Abstract

AbstrakPenelitian ini bertujuan untuk mengkaji nilai-milai  filosofi halal dan haram pada aktifitas manusia dalam memenihu kehidupan sehari hari, dimana dalam kajian ini lebih memfokus pada Maraknya bisnis berbasis halal yang menjadi magnet perhatian setiap negara, pertama karena perkembangannnya cukup pesat dan kedua trend ini bukan hanya diminati orang Islam, Karena itu, tentu saja, kajian halal- haram ini menjadi menarik untuk dikaji. Nyatanya sesuatu yang telah dianjurkan dan yang telah dilarang oleh Allah memiliki rahasia tersendiri yang cukup diyakini dan diikuti. Dan tulisan ini akan membahas tentang nilai filosofis dari halal dan haram, hasil dari penelitian ini adalah halal dan thoyyib dan larangan makan yang haram sejatinya adalah untuk kemaslahatan manusia itu sendiri. Makanan yang halal lagi thoyyib akan menjadikan seseorang sehat, baik secara fisik ataupun psikologis dan larangan makan yang haram mencegah manusia pada sesuatu yang dapat membahayakan bagi dirinya. Perintah dan larangan tentang konsumsi ini juga merupakan representasi dari maqasid al Shariah untuk menjaga al umuru al dharuriyah yaitu Hifdz Din, Hifdz Nafs, Hifdz Nasl, Hifdz Aql dan Hifdz Mal.Kata Kunci: Filosofi Halal dan Haram, Thoyyibah, Konsumsi

Abstract

One of the causes of differences in Eid al-Fitr so far is the difference among rukyat reckoning experts themselves regarding the concept of the new moon mar'i, where there are rukyat reckoning experts who say that the hilal is the lower disk, some even say it is the lower disk. on. This can clearly be a trigger for differences in starting the beginning of the Hijriyah month, especially Eid al-Fitr; that is, when the height of the new moon is critical (about 2 degrees), it may be that according to one rukyat reckoning expert and another, they have different views on the concept of the new moon mar'i; different, so the holidays are different. The researcher's initial hypothesis was that there was a difference in the concept of the new moon among members of the Hisab Rukyat Team of the Ministry of Religion of the Republic of Indonesia, because the ulama' differed in opinion regarding the entry of the early hijriyah month, especially the ulama' who allowed reckoning in determining the entry of the early hijriyah month, where there were those who used the criteria for the bright and light new moon. some wear the dark crescent. Besides that, the influence of a teacher's thoughts is quite large on the thoughts of his students, this also results in the similarity of views on the concept of the new moon of a student with his teacher, this happened to a member of the Hisab Rukyat Team of the Ministry of Religion of the Republic of Indonesia who combined the opinions of the majority of ulama' and the opinion of his teacher. (which follows the opinion of the minority ulama'). And after doing research, it turns out that the researcher's hypothesis is true.

Abstract

Islam does not regulate the age of marriage. Explanations of the minimum age limit for a person to marry are not found in the Qur'an, Sunnah, or the books of classical jurisprudence. The minimum age limit for marriage is only found in some regulations (al-qanun) in countries where the population is Muslim. In Indonesia, the minimum age of marriage is regulated in Law No. 1 of 1974 Article 7 Paragraph 1 and article 15 paragraphs (1) and (2) of the Compilation of Islamic Law. The law has the binding power to be obeyed by all citizens. In reality, there is a waiver of the minimum age limit by the Act. In some community groups, such as the Kampung Nelayan community in Saletreng Village, Situbondo Regency, this neglect still occurs with the rampant practice of marriage at an early age. Based on the results of this study, the practice of underage marriage was carried out for economic reasons. The presence of new members in the family is believed to help ease family work and can have an impact on strengthening the family economy. This practice became widespread because it was supported by the availability of access to manipulation of age data on brides-to-be by related parties.

