Abstract

The control exercised by business actors over supporting facilities in rest areas must be a serious concern, as it infringes upon tourists' rights. This research is analyzed using a normative legal method with an inconcrete approach and analytical descriptive elaboration, exploring the freedom rights of tourists in utilizing supporting facilities, the obligations of vendors as business actors to provide comfort to tourists, and the legal consequences of violations of tourists' rights. The findings indicate that, according to Law Number 1 of 2009 on Tourism, tourists' rights to comfort in using supporting facilities are regulated, along with the obligations of business actors to provide comfort to tourists. Additionally, legal consequences in the form of sanctions are found in Magetan Regency Regional Regulation Number 7 of 2013 on Tourism.

Abstract

In 2018 the Ciletuh-Palabuhanratu Geopark, Sukabumi Regency received Global recognition from the United Nations Educational, Scientific and Cultural Organization (UNESCO), UNESCO Global Geoparks are defined as an integrated geographical area where international geological sites and landscapes are managed with the concept of holistic protection. The existence of Indigenous Peoples in the forest area will be related to the forest. Customary law communities in forest areas can use forest, even Article 37 of the Forestry Law regulates customary forests. According to its function. Constitutional Court Decision No. 35/PUU-X/2012, based on the judicial review, it is hoped that there will be no more problems related to forest status between customary law communities and the state or companies. In fact, in the life of the Ciptagelar kasepuhan community there is still overlapping of laws. From this, problems arise (1) How is the management of the customary land of the Ciptagelar community in the Ciletuh Geopark area, (2) What are the rights for the Ciptagelar community in the Ciletuh Geopark area, (3) How is the management of land conflict resolution between indigenous peoples, indigenous peoples and the government? regional and national, and indigenous peoples and corporations. This study uses a combined Normative and Empirical research method with the Statute Approach, Analytical and Conceptual Approach, Case Approach and perceptual approach. The results of this study are that so far, there have been many regional regulations in regencies/cities, provinces that give recognition to Indigenous Peoples, Indigenous Peoples who carry out their traditional work have the potential to lose their land. This happens because the Job Creation Law generally regulates the ease of investing. There is still a lack of guarantees for customary rights to control their customary areas if they are clashed with the principle of public interest by the government. Until now, there is no legislation that is lex specialist for the protection of the rights of indigenous peoples.

Abstract

This research aims to describe the extent to which legal pluralism can run along with the times towards the recognition of customary land of indigenous peoples used as a means of national development. In formal legality, customary land rights of indigenous peoples have a place in national land law, but at the level of law in action they still lack legal protection. Without the availability of adequate land, planned development programs cannot run and ongoing development projects will be stalled. The government must participate in protecting the customary land rights of indigenous peoples who have long occupied their territory. This study uses a qualitative legal study method with a literature study research type. The approach used is customary law pluralism using documentation data collection techniques. The result of this study is that the existence of legal pluralism on customary land makes the law apply side by side for areas where there are customary rights. As for areas where there is no customary right, national agrarian law applies

Abstract

The purpose of this study is to further examine the adoption of mediation as an alternative non-litigation dispute resolution in the realm of conflict resolution or customary law disputes in Bali. This study uses a normative legal research method with a statutory and comparative approach. From the results of the studies conducted, it can be seen that there is an adoption of mediation as an alternative means of dispute resolution in the realm of customary law conflict resolution in Bali which is based on Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution outside the Court (Non-Litigation), besides that it is also based on the Regulation of the Supreme Court No. 2 of 2016 concerning Mediation Procedure in Court which is an amendment to PERMA No. 1 of 2008. In the realm of customary law, there are often conflicts or disputes involving indigenous peoples such as conflicts regarding the issue of fatherhood in traditional villages, village membership, regarding the seizure of village land, and separation from membership of the traditional banjar and of course there are still many problems that occur in the community. The scope of the customary law community, which if resolved through the courts (litigation) will certainly take a lot of time and cost a lot of money. Therefore, it is necessary to adopt mediation as an alternative dispute resolution into a pattern of conflict resolution involving customary law communities regarding customary disputes in the customary village area which will certainly be more efficient, cost-effective and does not take a long time.

Abstract

This research aims to analyze the role of investment law in public infrastructure development with a focus on equitable development in the regions, especially in the education sector in North Aceh. Equitable infrastructure development is one of the main goals of national development policy, but in reality in several regions, such as North Aceh, there is inequality in access to adequate educational infrastructure. This study seeks to explore the extent to which investment legal regulations can play a role in encouraging equitable development, and why, in the case of educational infrastructure development in North Aceh, this has not been achieved. Using a normative juridical approach and empirical studies, this research examines several aspects, including regulations related to investment, the legal framework governing infrastructure development, as well as the influence of the delegation of authority from the central government to regional governments, including in the local economic sector, on the implementation of development policies. This study also highlights the important role of government, both central and regional, in ensuring that investment policies and infrastructure development are carried out in a transparent and accountable manner. Strengthening regulations and increasing supervision are needed to ensure that development can proceed evenly, without intervention from interested parties.
