the Judge who functions to decide cases in Court can provide a fair and balanced decision to the parties and heirs by applying the principle of justice

Abstract

Interfaith marriage has become a topic ofinterest in social and cultural studies, especiallyin countries with significant religious diversity.This article aims to investigate the dynamics ofinterfaith marriage law in Indonesia, includingthe challenges faced and future prospects. Inaddition, this article will also compare thepractice of interfaith marriage law in Indonesiawith the legal practice in Turkey, as a countrywith a similar background in the context of amulticultural society and a majority Muslimpopulation. This study uses a doctrinalresearch method with a comparative approach.The researcher also uses document studies orlibrary materials such as legal journals, books,and Legislation, namely Law Number 1 of 1974concerning Marriage, Constitutional CourtDecision Number 24/PUU-XX/2022 andSupreme Court Circular Letter No. 2 of 2023concerning Guidelines for Judges inAdjudicating Cases of Applications forRegistration of Marriages Between People ofDifferent Religions and Beliefs, The TurkishFamily Law of Cyprus of 1951 and TurkishCivil Code No. 4721. This study shows that theDecision of the Constitutional Court Number24/PUU-XX/2022 and the Circular of theSupreme Court No. 2 of 2023 concerningGuidelines for Judges in Adjudicating Cases ofApplications for Registration of MarriagesBetween People of Different Religions andBeliefs prohibit the implementation ofinterfaith marriages absolutely and ignorereligious interpretations that allow interfaithmarriages and only refer to the majorityreligious interpretation. Indonesia and Turkey present interesting legal arrangements andhave significant differences in the context ofmarriage and interfaith marriages. Accordingto Turkish Marriage Law, religion and beliefare not obstacles to the implementation of amarriage. With a deeper understanding of thecomparison between Indonesia and Turkey, itis hoped that it can provide new insightsregarding more inclusive and comprehensivepolicies regarding interfaith marriages inIndonesia

Abstract

This research aims For analyze impact communication empathetic to rehabilitation inhabitant foster care in correctional institutions Class II-A Binjai . This study uses method qualitative descriptive , with informants consisting of from three category main : citizen foster , officer institution correctional , and head institution correctional . Informant chosen using purposive sampling to get view deep related to the coaching process . Data is analyzed use analysis thematic with NVivo software assistance , which focuses on patterns communication and its impact to discipline . The theory used is the FIRO (Fundamental Interpersonal Relations Orientation) Theory, which highlights importance inclusion , control , and affection in interpersonal relationships . Research results show that communication empathetic increase involvement inhabitant foster in the rehabilitation program , reducing conflict , and strengthen interpersonal relationships , so that create environment conducive for change behavior .

Abstract

Penegakan hukum yang adil dan efektif dalam menciptakan kepastian hukum yang menghargai harkat dan martabat manusia. Dalam konteks sistem pidana pidana, dilema hukum yang timbul akibat ketegangan diferensiasi fungsional antara kebijakan penyidik ​​dan tuntutan umum, terutama yang terkait dengan asas dominus litis, memerlukan pendekatan yang konstruktif. Penguatan peran penyidik, verifikasi kewenangan yang jelas, dan kolaborasi yang harmonis antara kedua lembaga tersebut merupakan kunci untuk membangun sistem investigasi yang modern, elegan, dan dapat dipercaya. Dengan mengubah tantangan tersebut menjadi peluang untuk berinovasi, serta meningkatkan efisiensi dan transparansi melalui teknologi dan pelatihan, diharapkan kepercayaan publik terhadap sistem hukum dapat terjaga, sehingga keadilan lebih mudah diakses oleh seluruh masyarakat. Peran polisi sebagai garda terdepan dalam menyelesaikan kasus dan menangkap pelaku tindak pidana sangat krusial dalam sistem pidana. Sebagai pihak pertama kali melakukan tindakan di lapangan, polisi bertanggung jawab untuk melakukan penyelidikan awal, mengumpulkan bukti, dan mengidentifikasi tersangka. Dengan keahlian investigasi yang baik dan pemahaman hukum yang mendalam, polisi berperan untuk memastikan setiap langkah diambil dengan cermat untuk membangun kasus yang kuat. Setelah bukti-bukti terkumpul cukup, polisi berkoordinasi dengan jaksa penuntut umum untuk memastikan pelaku dapat diadili. Proses ini tidak hanya mengutamakan penegakan hukum, namun juga menjamin perlindungan hak asasi manusia bagi semua pihak yang terlibat. Dengan demikian, polisi tidak hanya bertindak sebagai penegak hukum, tetapi juga sebagai pelindung keadilan yang menopang sistem hukum yang berfungsi secara efektif. Metode penelitian kualitatif ini menggunakan pendekatan yuridis normatif dengan mengkaji secara komprehensif dengan pendekatan studi pustaka dan menganalisisnya dengan pendekatan literasi, pendekatan peraturan perundang-undangan, dan pendekatan analisis konseptual.

