Abstract

Adat law is a set of written and unwritten norms that have lived in communities since historical period. In some regions in Indonesia that are still thick with customs and culture, customary practices are often carried out which often results in inconsistent with positive Indonesian Law. The practice of Ngarorod Marriage is a tradition of the Balinese people could raise questions with Indonesian legal regulations, especially Law No. 1 of 1974 concerning Marriage. The kinship position and the difference of the female caste is higher than the men being, is one of the causes of the Ngerorod custom.

Abstract

The position of the Judicial Commission in the judicial institutions is now subject to degradation of the interpretation of authority in accordance with Article 24B Paragraph (1) of the Indonesia Constitution related to its role in selecting judges for the general judiciary, religion and state administration, through Decree No. 43/PUU-XIII/2015. The ruling changed the position and authority of the Judicial Commission into a judicial body that only functions in terms of oversight of ethical-professional issues against judges. The judicial commission's participation in the selection of judges with the aim of finding judges of integrity and professional integrity has been abolished. Based on these issues, the discourse on contestation of the authority of the Judicial Commission in the supreme court recusal process emerged as an urgency of discussion in the field of legal research on the Indepedency of External Auditors in judicial power in Indonesia.

Abstract

Permasalahan hukum di tingkat internasional mengandung kompleksitas dan kerumitan yang lebih dibandingkan dengan konflik dalam suatu yurisdiksi wilayah tertentu. Hal tersebut dikarenakan permasalahan hukum internasional dapat melibatkan beberapa negara sekaligus dan mekanisme penyelesaian yang memerlukan upaya yang tidak sedikit. Seperti pada kasus yang akan penulis bahas dalam tulisan ini adalah berkaitan dengan sengketa Laut China Selatan yang diajukan oleh Negara Filipina sebagai salah satu negara yang merasa memiliki hak atas Laut China Selatan. Filipina membawa kasus sengketa Laut China Selatan dengan Negara Tiongkok ini ke ranah Arbitrase Internasional. Filipina mendalilkan bahwasannya tindakan China yang membangun pulau-pulau buatan telah menyebabkan kerusakan parah pada lingkungan terumbu karang. Kelanjutan analisis dari kasus ini akan dibahas lebih detail pada bagian di bawah ini.

Abstract

Various problems occur in the society caused by anarchism by football supporters has not been able to be completed well in mechanisms of state law. Whereas in the Indonesia Constitution had been there a guarantee from the state about human rights, such as the right to feel save, the right to life, freedom of association and assembly. But often the act of football supporters cause harm to society and the state. They damage public facilities, disrupt community activities, even cause death of a person. One mechanism that has evolved in an effort to controll football supporters is by implementing Football Spectators Act (FSA). However, Indonesia has not applying Football Spectators Act (FSA) concept in Regulation Legislation. It is encouraging the writers to research condition and any problems about football suporters and how the concept of Football Spectators Act (FSA) can be implemented as a controll for Football Suporters in Indonesia. . This study aims to analyse football suporters problems in Indonesia, to know, to understand about the concept and find modification of Football Spectators Act (FSA) as a instrument controll for football supporters in Indonesia. This is a normative-legal research that analyse the primary, secondary, and tertiary data. According to the facts, Football Spectators Act (FSA) concept should consist of preventive effort and repressive effort to resolve football supporters problems clearly. This concept should applied in to Regulation Legislation and held by government, police, Asosiasi Suporter Sepak Bola Indonesia (ASSI), community of regional supporters, and society.

Abstract

Indonesia merupakan salah satu negara kepulauan yang memiliki potensi sumber daya kelautan yang sangat melimpah didukung dengan kondisi geografis yang menunjang perkembangannya. Namun, sebagai negara kelautan, Indonesia memiliki ancaman klasik yang bahkan dapat mengancam kedaulatan Republik, yaitu adanya penangkapan ikan secara ilegal atau disebut dengan Illegal Fishing. Pemerintahan Jokowi di awal periodenya di bawah supervisi Susi Pudjiastuti selaku Menteri Kelautan dan Perikanan melakukan tindakan reaksioner berupa penenggelaman kapal yang melakukan IUUF. Karya tulis ini bermaksud mengkaji kebijakan tersebut dari perspektif hukum serta berusaha menemukan solusi melalui mekanisme alternatif penyelesaian sengketa yang tepat.
