Abstract

Abstrak: Kebijakan dalam bentuk perizinan investasi minuman keras telah memicu terjadinya peningkatan kekerasan dan kriminalitas di kalangan masyarakat. Penelitian ini bertujuan untuk mendeskripsikan tingkat kriminalitas yang disebabkan oleh kebijakan perizinan investasi minuman keras. Menggunakan metode kualitatif deskriptif. Hasil penelitian memperlihatkan; (1) Kebijakan perizinan investasi minuman keras beralkohol tidak ada manfaatnya, bahkan memiliki dampak negative di kalangan masyarakat; (2) Pengguna minuman keras beralkohol terjadi peningkatkan kriminalitas di kalangan masyarakat; (3) Kebijakan yang ada seyogyanya sebagai solusi dalam memberantas minuman keras beralkohol dan kriminalitas. Ini berbanding terbalik dengan peran fungsi kebijakan yaitu pengesahan perizinan investasi minuman keras. Sehingga tulisan ini dapat disimpulkan kebijakan perizinan investasi minuman keras memperlihatkan dampak negative dalam kehidupan masyarakat, dan pada akhirnya melalui berbagai pendapat para ahli dan organisasi masyarakat, maka Peraturan Presiden RI tersebut resmi dicabut. Sehingga tulisan ini menyarankan perlu dilakukan penelitian lanjutan dengan memperlihatkan aspek komparasi secara kewilayahan yang bersumber pada data yang lebih bervariasi. Dengan demikian kebijakan yang lebih akurat dapat dirumuskan dalam rangka meningkatkan investasi dan pendapatan Negara dengan tidak menimbulkan keresahan dan kriminalitas dalam masyarakat.Kata Kunci: Peningkatan Kriminalitas, Kebijakan, Investasi Minuman Keras Abstract: Policies in the form of licensing investment in liquor have triggered an increase in violence and crime in the community. This study aims to describe the crime rate caused by the liquor investment licensing policy. Using descriptive qualitative method. The research results show; (1) The investment licensing policy for alcoholic beverages has no benefits, and even has a negative impact on the community; (2) Users of alcoholic beverages have an increase in crime in the community; (3) The existing policy should be a solution in eradicating alcoholic beverages and crime. This is inversely proportional to the role of the policy function, namely the ratification of liquor investment licensing. So that this paper can conclude that the liquor investment licensing policy shows a negative impact on people's lives, and in the end through various opinions of experts and community organizations, the Presidential Regulation of the Republic of Indonesia is officially revoked. So this paper suggests that further research is needed by showing aspects of regional comparison that are sourced from more varied data. Thus, more accurate policies can be formulated in order to increase investment and state revenues without causing unrest and crime in society.Keywords: Increasing Crime, Policy, Investment in Liquor

Abstract

ABSRAKPenelitian ini bertujuan untuk mengetahui status talak menurut fikih dan ketentuan hukum nasional dan bagaimana cara mengharmonisasikan antara ketentuan fikih dan hukum nasional. Adapun hasil penelitian ini adalah secara aturan hukum Islam dan fikih dijelaskan bahwa selama rukun dan syarat perceraian terpenuhi, dimanapun dan kapanpun ketika suami mengucapakan talak maka cerai tersebut jatuh dan sah. Namun dalam aturan hukum nasional sebagaimana disebutkan dalam pasal 38 ayat (1) Undang-Undang Nomor 1 tahun 1974 dan pasal 115 Kompilasi Hukum Islam yang intinya perceraian itu dianggap sah dan jatuh jika diucapkan di depan sidang pengadilan. Maka untuk kehati-hatian agar aturan agama tidak dilanggar, hakim harus menggali dalam fakta-fakta di persidangan sudah berapa kali sang suami pernah mengucapkan talak. Jika sang suami pernah mengucapkan talak satu maka putusannya adalah memberikan izin menjatuhkan talak raji’, jika talak dua maka putusannya memberikan izin menjatuhkan talak bain kubra dan jika talak tiga maka putusannya memberikan izin menjatuhkan talak bain kubra. Seperti itu nampaknya solusi terbaik agar aturan agama tidak bertentangan dengan atura nasional.Kata Kunci: Status Talak, Hukum Islam dan Hukum Nasional ABSRACTThis study aims to determine the status of talak according to fiqh and the provisions of national law and how to harmonize the provisions of fiqh and national law. As for the results of this research are that according to the rules of Islamic law and jurisprudence, it is explained that as long as the terms and conditions of divorce are met, wherever and whenever the husband says divorce, the divorce falls and is legal. However, in the national law as stated in article 38 paragrafh (1) of law number 1 of 1974 and article 115 of the Compilation of Islamic Law, the point is that divorce is considered valid and falls if it is pronounced in front of a court session. So to be careful so that religious rules are not violated, the judge must dig into the facts in court how many times the husband had pronounced divorce. If the husband has ever said divorce one then the verdict is to give permission to drop talak raji ', if talaq is two then the verdict gives permission to drop talak bain kubra and if divorce is three then the verdict gives permission to drop talak bain kubra. Like that, it seems the best solution so that religious regulations do not conflict with national rules.Keywords: Divorce Status, Islamic Law and National Law

Abstract

Abstract : Narcotics cases are cases of extraordinary crimes (Extraordinary Crime) which are of concern to all countries in the world, because narcotics can damage a generation of nations from a country. During the Corona Virus Disease pandemic or commonly abbreviated as the acronym COVID-19. The type of research used in this research is normative juridical with a statutory and conceptual approach. This Restorative Justice can only be applied to addicts, abusers, drug dependence, victims of abuse, and narcotics for one day use. Restorative Justice can be applied if it meets the requirements, namely when caught red-handed by Polri investigators and/or National Narcotics Agency (BNN) investigators found evidence of one-day use and also has the results of an assessment from the Integrated Assessment Team for each case file transfer.Keywords: Criminal Law Policy, Narcotics, Restorative Justice

