Abstract

Along with the development of technology in this modern era, it also develops in terms of muamalah transactions such as the presence of new applications that change contracts that were previously carried out in person can now be done online and are considered to be easier, the sophistication of the technology can also have an impact on transactions that contain elements of fraud, betting and others by irresponsible parties. In modern muamalah activities, there are gharar and maysir practices carried out by several parties. The presence of sophisticated transactions in this modern era makes users not aware of whether the transaction contains elements such as gharar (obscurity) and maisir (gambling) in the device or transaction. The prohibition of gharar and maysir is increasingly relevant for this modern era because modern markets contain many attempts to transfer risk (danger) to other parties that contain elements of gambling. Because this transaction is prohibited in Islam and as economic actors, humans must be more careful and selective in order to avoid gharar and maysir which in this modern era have turned into several forms such as in banking, insurance, stock exchanges, online gambling and games online.

Abstract

This study aims to determine the governance and Utilization of Zakat, Infaq, Alms Funds at the Tangerang City Baznas in the Perspective of MUI Fatwa Number 23 of 2020. This study uses qualitative methods to describe the utilization of zakat, infaq, and alms (ZIS) funds. The source of this research data was taken through interviews with the daily chief executive and staff from the Tangerang City BAZNAS distribution division as core informants and also supporting informants such as mustahik who received program assistance after the MUI fatwa Number 23 of 2020. Other data were taken from various related documentation and articles. with this research. The results of this study explain that the management of ZIS funds at BAZNAS Tangerang City has been running according to the rules because it always refers to the annual budget work plan based on RELU (Distribution Realization) and RESTRA (Strategic Plan) for the next 5 years and is prepared according to the annual budget work plan. In addition, Tangerang City BAZNAS has carried out optimal management of zakat funds in accordance with MUI Fatwa Number 23 of 2020.

Abstract

Pawn is a contract that is allowed in islam and is a detention of an object that is used as collateral for a certain period of time to pay off the debt in whole or in part. In detention, scuh as taking the benefits of pawned goods, according to the malikiyah opinion, those who are entiled to take the benefis of pawned goods are murtahin (pawn recipients) on condition that they get permission from rahin and are included in the sale and purchase contract or exchange contract (al mu’aawadhah) with clear terms of time limit. Specified, while according to syafi’iyah, the benefit of the pawned goods is carried out by the rahin (the pawnbroker) as long as it does not reduce the value of the pawned goods. This study aims to discuss the differences of opinion on the use of pawned goods according to syafi’iyah and malikiyah.

Abstract

Multi-Level Marketing Business is a business method that is growing rapidly in today's society. However, regarding the permissibility of this business, there are still different understandings between the parties. Likewise regarding the difference between conventional MLM and Islamic MLM. This article aims to examine more deeply the differences between Sharia MLM and Conventional MLM and explore contemporary fiqh views regarding this business. The method used is descriptive qualitative using secondary data obtained from literature related to the discussion.Multi Level Marketing is also commonly known as sales intermediary services. This service (broker) in fiqh terminology called samsarah/simsar is a trade intermediary (people who sell goods and find buyers) or intermediaries between sellers and buyers to facilitate buying and selling. Samsarah/simsar activities in the form of distributors, agents or members, in fiqh include ijarah contracts, namely a transaction using the services of another person in return, incentives or bonuses (ujrah), all scholars consider it permissible (mubah). MLM Business Regulations in the realm of sharia are contained in the DSN-MUI Fatwa Number: 75/DSN-MUI/VII/2009 concerning Guidelines for Sharia Tiered Direct Selling. Abstract

The guarantee provisions in Indonesian positive law cannot be simply applied to Islamic banking, without reviewing and analyzing the provisions of Islamic law, because Islamic banks still have to implement sharia complieant systems and operations. The purpose of this study is to find out more about the status of guarantees in mudharabah profit sharing contracts in Islamic banking. Knowing the ideas in the development of guarantees from the perspective of positive law that applies in Islamic banks, and their compatibility with fiqh studies. This research is a qualitative library research. Data were collected from a number of publications related to the research topic, then the data were interpreted and analyzed descriptively. The results of this study indicate that the legitimacy of Islamic law allows taking material guarantees for the mudharabah contract as a guarantee against negligence or violations that may be committed by trust holders such as mudarib. Collateral is an important thing to be included in financing in Islamic banking with the reason of avoiding violations that may occur by the debtor. The permissibility or necessity of collateral in sharia law is also explained by an Islamic figure, namely Sheikh 'Ali al-'Adawi who asserts that it is legal to take collateral to guarantee trust contracts against moral hazard (borrower moral hazard) that may be carried out by the trust holder.

Abstract

Perkembangan teknologi yang begitu cepat berakibat pada perkembangan metode-metode penjualan yang terus mengalami kemajuan, salah satunya yaitu metode pembayaran cash on delivery. Cash on delivery merupakan pembayaran dengan menyerahkan uang tunai pada saat barang sudah diterima oleh konsumen. Namun dalam praktiknya jual beli dengan sistem cash on delivery terdapat kasus di mana terjadi pembatalan secara sepihak yang dilakukan oleh konsumen. Hal ini juga terjadi di toko Lucky Light Candy Kota Mataram. Penelitian ini bertujuan untuk menjawab permasalahan mengenai praktik pembatalan sepihak transaksi jual beli dengan sistem cash on delivery dan tinjauan hukum ekonomi syariah terhadap praktik pembatalan sepihak transaksi jual beli dengan sistem cash on delivery.