Abstract

The objective of this research is to analyse the legal protection of holders of land rights in development. The research employs a normative legal research method, utilising data sourced from literature studies, including laws and regulations on mining, as well as literature, such as books related to the subject matter. First, it is the duty of the State to protect holders of land rights certificates due to the aforementioned individuals' good faith and the state's decision to issue certificates as proof of land titles. Such certificates should not be canceled by the state without compensation. In light of this, it is essential to have valid, correct, and appropriate rules of state administrative law and their effective implementation to guarantee the legal protection of holders of land rights certificates. Second, in instances where land is required for the implementation of public development, the acquisition process must be conducted expeditiously and in a transparent manner, while maintaining due consideration for the protection of legitimate rights to land. The legal basis for land acquisition for the implementation of development in the public interest as stipulated by Presidential Decree No. 55 of 1993 is no longer deemed appropriate in the current legal landscape. The issuance of Presidential Regulation No. 36 of 2005, which has been amended by Presidential Regulation No. 65 of 2006, is founded on several legal instruments. This research leads to the conclusion that the government's objective is to provide a form of protection and guarantee of legal certainty over land ownership for individuals. This is achieved through the registration of land rights as outlined in Article 19, Paragraph 1 of Law Number 5 of 1960 concerning Basic Agrarian Regulations. Abstract

Good corporate governance (GCG) is one of company's success factorto grow and make long term profit, as well as winning global businesscompetition. In practice, many corporations have not implementedGCG properly and are vulnerable to being involved in corporatecrimes. The presence of Supreme Court Regulation (PERMA) No. 13of 2016 concerning Procedures for Handling Criminal Cases byCorporations is an effort to encourage the implementation of GCG bycorporations, strengthen law enforcement and legal certainty toenhance implementation of corporate criminal liability. This studyaims to examine the ideal corporate criminal liability in realizing GoodCorporate Governance. This study is a normative legal study usingthe Approach method, namely the Law Approach and the CaseApproach. The results of the study show that as a country that adheresto civil law, Indonesia implements a two-tier board system that clearlyseparates the supervisory function by the supervisory board(commissioners) and the executive function (Board of Directors) by themanagement board. The implementation of GCG is closely related tothe implementation of corporate criminal liability. PERMA No. 13 of2016 is expected to strengthen law enforcement and provide legalcertainty related to the implementation of corporate criminal liabilityso as to encourage corporations to implement GCG or goodgovernance. Good Law Governance and Rule of Law are needed, withthe executive body of government that is fairly and independentlyresponsible in implementing the law.

Abstract

To optimize legal support for Indonesia's national security, there is a need for improvements in transparency, accountability, and flexibility. This involves strengthening legal support in areas such as cybersecurity, maritime sovereignty, and defense procurement, all aligned with Indonesia's defense vision. Collaboration between military and civilian roles within a national security framework is also crucial for resilience against internal and external threats. Legal reforms should focus on increasing transparency, accountability, and flexibility, while upholding democratic values and state sovereignty. According to Soerjono Soekanto's theory of law enforcement, the key factors for an effective legal system are laws, law enforcers, facilities, society, and culture. Challenges in the defense and security sector, including border violations, terrorism, transnational crime, and cyber security, highlight the urgency for adequate policy support, personnel, and facilities to achieve national goals.

Abstract

The strategy of synchronizing the content of highereducation for first-line officers in the field of personnelhas an important role in supporting theimplementation of the main tasks of the IndonesianArmy optimally. This study aims to analyze the needfor integration between the higher educationcurriculum and the competencies required in the fieldof personnel, as well as to identify legal implicationsrelevant to these tasks. The approach used isqualitative descriptive analysis through literaturereview, interviews, and observations. The results of thestudy indicate that the mismatch between the contentof higher education and operational needs in the fieldcan affect the effectiveness of task implementation,especially in the field of human resource management.In addition, it was found that legal aspects, such asmilitary administration regulations, personnelmanagement, and compliance with laws andregulations, are challenges that need to beaccommodated in the synchronization. With the rightsynchronization strategy, it is hoped that first-lineofficers can be better prepared to carry out their dutiesprofessionally, accountably, and in accordance withapplicable legal norms
