Abstract

Penerapan prinsip negara hukum di Indonesia memberikan konsekuensi lahirnya pengadilan tata usaha negara. Pengadilan tata usaha negara sebagai pranata hukum adalah wujud pelaksanaan prinsip saling mengimbangi dan saling mengawasi agar pemerintah tidak melakukan tindakan yang sewenang-wenang. Sebagai lembaga peradilan yang dihormati maka seharusnya putusan pengadilan tata usaha negara wajib dihormati dan dilaksanakan oleh masing-masing pihak. Namun dalam praktiknya terjadi ketidakpatuhan yang dilakukan oleh badan/pejabat tata usaha negara. Mereka menentang untuk melaksanakan putusan pengadilan tata usaha negara meskipun telah memiliki kekuatan hukum tetap dan mengikat. Oleh karena itu, tulisan ini membahas secara komprehensif mengenai penyebab ketidakpatuhan yang dilakukan oleh badan atau pejabat tata usaha negara. Berikutnya juga membahas mengenai implikasi hukum yang terjadi apabila badan/pejabat tata usaha negara tetap mengabaikan putusan pengadilan tersebut menurut peraturan perundang-undangan yang berlaku. Lebih lanjut tulisan ini mengulas mengenai hubungan pemerintah pusat dan pemerintah daerah dalam kerangka otonomi daerah dikaitkan dengan ketidakpatuhan yang terjadi. Diketahui bahwa Presiden sebagai kepala pemerintahan memegang kekuasaan penuh untuk menjalankan pemerintahan dan memastikan seluruh kebijakannya dilaksanakan oleh pemerintah daerah terlebih lagi dalam konsep negara kesatuan.

Abstract

Electronic Court (E-court) was arranged by the Supreme Court prior to the Covid-19 pandemic with the issuance of Supreme Court Regulation (hereby refered as “Perma”) No. 3 of 2018 and restrictions with Perma No. 1 of 2019. The application of Electronic Court (E-court) greatly helps the realization of the Vision of the Supreme Court to become a Supreme Indonesian Judiciary Body, which in point 10 is the realization of the Vision of the Supreme Court in the Blueprint is to create a Modern Judiciary Body based on integrated information technology. In the New Normal Era, conventional trials must switch to online trials to prevent Covid-19 based on SEMA No. 1 of 2020. In addition to the many benefits obtained from the implementation of electronic court (e-court), especially during The New Normal Era, there are several obstacle of conducting electronic hearings, such as Electronic proceedings have not yet been regulated in the procedural law because they have only been regulated in a Supreme Court Regulation. Limited facilities and infrastructure, lack of human resources and the trial that was felt to be closed because it was only attended by online parties were also obstacles in electronic litigation.

Abstract

The promulgation of Law Number 11 Year 2020 Regarding Job Creation Bill by the Indonesian Government that uses the omnibus law model has caused polemics both theoretically and pragmatically. The omnibus law model breaks through the paradigm of law-making that has been known in Indonesia for of its unusual method of regulating many themes in one single bill. In terms of substance, especially in this paper concerning administrative law, many concepts are mixed up so that many things which in theory stray far from the science of State administrative law adopted in Indonesia. Among those that will be discussed in this paper are four problems namely 1.) The constitutionality of omnibus law method in the Law No. 11 of 2020 regarding Job Creation, 2.) The concept of governmental authority in the context of regional and central government relations, 3.) The Tacit Authorization concept, and 4.) The concept of licensing in the broader sense. This paper uses the literature study method, in which the writer observes the problems based on related literatures and regulations. The conclusion that can be drawn in this paper is that this law which regulates those four problems is still had a lot of mistakes and needs to be reviewed by the legislators or by President of the Republic of Indonesia.

Abstract

The development of personnel law regarding litigation has experienced tremendous development, but some of the latest literature in the field of personnel law is still referring to the mechanism of litigation that is already irrelevant. As is known now after the enactment of the Supreme Court Regulation (Perma) No. 6 of 2018 concerning Government Administration Dispute Resolution Guidelines After Taking Administrative Review, the principle applies so long as it is not determined otherwise by certain sectoral regulations (lex specialis), submitting a claim to the State Administrative Court (PTUN) must first take administrative efforts internally or quasi-judicial institution (lex generalis). As the initial intention of the State Civil Apparatus Act (UU Aparatur Sipil Negara), now the resolution of personnel disputes must be preceded by internal administrative review before being submitted to the State Administrative Court.

Abstract

This research is trying to explain two legal issues in relation to the submission of electronic evidence in e- Litigation evidence system, those are about the urgency of electronic evidence validation in proving a case and how the ideal mechanism of electronic evidence validation at the e-Litigation proof stage is. The discourse of the trial by fully using E-Court which includes the proof stage in it has not yet been implemented due to various obstacles, including regulations, availability of supporting facilities and Human Resources (HR). It is important to study this legal issue in order to optimize E-Court so that judicial modernization with information technology approach can be quicklyimplemented, solely to realize the vision of the Supreme Court and ensure better access to justice in the future. The results of this research conclude that the electronic evidence validation process in E- Litigation is a vital stage that cannot be ruled out in order to determine the validity of an electronic evidence and how important digital forensic procedures in the electronic evidence validation process.
