The Digest: Journal of Jurisprudence and Legisprudence (The Digest) is a double blind peer reviewed journal published by Faculty of Law, Universitas Negeri Semarang (UNNES), Indonesia. The Journal published bi-annual every June and Desember The Digest is intended to be a scientific and research journal for academics, legal scholars, and legal practitioners with focuses on analysis of Court Decision and legal studies. The Journal publishes contemporary articles on law and case analysis, and the Journal published within Bahasa and English both print and online version. Abstract

Layanan pinjaman online yang berbasis fintech merupakan salah satu produk hasil perkembangan teknologi dan informasi di era revolusi industri 4.0. Namun, justru marak ditemukan penyelenggaraan pinjaman online ilegal yang merugikan masyarakat dengan penyalahgunaan data pribadi konsumen. Kurangnya edukasi masyarakat oknum-oknum pinjaman online ilegal memanfaatkannya untuk melakukan kejahatannya. Dalam hal ini Otoritas Jasa Keuangan (OJK) sebagai lembaga pengatur dan pengawas sektor jasa keuangan mengeluarkan Peraturan Otoritas Jasa Keuangan (POJK) No. 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi sebagai upaya pencegahan dan penanganan kasus pinjaman online ilegal yang meresahkan masyarakat. Pada pelaksanaannya POJK tersebut mengalami kendala dimana belum adanya undang-undang yang secara khusus mengatur mengenai perlindungan data pribadi, sehingga POJK tersebut dipandang masih lemah. Dengan demikian, pengaturan perlindungan data pribadi diyakini perlu segera dibentuk dan dilaksanakan pada saat ini. Kata Kunci: Pinjaman online, OJK, Data Pribadi

Abstract

Ketentuan syarat pailit pada Pasal 8 ayat 4 yang tertera dalam Undang-Undang Kepailitan, memuat unsur melalui fakta atau keadaan sederhana menimbulkan permasalahan dalam implementasinya terhadap kelangsungan perekonomian negara. Ketiadaan indikator perhitungan matematis nilai ekonomi terhadap suatu debitor selaku perusahaan publik senyata-nyatanya memiliki implikasi kerugian terhadap kelangsungan perekonomian negara. PT. Cowel Development merupakan salah satu perusahaan publik yang turut terkena imbas dari permasalahan pasal ini. Perusahaan dengan nilai aset mencapai 3 Triliun lebih ini dipaksa dijatuhkan pailit sebagaimana dalam Putusan Nomor 21/Pdt.Sus-Pailit/2020/PN.Niaga.Jkt.Pst. sehingga dalam kerangka mendukung perekonomian melalui sumbangsih perusahaan-perusahaan besar terhadap negara, perlu diberikan perlindungan hukum yang lebih baik kedepannya yang kemudian diakomodir dalam Undang-Undang Kepailitan. Permasalahan dalam putusan tersebut dilakukan penelitian dengan menggunakan yuridis normatif atau hukum doktrinal.

Abstract

The allocation of post-divorce financial support to the ex-wife presents an intriguing topic, exemplified in the Tangerang District Court Decision Number: 927/Pdt.G/2017/PN.Tng, a case involving civil disputes arising from a divorce. The court ruled that the Reconviction Defendant/Convention Plaintiff must provide a monthly allowance of Rp. 17,500,000,- (seventeen million five hundred thousand rupiah) to the Reconviction Plaintiff/Convention Defendant until the latter remarries. Employing normative research methods with a normative juridical approach, the author observes that the judge, while referencing Article 41 of Law No.1 of 1974, failed to provide any legal reasoning in the judgment. This lack of legal reasoning suggests the panel lacked a sound legal basis, undermining the application of Article 41(c) of Law No.1 of 1974 regarding Marriage, which is non-imperative. Therefore, the importance of prudence, justice, and a robust legal foundation in rendering decisions is highlighted to prevent the issuance of frivolous or ambiguous judgments that could complicate the execution of court decisions.

Abstract

Iming-imingi upah yang besar menjadi pekerja migran diluar neeri juga dibayangi-bayangi akan resiko yang juga sama besarnya. Jumlah perpindahan pekerja dari tanah air ke negeri asing semakin lama semakin meningkat . Resiko yang besar dan minat yang tinggi menyebabkan buruh migran sebagai pihak yang rentan terenggut haknya olehkarena itu perlu dilindungi oleh negara. Penelitian ini berusaha mengkaji mengenai penerapan pola sanksi yang didapat oleh perusahaan penyedia jasa tenaga kerja sebagai buruh migran dan perlindungan bagi buruh migran Indonesia. Penelitian dilakukan dengan menggunakan pendekatan yuridis empiris dimana realita yang terjadi dilapangan dikaji dan dikomparasi dengan ketentuan hukum yang berlaku. Tujuan untuk mengetahui seperti apa perlindungan hukum bagi pekerja migran dan sanksi bagi Penyedia Jasa Tenaga Kerja Indonesia

Abstract

State-Owned Enterprises as a government tool in seeking profit in running their business in managing funds from capital receipts from the government have a great potential for corrupt practices. Therefore, PT Waskita Karya in suppressing and taking preventive steps for corruption by implementing preventive efforts in preventing at Waskita Karya Group with a Situational Prevention Crime approach that focuses on internal and external supervision and narrows space in areas prone to corruption. Then improve the quality of human resources with integrity and quality. In addition to a preventive approach, a repressive approach by taking an approach that focuses on asset recovery due to losses from corruption through one of the civil law instruments, civil forfeiture as regulated in the Anti-Corruption Law.

