STAATSRECHT: Indonesian Constitutional Law Journal (ISSN: 2549-0915) is a national journal published by Center for the Study of Constitution and National Legislation (POSKO-LEGNAS) UIN Jakarta, INDONESIA. The focus is to provide readers with a better understanding of Constitutional Law and present developments through the publication of articles, research reports, and book reviews. STAATSRECH specializes in Constitutional Law and is intended to communicate original researches and current issues on the subject. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The Review basically contains any topics concerning constitutional law. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as privacy laws and public laws which include constitutional to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law. Abstract

The upcoming General Elections and Regional Head Elections, which will be held in 2024, will reap probelmatics. One of them is about the appointment of acting regional heads which is considered contrary to democratic aspects, because there is no community involvement or inaccessibility to the mechanism for appointing acting regional heads. On the one hand, the Government does not heed the Decision of the Constitutional Court to issue implementing regulations as a follow-up to Article 201 of Law Number 10 of 2016 concerning Regional Elections. In fact, it is clear that the Constitutional Court is the guardion of constitution as well as the guardion of democracy. This is what makes the author want to do more research to answer the above problems. To answer this, the author uses a normative research method, namely by researching library materials or secondary data as basic materials for research. The approach used is a conceptual and statute approach.

Abstract

Pemilihan Umum Kepala Daerah diselenggarakan secara serentak di tahun 2024. Pelaksanaan pilkada yang diselenggarakan secara serentak menyebabkan jabatan kepala daerah di beberapa daerah di Indonesia mengalami kekosongan untuk periode tahun 2022 dan tahun 2003. Untuk mengisi kekosongan tersebut, berdasarkan Pasal 22 E UUD NRI Tahnun 1945 Presiden sebagai penyelenggara pemerintahan tertiggi bertanggung jawab untuk memastikan penyelenggaraan pemerintahan di daerah tetap berjalan. Oleh karena itu, Presiden melimpahkan kewenangannya pada Kementerian Dalam Negeri untuk bertanggung jawab atas pengisian penjabat kepala daerah tersebut. Namun mekanisme pengisian kekosongan jabatan kepala daerah masih dinilai gamang, karena belum ada payung hukum yang jelas mengatur pengisian kekosongan jabatan tersebut, yang merupakan aturan delegatif dari UU Noor 10 Tahun 2016 tentang Pilkada. Padahal Putusan MK Putusan No 67 / PUU- XIX/2021 mengamanatkan pada pemerintah untuk segera mengeluarkan aturan terkait mekanisme pengisian penjabat kepala daerah. Proses pengisian jabatan juga dinilai menegasikan asas demokrasi karena tidak melibatkan masyarakat sebagai pemegang kedaulatan tertinggi melalui proses pemilu. Komitmen pemerintah terhadap penyelenggaraan proses pengisian penjabat kepala daerah harus ditunjukkan melalui mekanisme yang transparan dan akuntabel. Sehingga dapat memastikan bahwa proses pengisian penjabat kepala daerah bersifat netral dan tidak syarat akan kepentingan politik demi meminimalisir proses-proses yang bertentangan dengan asas demokrasi dan kedaulatan rakyat.

Abstract

Regardless of the size of a city, children living on the streets, the homeless, and begging have become typical aspects of city life. This issue appears to necessitate particular attention. The problems of unmanaged homelessness, street kids, and begging are also present in Tangerang. The purpose of this study was to determine the extent to which the fiqh siyasah has evaluated regional rule 5 of 2012 in Tangerang City. This inquiry utilizes library searches with a policy-centric focus. This study discovered that Law No. 11 of 2009 concerning Social Health and Law No. 13 of 2012 concerning Handling the Poor are used to implement the Tangerang City Regulation, which promotes the right to education, shelter, and work for street children, homeless persons, beggars, and buskers. Numerous aspects of Tangerang City Regulation Number 5 of 2012 are consistent with siyasa fiqh, including the obligation to protect all people regardless of race or religion, the protection of oneself, one's property, and one's family, and the emphasis on equality of rights and equality before the law. In accordance with the Siyasah fiqh principles espoused by Abdul Khalaf Wahhab and Abu A'la al-Maududi, Regional Regulation No. 5 of 2012 also seeks to preserve the human rights of each community, social justice, and legal protection for all.

