Abstract

This research aims to analyze the legal validity of Shopee’s complaint feature in Shopee transaction disputes and the legal implications if such evidence is not recognized in civil proceedings. The issue arises from disputes related to product discrepancies and the absence of clear legal standards regarding the admissibility of Shopee’s internal system records in civil litigation. The urgency of this research lies in ensuring legal certainty and consumer protection in e-commerce transactions. This study employs a normative juridical method with a statutory approach, supported by empirical data consisting of negative consumer reviews and documented cases of rejected refunds or returns on Shopee. The novelty of this research lies in its theoretical examination of Shopee’s complaint feature as admissible evidence under the Electronic Information and Transactions Law, the principle of legality in civil procedural law, and authentication as a prerequisite for the validity of digital evidence. The findings indicate that Shopee’s complaint feature meets the formal requirements of valid electronic evidence; however, in judicial practice, its evidentiary weight is often categorized merely as a supporting indication and considered weak due to authentication limitations, lack of digital forensic verification, non-transparent internal verification mechanisms, and inconsistent judicial acceptance in similar cases. This research contributes to the development of digital evidence assessment in e-commerce disputes by offering a framework for evaluating the validity of marketplace-based evidence. It further emphasizes the urgency of regulatory reconstruction and technical guidelines for the admissibility of digital evidence to ensure legal certainty, platform accountability, and consumer protection in online transactions.   Penelitian ini bertujuan untuk menganalisis keabsahan hukum fitur pengaduan Shopee dalam kasus transaksi Shopee dan implikasi hukum jika fitur pengaduan tidak diakui sebagai bukti sah. Permasalahan ini berawal dari sengketa transaksi Shopee, terkait ketidaksesuaian barang dan ketiadaan standar hukum yang tegas dari sistem internal Shopee dalam proses perdata. Urgensi penelitian ini adalah untuk menjamin kepastian hukum dan perlindungan konsumen dalam transaksi e-commerce. Metode penelitian ini bersifat yuridis normatif dengan pendekatan perundang-undangan dan data empiris berupa ulasan negatif konsumen dan kasus penolakan refund atau retur Shopee. Kebaruan penelitian ini, secara teoretis menganalisis fitur pengaduan Shopee sebagai bukti yang sah menurut Undang-Undang Informasi dan Transaksi Elektronik asas legalitas pembuktian hukum acara perdata, dan konsep autentikasi sebagai syarat validitas bukti digital. Hasil penelitian menunjukkan bahwa fitur pengaduan Shopee memenuhi unsur sah alat bukti elektronik, namun dalam praktik peradilan kekuatan pembuktiannya dianggap sebagai petunjuk dan dipandang lemah karena keterbatasan autentikasi, verifikasi ahli digital forensik, tidak transparannya mekanisme verifikasi internal platform, serta inkonsistensi penerimaan oleh majelis hakim dalam perkara sejenis. Penelitian ini berkontribusi pada pengembangan kajian pembuktian digital dalam sengketa e-commerce dengan kerangka penilaian validitas bukti berbasis sistem marketplace. Penelitian ini menegaskan urgensi rekonstruksi regulasi dan pedoman teknis penerimaan bukti digital agar dapat menjamin kepastian hukum, akuntabilitas platform, dan perlindungan konsumen dalam transaksi daring.

Abstract

This study aims to evaluate whether the legal framework governing Corporate Social and Environmental Responsibility (TJSL/CSR) in Bali has been effectively designed and implemented to maximize public and cultural welfare, or whether it remains confined to administrative compliance. Using a juridical-normative method informed by a utilitarian evaluation framework, this research examines the normative foundations of TJSL under the Company Law of 2007, Government Regulation No. 47 of 2012, and Law No. 15 of 2023 (ius constitutum), as well as their operationalization through Bali Provincial Regulation No. 8 of 2023 and Governor Regulation No. 46 of 2023 (ius operatum). The analysis demonstrates that, although the national legal framework provides sufficient authority for regional governments to coordinate and direct TJSL toward culture-based public welfare, its implementation in Bali remains predominantly input-oriented and administrative. The findings identify a significant utility gap, manifested in the absence of standardized cultural outcome indicators, outcome-based public reporting, independent verification mechanisms, and performance-based incentives or sanctions. As a result, TJSL policies have not been able to optimally translate corporate social resources into measurable benefits for key sectors of Balinese welfare, such as the strengthening of customary institutions, the preservation of ritual landscapes, and the transmission of traditional knowledge. The novelty of this study lies in its outcome-oriented evaluation of TJSL policy through a utilitarian lens, bridging normative legal analysis with public policy assessment. The study further proposes a direction for policy reconstruction that aligns TJSL implementation with cultural indicators mandated under Provincial Regulations No. 4 of 2020 and No. 5 of 2020, thereby repositioning TJSL as an effective instrument for cultural sustainability and public welfare rather than mere procedural compliance.

