Abstract

Marriage is a form of the union of two human beings united by a strong bond, the purpose of uniting the two male and female humans in the form of a household is to realize a sakinah family, mawaddah wa rahmah or a peaceful and loving family. One way to achieve the purpose of marriage is to make a marriage agreement between the two parties before entering into a marriage contract. In this study, it uses normative-empirical juridical research by basically combining a normative legal approach with the addition of various empirical elements using the method of approach to the law approach method. This type of research is library research which is descriptive analytical. And the results of this study explain the law of the ability of marriage agreements in Islam but must be in accordance with the provisions of the Islamic shari'a, and in the Marriage Agreement Law it is regulated in several regulations including those listed in Presidential Instruction No. 1 of 2974 and article 47 of the Compilation of Islamic Law and also contained in the Civil Code part 1 Article 139-147 and so on

Abstract

The age limit for marriage is one of the things that determines the maturity or marriage maturity, so that those who want to get married can distinguish between good and bad. Renewal of Islamic law in Indonesia in terms of the age limit for marriage which was previously stated in article 7 of law no. 1 of 1974 concerning marriage stipulates that the maximum age of marriage for men is 19 years and 16 years for women. After the reform of the law, the maximum age for marriage is 19 years for both men and women. In addition, in the country of Brunei Darussalam there are 3 regulations that discuss the age limit for marriage, including the Chinese marriage law explaining the age limit for marriage, which is 15 years, the Christian marriage law explaining the marriage age limit is 14 years for men and women, and the law Islamic family law stipulates that the age limit for marriage is 18 years for men and 16 years for women. The age limit for marriage according to the scholars of the school of thought has several differences of opinion. Scholars of the Shafi'i and Hanbali schools are of the opinion that the ideal age of puberty in marriage is 15 years, while Abu Hanifah believes that the age of maturity comes at the age of 18 for men and 17 years for women, while Imam Malik believes that the limit for marriage is 17 or 18 years. Abstract

Perkembangan teknologi yang semakin canggih sangat memudahkan bagi setiap orang dalam melakukan transaksi secara online. Khususnya dalam hal perekonomian. Transaksi yang terjadi secara online pada saat ini tidaklah hanya seputar jual beli. Selain itu, transaksi hutang-piutang juga dapat dilakukan secara online dengan menggunakan aplikasi berupa pinjaman online. Dalam transaksi hutang-piutang yang dilakukan secara online juga harus memenuhi beberapa syarat sebagaimana mestinya. Transaksi hutang-piutang berbasis online tentunya juga diatur dalam islam. Banyak permasalahan yang terjadi ketika melakukan transaksi hutang-piutang secara online, baik keuntungan dan juga kerugian dari nasabah ataupun perusahaan yang memberikan pinjaman. Maka dari itu dalam bertransaksi secara online harus sesuai dengan aturan yang ada di dalam islam. Agar tidak ada pihak yang merasa dirugikan. Dalam penulisan artikel ini, penulis menggunakan metode Library Research (kajian pustaka). Yang mana, penulis menggunakan buku, jurnal, hadits, dan juga al-qur’an yang menjadi sumber data dalam penulisan artikel ini. Kesimpulan dari penulisan artikel ini adalah menjelaskan tentang transaksi hutang-piutang berbasis online di aplikasi pinjam yuk menurut pandangan islam. Dalam hal ini, islam tidak membolehkan adanya transaksi hutang-piutang berbasis online di aplikasi pinjam yuk. Dikarenakan, transaksi hutang-piutang di aplikasi pinjamyuk tidak sesuai dengan hukum islam karena mengandung riba. Dan dalam islam, riba sangat diharamkan.