Abstract

The existence and role of state civil apparatus in the field of public services has a strategic position if without the role of state civil apparatus,the state's obligation to serve its citizens will not be carried out. The problems faced in the implementation of public services include the organizational management system that has not been maximized, the occurrence of disciplinary violations committed by state civil apparatus, poor performance, poor quality of public services provided, a lot of overlapping state civil apparatus, not maximally provided by the state, and Often there is the implementation of tasks that are not in accordance with their duties and responsibilities. At this time, the election of regional heads is a source of problems for mutations on a large scale, usually the elected regional heads make changes in the form of changing and decreasing positions to changing the workplace of an state civil apparatus. Then how is the governance of the state civil apparatus centralized and how is the merit system in managing the state civil apparatus. The research method used in this study uses qualitative methods, namely a research method by means of interviews, observation, documentation in collecting data, then on the data that has been found a data analysis will be carried out. According to the Indonesia State Civil Apparatus Act Law, the state civil apparatus recruitment system in Indonesia is inappropriate for regional head officials to transfer state civil apparatus for political reasons, based on proximity and others. If the regional head transfers his state civil apparatus without paying attention to the regulatory aspects, then a regional head has violated the law. The implementation of state civil apparatus governance in Indonesia is currently regulated by many rules, so that the legal rules for state civil apparatus governance support strongly. However, in terms of substance there are still many problems. There are so many rules that are not considered by regional head officials in transferring or promoting state civil apparatus.

Abstract

Pancasila education can have a significant impact on reducing corruption in Indonesia, especially among university students. This is because Pancasila, Indonesia's state ideology, promotes the development of an honest and transparent government. The purpose of the study of how much Pancasila education can help reduce the culture of corruption in Indonesia is to find out how much Pancasila education can help reduce the culture of corruption in Indonesia. The research method used is a qualitative research method with a literature approach and a statutory approach. Research data shows that Pancasila Education is a big reason why the culture of corruption in Indonesia is getting better. Students can get to know and understand the values of Pancasila which encourage anti-corruption attitudes and actions, by studying Pancasila educational resources. In order to continue to fight for the importance of Pancasila education and eliminate the culture of corruption in Indonesia, strong support from the government, educational institutions, society and society is needed.

Abstract

The delay in development is the same as the delay in efforts to realize prosperity for the people of Indonesia. Indonesia Corruption Watch (ICW) noted that state financial losses arising from corruption cases throughout 2021 reached Rp 62.9 trillion. This amount exceeded the previous year with a total loss of Rp 56.7 trillion. Pungki Harmoko, revealed in his application for judicial review in 2015, the facts of losses to the state and society due to corruption, that: (1) Corruption is increasingly prevalent; (2) There is a desire from the people represented by Nahdlatul Ulama and Muhammadiyah so that corruptors get the death penalty. However, the Constitutional Court decided that the Petitioner did not have the legal standing to file the a quo petition. The researcher tries to explore the legal standing and qualifications of the applicant in the Judicial Review and is reviewed in the fiqh siyasah. After researching that the legal standing and qualifications of the applicant in the Judicial Review of the decision of the Constitutional Court Number 112/PUU-XIII/2015, are in accordance with the Constitutional Court Law. Thus Pungki Harmoko does not have legal standing as an applicant. Likewise with the Legal Standing and Qualifications of the Petitioners in the Judicial Review from the Fiqh Siyasah Perspective. In the review of the decision of the Constitutional Court Number 112/PUU-XIII/2015, it has also been in accordance with what is argued in the Constitutional Court Law.Kata Kunci: Judicial Review,Legal Standing, Kualifikasi Pemohon AbstrakTerhambatnya pembangunan sama dengan terhambatnya usaha mewujudkan kesejahteraan bagi rakyat Indonesia. Indonesia Corruption Watch (ICW) mencatat kerugian keuangan negara yang timbul akibat kasus korupsi sepanjang 2021 mencapai Rp 62,9 triliun. Jumlah tersebut melampaui tahun sebelumnya dengan jumlah kerugian sebesar Rp 56,7 triliun. Pungki Harmoko, mengungkapkan dalam permohonan uji materinya pada tahun 2015, fakta-fakta kerugian negara dan masyarakat akibat korupsi, bahwa: (1) Korupsi yang semakin menggurita; (2) Adanya keinginan dari rakyat yang terwakili oleh Nahdlatul Ulama dan Muhammadiyah agar para koruptor mendapat hukuman mati. Namun Mahkamah Konstitusi memutuskan Pemohon tidak memiliki kedudukan hukum (legal standing) untuk mengajukan permohonan a quo. Peneliti mencoba menggali legal standing dan kualifikasi pemohon dalam Judicial Review dan ditinjau dalam fiqh siyasah. Setelah diteliti bahwa Legal standing dan kualifikasi pemohon dalam Judicial Review putusan Mahkamah Konstitusi Nomor 112/PUU-XIII/2015, telah sesuai dengan UU MK. Dengan demikian Pungki Harmoko tidak memiliki legal standing sebagai pemohon. Begitu juga dengan Legal Standing Dan Kualifikasi Pemohon Dalam Judicial Review Perspektif Fiqh Siyasah. Dalam Review putusan Mahkamah Konstitusi Nomor 112/PUU-XIII/2015, juga telah sesuai dengan yang didalilkan dalam UU MK.Keywords: Judicial Review, Legal Standing, Applicant Qualifications
