Al-Manhaj: Journal of Indonesian Islamic Family Law (ISSN 2714-5522; E-ISSN 2715-0097) published twice a year, always places Islamic Family Law, and Islamic Civil Law in the central focus of academic inquiry and invites any comprehensive observation of Islam Family Law as a normative Islam and a system of society and Muslims as those who practice the religion with their many facets. The subject covers textual and fieldwork studies with various perspectives of Islamic Family Law, Islam and gender discourse, and legal drafting of Islamic Civil law. In the beginning the journal only served as a scholarly forum for the lecturers, professors, and students at the State Institute of Islamic Studies. However, due to the later development, the journal has successfully invited scholars and researchers outside the Institute to contribute.

Abstract

Tulisan kali ini mengupas alasan penolakan masyarakat Pakistan, Afghanistan, dan Indonesia. Menggambarkan alasan penolakan masyarakat atas lahirnya reformasi hukum keluarga Islam, dengan didahului uraian historitas pro-kontra reformasi Hukum keluarga pada ketiga negara tersebut. Hasil tulisan ini menunjukan terdapat relevansi antara alasan penolakan umat atas risalah kenabian dengan alasan penolakan masyarakat atas reformasi hukum keluarga Islam. Relevansi yang ditemukan adalah keduanya menolak perubahan (ideas movement), dan hanya ingin mempertahankan nilai kemapanan. (This article explores the reasons for the people of Pakistan, Afghanistan, and Indonesia. The people's reasons for reforming Islamic family law explain the historical pros and cons of Drawing Family Law in the three countries. The results of this paper indicate a relevance between the reasons for rejecting the prophetic message and the reasons for the users of Islamic family law reform. The relevance found is that both resist change (idea movement) and only want to maintain established values.)

Abstract

(The focus of the problem studied in this study, namely: what are the reasons for the community of Jarin Village, Pademawu District, Pamekasan Regency to carry out the dhempo tradition? and what is the community's view of the dhemo' tradition in the engagement process in Jarin Village, Pademawu District, Pamekasan Regency? After doing the research, it was concluded that the strong reason for the community to conduct demonstrations was one of them on the basis of following the previous elders.)

Abstract

Tradisi pecotan dalam acara Walimah al-’urs mewajibkan para tamu untuk berdonasi uang dan merupakan syarat yang harus dipenuhi saat menghadiri undangan walimah. Pengembangan tradisi pecotan dalam perayaan walimahul 'urs di Desa Bandaran masih dilakukan oleh masyarakat karena tradisi ini memiliki sifat yang lestari. Tradisi ini jarang dilakukan. Namun makna tradisi pecotan dalam perayaan Walimah al-’urs tetap diwujudkan yaitu memberikan sumbangan selain biaya acara. (the pecotan tradition in the Walimah al-’urs event requires guests to donate money and is a condition that must be met when attending a walimah invitation. The development of the pecotan tradition in the Walimah al-’urs celebration in Bandaran Village is still carried out by the community because this tradition has a sustainable nature. This tradition is rarely carried out. However, the meaning of the pecotan tradition in the Walimah al-’urs celebration is still realized, namely giving donations other than the cost of the event.)

Abstract

Tulisan ini menganalisa dampak perkawinan siri dari segi keadilan terhadap istri dan anak-anak, serta perlindungan hukumnya yang dilakukan oleh TKI Pamekasan, baik dengan sesama Warga Negara Indonesia ataupun dengan Warga Negara Asing. Dampak terhadap anak yaitu terjadinya diskriminasi baik dari lingkungan maupun keluarganya sendiri; anak tidak mendapatkan hak-hak sipilnya (akta lahir); sulit untuk menyatakan pendapatnya; sulit untuk melangsungkan kehidupan serta pendidikannya. (This paper analyzes the impact of unregistered marriages in terms of justice for their wives and children, as well as the legal protection carried out by Pamekasan TKI, both with fellow Indonesian citizens or with foreign nationals. The impact on children is the occurrence of discrimination both from the environment and their own families; the child does not get his civil rights (birth certificate); it is difficult to express his opinion; difficult to carry on life and education.)

Abstract

(This study highlights the phenomenon of childfree that is starting to happen a lot in marriage. As a relatively new thing in Indonesia, the reproductive rights of a woman (wife) have so far been understood as the prerogative of a man (husband) as classical fiqh also believes it. This study focuses on 2 points, one of which is Masdar Farid Mas'udi's point of view regarding the childfree phenomenon as the antithesis of classical fiqh experts, especially Al-Ghazali.)

Abstract

(This study reveals the fact of the community anomaly, carrying out a serial marriage which is carried out a few days or months before the marriage is officially carried out in front of the official of the Office of Religious Affairs (KUA). There are at least three reasons for the unregistered marriage to be carried out, namely as an anticipation of the wrong assumptions of the public who judge that engagement has consequences such as a marriage contract. Second, avoiding the fall of the bride and groom into acts such as adultery and others. Third, as an effort to hasten the marriage because of concerns about the failure of the wedding procession.)