Abstract

Abstract : In carrying out its duties, Densus 88 AT needs to be supervised by an independent institution that oversees the work of the anti-terror unit of Densus 88 because so far there are indications that there is no supervision or evaluation of the performance of Densus 88, so there is an impression of being out of control.Komnas HAM did not want to comment on the pros and cons of the disbandment of Densus 88 AT, because the agency agreed that terrorists should be dealt with, but arbitrary actions should not be taken. Abstract: The special agency tasked with eradicating and eradicating corruption in Indonesia, called the Corruption Eradication Commission, has the authority to coordinate and supervise, including conducting investigations, investigations, and prosecutions, while regarding the formation, organizational structure, work procedures and responsibilities, duties and authorities and its membership is regulated by Law Number 19 of 2019 concerning the Second Amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission. Abstract

Abstract: There is a phenomenon where married husband and wife only fulfill the requirements and pillars of Islamic marriage. This marriage is called a siri marriage. The Directorate General of Population and Civil Registration states that every married Indonesian citizen is required to have a family card even if they are married outside of wedlock. This policy allows unregistered marriages to obtain a KK using the SPTJM form with a special note that the marriage is not registered. This study uses a normative juridical approach and analytical descriptive research specifications, namely by explaining the laws and regulations related to the events studied. in this case regarding the registration of unregistered marriages using SPTJM on KK. Based on the results of the study, the use of SPTJM against KK has no legal consequences, the use of SPTJM against KK has no legal consequences, the marriage that is carried out will legally result in the status of the child from the marriage being unclear, the rights and obligations of the husband and problems in managing marital assets are regulated in UUP and KHI.Keywords: KK, Siri Marriage, SPTJM

Abstract

Abstract : Civil Servants are the first element as human resources that play a role in government development. The aim of the Government to issue Regulations on Civil Servant Discipline is to guarantee the order and smooth running of the duties of the Civil Servants themselves, so that in carrying out their main duties and functions as government apparatus they can run properly which in the end can support development in Indonesia. But in reality, regulations issued by the government cannot suppress disciplinary violations committed by civil servants. There are still many civil servants who are undisciplined in their work, lack awareness to complete tasks, and lack a sense of responsibility for their work. This is because there is no concern for the implementation of its duties, principals and functions, so that it indirectly causes the activities of the agency to not go well. The formulation of the problem in this study is how is the application of civil servant discipline in DKI Jakarta? This research uses juridical-empirical research and legal sociology approaches to determine the effectiveness of civil servant disciplinary regulations. It is known that there are already regulations governing civil servant discipline, namely PP No. 94 of 2021 concerning PNS Discipline, but in sociological law enforcement there are still obstacles in upholding civil servant discipline. So it is necessary to have a solution in order to increase the discipline of Civil Servants to reduce the number of violations committed.

Abstract

Abstract: Bain & Company and Facebook research predicts that the online shopping sector in Indonesia will grow 3.7 times from US$ 13.1 billion in 2018 to US$ 48.3 billion in 2025, and the number of digital consumers in Indonesia is as much as 64 million people in 2017 to as many as 102 million people or around 53% of the total population in 2018. Even so, this massive e-commerce development itself opens up opportunities for cybercrime or what is commonly called cybercrime. Theft of personal data is a form of privacy violation. The formulation of the problem in this research is what is the basis for the judge's considerations in imposing a crime on misuse of personal data in Decision Number 438/Pid.Sus/2020/PN.Jkt.Utr? This research uses the type of juridical-normative research. The results of the study showed that Dede Supardi had committed an unlawful act in accordance with statutory provisions, especially in RI Law Number 19 of 2016 in Article 27 paragraph (4) which explained all the actions of the defendant. Based on the analysis of the decision number 438/Pid.Sus/2020/PN.Jkt.Utr which the author does that criminal responsibility for perpetrators who commit criminal acts of extortion and threats through the dissemination of personal data is in accordance with Article 45 paragraph (4) Jo Article 27 paragraph (4 ) Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions. Penalties will be imposed on individuals or corporations who commit prohibited acts. Such as collecting personal data that is not theirs to benefit themselves or others, disclosing personal data that is not theirs and falsifying personal data for profit resulting in losses for others. Criminal provisions are regulated in articles 67-73, in the form of a maximum fine of IDR 4 billion to IDR 6 billion and a maximum imprisonment of 4 years to 6 years.Keywords: Personal data, Accountability, Consumer Protection

Abstract

Abstract: The company's directors as the organ that leads the company based on the law have the responsibility to manage the company for the benefit of the company and represent the company both inside and outside the court. Strike action is an activity that comes as a result of failed negotiations in resolving industrial relations disputes between companies and workers. Regarding the strike action, the Board of Directors as an organ that has responsibility for the company is also responsible. Therefore, this study aims to understand the responsibilities of the Board of Directors regarding strikes by workers and to find out what actions the company can take as an effort to prevent strikes by workers. This study uses a normative juridical approach, legal research conducted by examining literature or secondary data as the basis for research by conducting a search of regulations and literature. Based on research, the responsibilities of the Directors regarding the strike action are based on the provisions contained in the BUMN Law and the Company Law as well as the provisions in the Civil Code. The actions that can be taken as an effort to prevent strikes from affecting the company's productivity are by creating a harmonious relationship between the company and workers, establishing a Bipartite LKS, fulfilling workers' rights, and improving workers' welfare.