Abstract

The young generation of a child has the right to the opportunity to grow and develop as widely as possible. However, not all children can make it happen, especially children who are hampered by the family economy. To be the backbone of the family, the phenomenon of underage child labor is a serious problem. In the elucidation of the Labor and Child Protection Law itself, there is protection and sanctions against child workers. Apart from the rules issued by the government, it has also ratified international conventions in enforcing the legal protection of children. In research using library material collection, the authors examine the legal protection of child labour. Continuing in this phenomenon, studies are related to the various causes of the rise of child labor in society. Seeing from this phenomenon, it can be found that the government itself has not been able to optimize its efforts to deal with the problems that occur.

Abstract

Along with the times, it has implications for the development of a crime. Rape is one of the taboo criminal acts in society, if in the past rape was generally carried out by adults in this era, it is possible that children can become perpetrators and become victims of rape. Children are the image of the nation in the future who carry noble values ​​and ideals of the nation. The need for massive and sustainable legal and non-juridical protection of children is the obligation of all parties. The crime of rape committed by children against children is a special case where the handling is certainly not the same as handling other cases in general. Seeing further that the perpetrators and victims are still minors, there will be many conflicts between the sociological rules and the juridical aspects in general, the role of institutions and law enforcement officers is needed for the creation of justice. In solving the problem of rape committed by children with child victims, then there are two interests and two rights of children that are confronted with each other, both of which still have a long future ahead so that in handling it must receive special attention, even though this cannot be immediately eliminate the crime that has been committed by the child. Ordinary people will think that rape is a taboo subject, because of this mindset, the victim will tend to be cornered and just remain silent without getting justice. Victims of sexual violence/rape have the right to obtain legal assistance and obtain justice for the rights of victims who have been violated. Then how important is legal aid for victims of child rape crimes committed by children.

Abstract

The obligation to provide free legal aid by advocates has been stipulated in Article 22 of Law Number 18 Year 2003 regarding Advocate. As a respectful profession (officium nobile), advocate has duty and responsibility to embody rule of law principle. Pro bono legal service is a duty of every advocate as mandated by Advocate Law. This research uses normative approach and is descriptive analysis in manner. The researchers uses library research to process the data. This research aims to analyse the implementation of pro bono legal service by advocates and bar association in Indonesia. Despite of bar association, in this regard Perhimpunan Advokat Indonesia (PERADI) has established a special work unit to implement the function of pro bono legal service, Pusat Bantuan Hukum in the regions in Indonesia, However, in practice, the interest of lawyers to carry out this obligation and their reporting is still minimal. This study intends to determine the cause of the lack of interest in lawyers in provide free legal assistance.

Abstract

Diversity and Justice stand as norms within Indonesia's Criminal Justice System, as outlined in Law Number 11 of 2012 pertaining to the Juvenile Justice System. This legislation, inseparable from the UN Resolution concerning the Convention on Rights, ratified by the Government on January 26, 1990 through Presidential Decree Number 36 of 1990, finds its foundation in the Convention on the Rights of the Child. This study delves into the evolution of crimes against children in Indonesia. Firstly, it scrutinizes the imperative of safeguarding children in familial, educational, and broader societal contexts against violence and crime. Secondly, it assesses the effectiveness of the criminal justice system in providing protection for children as victims of violence and crime. Thirdly, it explores the state's responsibility in imposing sanctions through the criminal justice system. Employing a juridical-normative approach, this research relies on the collection of secondary data related to laws and regulations, drawing from materials in books, journals, and relevant sources. Observations reveal a distressing prevalence of children falling victim to violence, spanning beyond the confines of their homes to schools. Such violence encompasses not only physical harm but also psychological trauma. The onus of protecting, nurturing, and fostering the development of children lies with their environment, families, and schools. The efficacy of the juvenile justice system in combating crimes against children's rights hinges significantly on the functional application of criminal law.

Abstract

This paper examines the application and impact of the Miranda Rule in the Indonesian legal system, particularly concerning impoverished defendants, within the framework of Law No. 16 of 2011. Originating from investigator negligence during the interrogation of an Arizona citizen, the Miranda Rule has evolved into a crucial legal principle safeguarding the rights of suspects as citizens, with constitutional implications. The study investigates the incorporation of Miranda principles into Indonesian legislation, focusing on its relevance to providing legal aid for impoverished individuals accused of criminal acts. The research traces the historical trajectory of the Miranda Rule, emphasizing its transformative role in shaping legal norms and protecting individual rights. It analyzes the specific provisions within Law No. 16 of 2011 that address the needs of impoverished defendants and explores the practical implications of these provisions in real-world legal scenarios. Furthermore, the paper sheds light on the broader consequences of the Miranda Rule, examining its influence on derivative regulations that redefine the legal status of individuals within the Indonesian legal framework. The advocacy for impoverished defendants is a central theme, emphasizing the rule's role in ensuring justice and welfare for all citizens. Through a comprehensive analysis of legal texts, case studies, and practical implications, this paper contributes to the understanding of how the Miranda Rule, as enshrined in Law No. 16 of 2011, intersects with the rights and well-being of impoverished defendants within the Indonesian criminal justice system.