Abstract

Capital market legal reform through Law Number 4 of 2023 on the Development and Strengthening of the Financial Sector (the P2SK Law) represents a comprehensive effort to address structural weaknesses in Indonesia’s financial sector. However, existing scholarship remains limited in assessing the P2SK Law in an integrative manner, particularly in linking legal efficiency with the philosophical dimension of justice in capital market governance. This analytical gap raises questions as to whether the omnibus reform not only enhances market performance but also ensures fairness for all stakeholders. This study aims to analyze the implications of the P2SK Law for regulatory efficiency, transparency, and investor protection in Indonesia’s capital market. The research employs a qualitative normative legal method using the Economic Analysis of Law (EAL), Cost–Benefit Analysis (CBA), and classical legal philosophy approaches. Primary legal materials include the P2SK Law as well as regulations issued by the Financial Services Authority (OJK) and the Indonesia Stock Exchange, which are analyzed alongside legal and financial literature as secondary sources. The findings indicate that the strengthening of OJK’s authority and the enhancement of disclosure obligations under the P2SK Law contribute to lower transaction costs and improved information symmetry, which in turn causally promote greater investor confidence and deeper market liquidity. Furthermore, the simplification of the regulatory structure reduces overlapping authority and strengthens legal certainty, thereby improving capital market governance and systemic risk mitigation. From a justice perspective, the reform also expands retail investor access and accommodates digital financial innovation, aligning with the principles of corrective and distributive justice. The novelty of this study lies in its proposal of an integrative evaluation model that combines economic efficiency and moral justice in assessing capital market regulation. This contribution is not only theoretical but also practical, offering a comprehensive policy-analysis framework for evaluating the effectiveness of modern financial-sector reforms.

Abstract

This study aims to examine the legality of using QR-Codes as a validation mechanism and a substitute for signatures on copies of notarial deeds within the Indonesian legal system and to formulate directions for regulatory reform. The research is motivated by the increasing risk of forgery of notarial deed copies and the limitations of the Notary Law (UUJN), which has not explicitly accommodated electronic authentication mechanisms, despite the recognition of electronic signatures under the Electronic Information and Transactions Law (UU ITE). This research employs a normative juridical method using statutory, conceptual, comparative, and philosophical-progressive approaches. The findings indicate that under the current legal framework (lex lata), QR-Codes cannot yet be fully recognized as a substitute for notarial signatures on deed copies. However, normatively and conceptually, QR-Codes possess strong potential to be legalized as an electronic authentication mechanism, provided that they are synchronized with the UU ITE and supported by an official state verification system. The novelty of this study lies in proposing a normative synchronization model between the UUJN and the UU ITE that positions QR-Codes as a form of electronic validation, as well as in formulating a regulatory blueprint for QR-Code-based verification of notarial deed copies integrated with the AHU Online system. This study recommends regulatory reform in notarial law to enhance legal certainty, prevent document forgery, and improve efficiency and public trust in notarial practices in the digital era.   Penelitian ini bertujuan menganalisis legalitas penggunaan QR-Code sebagai validasi dan pengganti tanda tangan pada salinan akta notaris dalam sistem hukum Indonesia serta merumuskan arah pembaruan pengaturannya. Penelitian ini dilatarbelakangi oleh meningkatnya risiko pemalsuan salinan akta notaris dan keterbatasan Undang-Undang Jabatan Notaris (UUJN) yang belum secara eksplisit mengakomodasi mekanisme autentikasi elektronik, meskipun Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) telah mengakui keabsahan tanda tangan elektronik. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, komparatif, dan filosofis-progresif. Hasil penelitian menunjukkan bahwa secara hukum positif (lex lata), QR-Code belum dapat diposisikan sepenuhnya sebagai pengganti tanda tangan notaris pada salinan akta, namun secara normatif dan konseptual memiliki potensi kuat untuk dilegalkan sebagai mekanisme autentikasi elektronik sepanjang disinkronkan dengan ketentuan UU ITE dan didukung oleh sistem verifikasi resmi negara. Kebaruan penelitian ini terletak pada perumusan model sinkronisasi norma antara UUJN dan UU ITE yang menempatkan QR-Code sebagai instrumen validasi elektronik, serta penyusunan blueprint regulasi verifikasi salinan akta notaris berbasis QR-Code yang terintegrasi dengan sistem AHU Online. Penelitian ini merekomendasikan pembaruan regulasi kenotariatan guna memperkuat kepastian hukum, mencegah pemalsuan dokumen, dan meningkatkan efisiensi serta kepercayaan publik terhadap praktik kenotariatan di era digital.
