Abstract

This study examines the criminal liability of fiber optic operators for intentional and negligent acts that harm the public. The main focus is on how positive law and the harmonization of the criminal justice system regulate this responsibility. This research uses a legislative, case, and comparative approach within the framework of normative legal methods. All legal materials (primary, secondary, and tertiary) are analyzed qualitatively to answer the legal issues raised. In addition to providing compensation. The research findings reinforce the existence of negligence by the fiber optic network operator as a corporate entity, whether committed intentionally (dolus) or due to structural negligence (culpa), resulting in legal liability for damage to public facilities in the form of dysfunction of public infrastructure. Business actors sometimes benefit from the crimes they commit, so it is considered unfair to impose criminal sanctions on operators. As the regulator of regional development, local governments also bear responsibility for every policy issued. On the other hand, the restorative justice approach through criminal mediation remains relevant to be integrated into various models of law enforcement. This requires comprehensive harmonization in the criminal justice system—substantively, structurally, and culturally—to be in line with the values ​​of justice in positive law.

Abstract

This study aims to analyze the indicators of Sekolah Ramah Anak (SRA)/Child-Friendly Schools (CFS) in primary education and examine their implications for gender equality content. The study is grounded in the observation that the SRA framework generally emphasizes safety, protection, participation, health, and inclusiveness, yet has not adequately integrated gender as an explicit analytical dimension. In fact, the primary school environment constitutes an important space for shaping children’s social experiences, including gender relations, participation, self-expression, and access to equitable learning spaces. This study employed a qualitative approach using a systematic literature review design. Data were collected through a review of academic databases and relevant policy documents, and were analyzed using thematic analysis combined with a critical gender lens. The findings indicate that the dominant SRA indicators include safe and protective environments, anti-discriminatory practices, child participation, health and well-being, and inclusive education. However, most of these indicators are still formulated in neutral terms and remain insufficiently sensitive to capture gender-based inequalities in children’s school experiences. Further analysis reveals that gender bias may manifest in teaching practices, classroom participation patterns, the use of school facilities, and social relations that shape children’s experiences differently. Therefore, this study recommends the reconstruction of SRA indicators to make them more explicit, contextual, and transformative by positioning gender equality as a cross-cutting principle embedded in school policy, governance, infrastructure, participation, and pedagogical practices in primary education. These findings affirm that a truly child-friendly school is not only administratively safe, but also experientially just for all children.

Abstract

This study aims to examine and understand the legal principles applied by the judge in the annulment of a Deed of Sale and Purchase executed by a Land Deed Officer (PPAT) in Judgment No. 80/Pdt.G/2020/PN.Btl. The type of research used in this study is normative legal research, which involves examining legal materials derived from various laws and regulations as well as other materials from the literature. This legal writing employs both the statutory approach and the conceptual approach. The legal materials used in this normative legal study consist of primary and secondary legal sources. The method of collecting legal materials involves a literature review, which is conducted by reading and citing books, as well as analyzing laws and regulations, documents, and information relevant to the research being conducted. The research analysis was conducted using descriptive analysis. Research findings indicate that judges who tend to apply the theory of responsive law do not merely focus on the formal validity of authentic documents (legal positivism), but actively respond to the public’s sense of justice and the social realities surrounding the case. The ruling invalidating the deed took effect when the judge prioritized substantive justice and granted legal protection to the plaintiffs as parties acting in good faith.

Abstract

This study analyzes the role of BRICS as a geopolitical security instrument within Russia's broader strategy to expand its influence across Africa amid the ongoing structural transformation of the international order toward multipolarity. Originally established as an economic cooperation forum among developing nations, BRICS has since evolved into a political and strategic platform that functions as an alternative to Western-dominated global institutions. This transformation has become increasingly pronounced in the context of escalating geopolitical tensions between Russia and Western states, particularly in the aftermath of the Ukraine conflict. Employing a descriptive qualitative approach, this study conducts content analysis of policy documents, official statements by Russian officials, international media reports, and communiqués from BRICS summits and the Russia–Africa Summits of 2019 and 2023. The analytical framework draws on the theories of strategic depth and multipolar institutionalism to examine how Russia leverages non-Western multilateral platforms to build cross-regional strategic depth. The findings reveal that Russia has systematically utilized BRICS as an alternative diplomatic channel to consolidate military cooperation, advance energy investment expansion, and construct anti-hegemonic narratives rooted in South–South solidarity across Africa. Through BRICS, Russia positions itself as a strategic partner that upholds the principles of equality, sovereignty, and non-intervention which stands in deliberate contrast to the hierarchical patterns characteristic of Africa–West relations. This article contributes to the international relations literature by broadening the understanding of the role of multipolar institutions in the security strategies of non-Western states, and by demonstrating how BRICS functions as a geopolitical instrument that reconfigures global power dynamics and South–South relations within the context of an emerging multipolar world order.
