Abstract

This study aims to analyze the transparency of local governance, as well as to analyze the accountability of local governance. This research is a normative study, using a statutory approach, a conceptual approach, and a historical approach, the data used are primary and secondary legal materials, all data collected were analyzed qualitatively. The results show that in order to achieve the goal of regional autonomy, good government governance is needed. In line with the realization of justice and prosperity of the people according to the ideals of the 1945 Constitution, good government governance has three main components, namely: the government (state), the private sector or the business world (private sector) and society (society). These three main components have their respective roles in creating good government governance. The role of the government sector is more dominant as policy maker, control and supervision. The private sector is more of a driving force for activity in the economic sector. The public sector is more of an object as well as a subject in a field that is driven by the government and private sectors.

Abstract

This study aims to analyze the separation of powers in the Indonesian constitutional system, as well as to analyze the principles of checks and balances in the Indonesian constitutional system. This research is a normative study, using a statutory approach, a conceptual approach, and a historical approach, the data used are primary and secondary legal materials, all data collected were analyzed qualitatively. The results show that the authority given to the Public Prosecutor is an authority in the form of a mandate, considering that this authority is the delegation of authority between superiors and subordinates at a hierarchical level, the development of that authority is seen from its purpose and designation in accordance with the contents of the mandate transfer. given by the Attorney General to his subordinates and usually has a special formal nature, one of which is the special mandate given by the Attorney General to his subordinates (the General Prosecutor) in the case of delegation of authority in the form of extraordinary legal remedies or reconsideration in criminal cases.

Abstract

The problems in this research are: a juridical review of the completion of the Notary code of ethics in Samarinda City and the obstacles and solutions to the completion of the Notary code of ethics in Samarinda City. The method used by researchers is a juridical empirical legal approach and the specifications in this study include descriptive analytical. The source and type of data of this research are primary data obtained from field studies by interviewing a notary in Samarinda City. Notaries who commit errors against ethics, appropriateness or moral solutions not only according to the code of ethics alone but also based on statutory regulations. Everything that is not allowed to be done by a notary clearly and is regulated in the regulations. Obstacles in the process of completing the Notary code of ethics in Samarinda City are the large number of Notaries, with a large working area, a lack of awareness of Notaries to comply with the code of ethics, and the provision that the Notary receives is not sufficient while attending education, and overlapping provisions of the code of ethics supervision between the Honorary Council and the Notary Supervisory Council. Meanwhile, for the Supervisory Council, namely the unavailability of a representative secretariat, lack of budget funds to carry out optimal supervision and guidance, lack of government attention / concern, and weak morals/ behavior of Notaries in implementing UUJN and the Notary's Code of Ethics.

Abstract

Tourism is a service trade industry that has a complex regulatory mechanism because it includes the arrangement of the movement of tourists from their home country to return to their home countries. To be able to achieve the success of tourism development, cross-sectoral support programs are required which is a program that is expected to be carried out by various agencies / other institutions that will help determine the success of cultural development and tourism. This study aims to (a) know and review the implementation of tourism development policy in East Kalimantan Province and (b) know and review the readiness of government officials in implementing the program. Research methods in the form of empirical legal research using primary and secondary data support and utilizing persuasive approaches in the form of interviews. The results show that the implementation of tourism development policy favors nature conservation and the strategies used in attracting tourists to East Kalimantan. Obstacles often faced by the East Kalimantan Provincial Government in implementing tourism development policies include the lack of seriousness of local and municipal governments to support the work programs of the Tourism Office.

Abstract

Donors are ignorant of the prohibition on the practice of buying and selling body organs both belonging to other people and their own in Article 192 of Law Number 36 Year 2009 concerning Health. making buying and selling of organs with their own for commercial purposes thrives in Indonesia. This is the weak point of law enforcement against buying and selling of human organs, especially buying and selling of kidney organs. Therefore it is necessary to carry out further research on the act of transplanting one's own kidney organs for commercial purposes as an illustration of the upcoming criminal policy regarding the act of transplanting one's own kidney organs for commercial purposes. This research is a normative juridical legal research, namely analyzing a legal issue to find concrete law applied in resolving a particular legal case. The technique used in this research is to make an inventory of primary legal materials, secondary legal materials, and tertiary legal materials, and this type of research uses a statute approach with data analysis methods using descriptive methods (descriptive research). The targeted output is in the form of reputable international scientific articles.
