Abstract

This article is the result of a qualitative field research with a legal sociology approach. This article discusses the tradition of intermarrying with the eyes of Islamic law and positive law. The researcher uses the maqasid shariah theory in explaining the legal position of capture marriage. The maqasid shariah theory has a flexible and adaptive character in determining the legal status of localistic matters. The location of this research is in Pekalongan village, Sampang district, Madura. This study concludes that marriage arrests in the village of Pekalongan are legal, even obligatory, seeing that the implementation of the marriage arrest law cannot be separated from the main purpose of implementing Islamic laws. Capture marriage fulfills the maqashid al-sharī'ah element. Capture marriages function as hifd al din, namely tradition as religious social control, as a social protection system that fulfills the elements of hifdh an-nafs (avoiding cases of violence and vigilantism), hifdh an-nasl (avoiding offspring from illicit relationships), hifdh al-mal (avoiding the use of money in vain), hifdh al-aql (maintaining a healthy mindset and avoiding depression). Capture marriages are marriages that have no legal force because they are not registered.. Abstract

This article is the result of a qualitative field research. This article discusses a series of Sundanese traditional marriages from the perspective of Islamic law. The research location is in Caringin Village, Tegal Panjang Village, Sucinarja District, Garut Regency. This study concludes that the series of Sundanese traditional wedding ceremonies are not in conflict with fiqh law. The series consists of a) pre-marriage stage; b) stage of the marriage contract; and c) post-marriage contract stage. The three sets of Sundanese marriage traditions are in harmony with the law of fiqh. This argument is built by analyzing the three series with the jurisprudence of the four schools of thought, istihsan bi maqasid al-shariah, isthsan bi al'urf, and the text of the argument. Abstract

This article is the result of a qualitative field research. The research location is at the At-Tahdzib Islamic Boarding School Rejoagung Ngoro Jombang. The direction of the discussion in this article is how to place the marriage tradition following the Kyai within the framework of maqasid marriage and maqasid shariah. The researcher uses maqasid al-nikah and maqasid shariah theory in explaining the position of the marriage tradition following the Kyai, because the maqasid al-nikah and maqasid shariah theories. The researcher argues that the marriage tradition following the Kyai provides advocacy for the protection of the bride and groom in achieving the goals of marriage and the goals of the Shari'a that arise from marriage Keywords: marriage is obedient to the kyai, maqasid shariah. Abstract

This article is result of library research with a normative legal approach. Legal materials and data were obtained from Islamic legal norms regarding inheritance and khuntsa obtained from the texts of the Qur'an and Hadith, as well as the opinions of the jurists. This thesis discusses the distribution of khuntsa inheritance based on the opinion of Imam Ali As-Shobuni and Imam Abu Hanifah. People who do not have a clear gender status, not male and not female, are called khuntsa in Islamic law. One of the problems of khuntsa is in determining the right of inheritance. The Qur'an does not clearly state the portion of khuntha inheritance. This study concludes that in the unclear gender of khuntsa, it can be determined by two things, namely first, signs of maturity and second, where does urine come from. This argument is put forward using the istidlal theory used by Imam Ali As-Shobuni and Imam Abu Hanifah. Abstract

This article is a result of a qualitative field research. This article discusses efforts to form a sakinah family. The research location is Jombang Regency. The data of this research are alumni of Madrasatul Qur'an Islamic boarding school Tebuireng Jombang who are domiciled in Jombang Regency. This study concludes that marriage counseling to maintain household harmony, one of which can be done independently through istiqamahan interacting with the Qur'an. This argument is based on data from the family of alumni who have memorized the Koran PP. Madrasataul Qur'an Tebuireng in Diwek district, Jombang. The alumni practice the routine of memorizing the Qur'an, always remembering Allah (taqarrub), tadarus Al-Qur`an every day, praying in congregation, being open between family members. The alumni carry out several family functions, namely educational, religious, protective, economic, and recreational functions. Keywords: marriage counseling, happy family, pesantren alumni.