Abstract

The law does not come in a social vacuum, in fact the law comes when there is social activity. Consequently, every social treatment definitely requires certain laws and rules. Meanwhile, religion exists because it functions as a guide to good and values and keeps away from substantial evil. Therefore, every culture is believed to allow for two opposite things, namely wrong culture and religiously right culture.In considering the Al-Quran and Hadith of the Prophet, Muslims believe that the death of a person is an event that can cut off his good deeds (including bad deeds) except through three things, so that every time someone dies in the village of Ganding there is a habit of praying and giving alms for his family. died with the aim of alleviating the burden of the sins of the deceased and providing good benefits through the Rokat Beliuneh ritual.However, Beliuneh's rokat culture does not have clear adequate references and arguments in both the Koran and the hadits of the Prophet and even the opinions of the scholars, from this it requires proper thinking to combine cultural reality and the substance of religious values if it does not have fatal consequences in the realm of I'tiqadyKeywords : Beliuneh's Rokat, Culture, Islamic Law

Abstract

Basically the authority to determine Islamic law (tasyri') rests with God and His Messenger. Apart from being explicitly stated in the Qur'an, explicit information (qath'i) is also general in nature, mujmal (dhanni). So that in the verses that are dhanni it is necessary to carry out ijtihad as an explanation of syara' demands and answers to the socio-cultural conditions and development of society. Human understanding and thinking of the second type of legal verses is called fiqh, its nature can change and is not eternal. The activities of the clergy in the process of understanding and developing Islamic law can be seen from the influence of the social and cultural conditions where the clergy are located. The contemporary fiqh that the author refers to here is contemporary Islamic law. Islamic jurists tend to interpret the meaning of contemporary Islamic law with Masa'il al-Fiqhiyah, so there is a tendency to reduce the meaning of contemporary Islamic law to the area of study of fiqh or issues that have developed in the last period. further strengthens the hypothesis about the order and relevance of fiqh-fiqh with real life contexts. Fiqh is basically not theoretical sciences (ulum al-nazariah), but its field of work is positive regulations (ahkām 'amaliyah). The contemporary family law fatwa approach uses the fiqh al-maqashid paradigm. This fiqh paradigm emphasizes the importance of attention as well as in-depth understanding of the factors or things that are the goal or reason (illat) in a legal decision, not just understanding the textual normative aspects of the provisions, fiqh al-awlawiyat. This fiqh paradigm emphasizes the selection of what is the most important of the important or between the important and the unimportant fiqh al-muwazanat.

Abstract

Penelitian menaganilis hukum pernikahan mahasiswa melalui perspektif maqasid al-syariah di Sekolah Tinggi Ilmu Syariah (STIS) Miftahul Ulum Lumajang. Perspektif maqasid al-syariah digunakan karena syari’at pernikahan merukan upaya mewujudkan kemaslahatan manusia, baik dalam kapasitas individu, keluarga ataupun masyarakat. Pendekatan yang digunakan adalah pendekatan kualitatif dan menggunakan sumber data primer dengan teknik observasi partisipan, wawancara yang mendalam, dan focus Grup. Hasil penelitian ini menjelaskan bahwa (a) Dasar penetapan hukum menikah oleh para fuqaha’ ditentukan oleh kondisi dan motivasi pelaku, dalam kasus pernikahan yang dilakukan mahasiswa, maka dalam perspektif maqasid al-syariah diberlakukan  kaidah aulawiyat (prioritas hukum) karena menuntut ilmu dan beribadah menempati posisi yang lebih tinggi secara hirarkis, yaitu hifz al-‘aql dan hifz al-din, yaitu yang wajib harus lebih didahulukan dari pada yang sunnah, (b) Fenomena pernikahan yang dilakukan oleh para mahasiswa Sekolah Tinggi Ilmu Syariah (STIS) Miftahul Ulum Lumajang pada masa studi dalam perspektif maqasid al-syariah dikarenakan beberapa faktor internal dan eksternal dan didorong oleh satu atau beberapa tujuan (niat atau maqashid) berimplikasi pada mashlahah wajibat atau mashlahah mandubat, atau mashlahah muharramat dan makruhat
