Abstract

Asymmetric decentralization is a policy approach within a unitary state that accommodates regional diversity by granting specific regions special authority. In Indonesia, this policy is implemented through a special autonomy scheme that grants different fiscal, institutional, and regulatory authority compared to other regions. Although designed to strengthen regional governance and maintain national integration, the implementation of special autonomy also poses various challenges, particularly related to regulatory disharmony, overlapping authority, and the complexity of coordination between the central and regional governments. This study aims to analyze the design of special autonomy as a form of asymmetric decentralization and its implications for the unity of the national legal system. The study uses a normative legal approach supported by limited empirical analysis through legislative and conceptual approaches. The legal assessment applies Articles 18, 18A, and 18B of the 1945 Constitution, the Aceh and Papua autonomy laws, and the Regional Government Law, supported by descriptive BPS human development data. The analysis was conducted descriptively and analytically to identify legal issues, relevant norms, and policy implications. The results show that asymmetric decentralization in Indonesia results in differentiation of regional fiscal, institutional, and regulatory authority, with statutory coordination and oversight mechanisms whose implementation requires closer alignment with the allocation of authority. This situation has the potential to give rise to conflicts of authority and administrative fragmentation, which could impact legal certainty and the effectiveness of public policy. Therefore, it is necessary to strengthen the clarity of the division of central and regional authority, harmonize regulations, and improve coordination and accountability mechanisms within the national legal system.

Abstract

This study aims to describe the implementation of risk management in the fixed asset management of the Bogor Regency Government; analyze the strengths and weaknesses of this implementation; analyze the effectiveness of risk mitigation; analyze the contribution of existing regulations regarding fixed asset management to the mitigation efforts undertaken; develop a risk mitigation model for fixed asset management; and formulate an implementation strategy for fixed asset management risk management. The study employs a qualitative approach using triangulation techniques, with data analysis involving reduction, presentation, and conclusion drawing. It utilizes data from the 2021–2024 period, obtained through interviews, questionnaires , observations, and literature reviews at the research site, the Bogor Regency Regional Financial and Asset Management Agency (BPKAD). The research identifies 50 risk variables, 13 external risk cause variables, 50 internal risk cause variables, 81 impact variables, and 83 risk mitigation variables. Based on SNI ISO 31000:2018, the study identifies 5 strength variables and 6 weakness variables. Reveals that 74.70% of mitigation efforts are effective against internal risk causes, and 38.55% are effective in enhancing budget efficiency and reducing state financial losses. Ministry of Home Affairs regulations concerning fixed asset management contributed to 43.37% of risk mitigation efforts. The study also produces a three-layer risk mitigation model for fixed asset management. Relevant implementation strategies include regulatory harmonization, the provision of an integrated information system, commitment enhancement, risk management competency development, the simplification of risk management administration and reporting, and the strengthening of network cooperation.
