CJSI is a scientific journal of Islamic studies managed by Universitas Muhammadiyah Magelang, Indonesia. This journal is issued twice a year and it is a tool for Indonesian researchers, academics, and practitioners who are interested to channel their thoughts and findings. This journal should cover Islam both as a textual tradition with its own historical integrity and as a social reality which was dynamic and constantly changing. However, with the higher interest in the research of Islamic studies, since 2021, the journal open the widest possible access for overseas researchers to contribute and share their findings. CJSI invite researchers to contribute ideas on the main scope of Islamic Law; Islamic Economics and Business; Zakah, Waqf, and Islamic Social Finance; Quranic and Hadith Studies; Islamic Philosophy; Islamic Thought and Literature; Islam and Peace; Science and Civilization in Islam; Islam in Local; and Islam and Gender.

Abstract

This paper analyzes the forms of negotiation and contestation of religious practices Transvestites in Yogyakarta. The issue of Transvestites has become a hot conversation in the Indonesian public space and has led to multiple interpretations of the Transvestites identity’s position in the eyes of the law, religion, and society. So, it becomes significant to see how the negotiation and contestation of the Islamic religious practices among Transvestites. This study was conducted through field studies by conducting in-depth interviews and relevant literature search both online and offline. The results indicate that the Contestation of Islamic practices among Transvestites occurs in the form of interpretation of the Quranic texts, families and community organizations. To strengthen its existence, transvestites carried out many negotiations mainly related to the Islamic practice. Negotiations are carried out through various activities such as holding regular recitations, engaging in discussion forums and social activities in the community and interpreting the Quranic verse with a dehumanization approach to Islamic law. Besides, the support of religious leaders and the Legal Aid Institute further strengthens its authority in the community.

Abstract

The way to alleviate the poverty in the community, family, and individuals to prosperous condition and to alleviate the burden of daily living needs is a real practice of philanthropy. This is the relevance between the objectives of zakat, infaq, shadaqah, and waqf (ziswaf) and Sustainable Development Goals (SDGs) towards the achievement of development goals. The movement focuses on 6 issues including: without poverty, without hunger, quality education, decent work and economic growth, reduced inequality, and environmental cleanliness. It means that ziswaf is a pressure on the existence of community assets. As an effort to fund to distribute (social function), as well as control function. In order to have a practical and valuable impact, Islamic philanthropy must have a relationship between the purpose and essence of the Shari'a in the form of maqashid syarîah to encourage social welfare and the economy. As the inherent institution of Baitul Mal Tamzis, the concept of a creative philanthropy approach is used to increase the scope and sustainability of institutional impacts and provide institutional specific roles with specific institutions and target communities both consumptive and productive

Abstract

To obtain an expected benefit and avoid the business risk, effective and efficient management is needed. In general, Multi Level Marketing (MLM) system in Indonesia is still considered quite role in driving the economy. Even though in some cases, this MLM system is often used as a cover for Money Game businesses that deify passive income. So that, the conversations about it often reap the pros and cons of some business people. MUI itself issued DSN fatwa No. 75/DSN/MUI/VII/2009 concerning sharia MLM. It means that MUI issues a fatwa to allow the MLM system if required the terms and conditions. The research used a library approach, where studies of MLM systems spread across several sources of books and scientific articles are reviewed and then conclusions are taken. The results of the study are the MLM system has less benefits than the problem. MLM system has positive values, including: 1) easy marketing / distribution of products; 2) marketing costs is lower, and 3) there are bonuses that make motivation for MLM members to develop their business. The madharat caused by the MLM system is that there is a lot of confusion that causes the marketing system to be out of order

Abstract

Islam is a religion that demands autonomy and must not be distorted. But in its function as a worldview, it is always faced with the progressivity of human life’s problem that is able to accommodate the changes. In this context, there are two approaches in Islamic studies; normative and historical approaches, both have different implications. The normative approach focuses on respecting normative values and the sacredness of the text. The Implication is understanding of Islam becomes very legal-formal and rigid. Islamic scholarship becomes repetitive and involutive, which is often paradox with humanitarian problems. While the historical approach is more focused on the substantial meaning behind religious symbols and texts. The implication is Islamic studies are becoming more progressive and compatible with the progress of life. However, this approach often criticized will make Islam lose its intensity

Abstract

Islam has an essential position in the market mechanism. But, it needs some requirements to be perfect in the market. However, in reality, market distortions have occurred, it will make the injustice price determination. Rising price as a result of injustice or malpractices on the part of sellers leading to imperfection in the market. One of the Islamic scholar, Ibnu Taimiyah, explained that price is determined by the power of demand and supply. But, in the case of a rising price caused by injustice market mechanism, government intervention is needed to determined justice price. Therefore, Ibnu Taimiyah thinking about price regulation not just only give a deep analysis of what has occurred in that time, but it also can be used nowadays and reasonable to apply in the society

Abstract

The purpose of Sharia Economics is to realize the goodness, prosperity, and prosperity of human beings, especially in the economic field. Islamic Sharia prohibits the practice of usury in all its economic activities, because of its negative impact on the social system and the economy of society. Article 1 of Law Number 19 Year 2008 stipulates that the State Sharia Securities or Sukuk, is state securities issued under sharia principles, so It must be free from various elements of the ban, such as usury, maysir, and gharar. Sukuk issuance aims to finance the State Budget, including financing the construction of projects, such as infrastructure projects in the energy sector, telecommunications, transportation, agriculture, manufacturing industry, and public housing. Therefore, the participation of Muslims as the majority in Indonesia are needed to become the investor. The method used in this article is librarian research. In describing, analyzing, and evaluating, we used the regulation concerning with state sharia securities in Indonesia such as Law Number 19 year 2008 and Fatwa of National Sharia Council No: 69/DSN-MUI/VI/2008 concerning State Sharia Securities. Abstract

Al-Quran and Hadits as main sources of Islamic law are of a limit in numbers, yet the emerging matters in life are complex and limitless. In order to face problems which are more complicated and fuller of novelty, sometimes there is no specific law on the matters in Al-Quran and Hadits, thus ijtihad is necessary for this situation. One of the reasons in the formation of the Indonesian Ulama Council (MUI) is to respond and answer many religious matters emerging within society. As an Islamic community-shading institution with authority to issue a fatwa, MUI must have a method in performing ijtihad. Based on that reality, this paper seeks to explore the MUI-used ijtihad method and its implementation in the fatwa issue. This research found that the ijtihad method of MUI uses three approaches; Nash Qath’i approach, Qauli approach, and Manhaji approach based on its contexts
