Abstract

Abstract. This paper examines child parenting that occurs in working mothers in Paiton Probolinggo, East Java. On the one hand, the demands of fulfilling the family economy forced the mothers to work hard outside the home. On the other hand, they are required to care for and assist children in proper parenting intensely. Based on this fact, it is necessary to study how changes in parenting happened to work mothers and how fathers and mothers worked together in families to do co-parenting. These two problems are then examined from a gender mainstreaming perspective and then analyzed through fiqh so that the concept of gender relations in parenting can be found in accordance with the values of Islamic teachings. Through a case study approach, collecting, processing, and analyzing data with qualitative research principles, this study resulted in the finding of delegating parenting from parents to others resulting in low-quality supervision and assistance from caregivers to children and low levels of child satisfaction. This study also found no occurrence of parenting that involved fathers and mothers in the principle of partnership and ignorance. In the perspective of parenting fiqh, the parenting patterns that occur in Paiton Probolinggo are not in accordance with the values and laws of parenting fiqh. Abstrak. Tulisan ini mengkaji tentang pola asuh anak yang terjadi pada ibu pekerja di Paiton Probolinggo Jawa Timur. Di satu sisi tuntutan pemenuhan ekonomi keluarga memaksa para ibu untuk bekerja keras di luar rumah. Di sisi yang lain mereka dituntut untuk secara intens merawat dan mendampingi anak dalam pola asuh yang tepat. Berdasarkan fakta ini, perlu dikaji bagaimana perubahan pola asuh yang terjadi pada ibu pekerja serta bagaimana kerjasama ayah dan ibu dalam keluarga melakukan coparenting. Kedua permaslahan tersebut selanjutnya dikaji dari perspektif gender mainstreaming untuk kemudian dianalisis melalui fiqih sehingga dapat ditemukan konsep relasi gender dalam pengasuhan anak yang berkesesuain dengan nilai nilai ajaran Islam. Melalui pendekatan case study, mengumpulkan, mengolah, dan menganalisis data dengan prinsip-prinsip penelitian kualitatif, kajian ini menghasilkan temuan adanya pendelegasian pola asuh anak dari orang tua kepada orang lain yang berakibat rendahnya mutu pengawasan dan pemdampingan dari pengasuh terhadap anak serta rendahnya tingkat kepuasan anak. Kajian ini juga menemukan tidak terjadinya coparenting yang melibatkan ayah dan ibu dalam prinsip kemitraan dan kesalingan. Dalam perspektif fiqih parenting, pola pengasuhan anak yang terjadi di Paiton Probolinggo ini tidak sesuai dengan nilai dan prinsip fiqih parenting.

Abstract

The determination of the wedding day by using primbon happened  in Karanggeger’s society is a Tradition that has been inherited by the ancestors, as in Islam this tradition certainly contradicts with Islamic Shari'a, where as the majority of the Karanggeger people are Muslim, but the tradition is still carried out as a habit that has been handed down for generations by the society, to determine the law from that tradition by using Istihsan, where Istihsan assesses an event based on whether or not there are benefits in it.How to find out the process of determining the marriage contract day in Karanggeger village by using Primbon and how the Istihsan study of the determination of marriage contract by using the primbon. This research used some methods those are Phenomenology, Observation, Interview, and Documentation. The data obtained is then processed with a qualitative approach.The results of the study were that Karanggeger people came to the local religious figures who understood the Primbon problem then determine a good wedding day, every thing that was done and considered something good was worthy of being called Istihsan, as well as legal exclusion from general shari'ah principles, based on habits applicable.

Abstract

When a divorce occurs between a husband and wife, it creates obligations that must be obeyed by a husband and wife, and these obligations include an ex-husband being obliged to give a gift that must be given to the ex-wife who has been divorced, the gift is in accordance with economic conditions. the ex-husband (according to his ability), the provider of a living is a consolation during the 'iddah period, in Islamic law the provision of a living is only during the 'iddah period, this is different from Asghar's opinion, according to him the provision of a living for a divorced ex-wife, not only only during the 'iddah period, but until they remarry or die. The results of the study concluded that the criteria for women who are entitled to a sustainable living from their ex-husband are for women who are unable to take care of themselves (poor), because they do not have family or relatives, because it is far from a sense of justice if a woman who has divorced back to his parents or to his relatives. Asghar Ali Engineer's thoughts have relevance to Law Number 1 of 1974 article 41 letter (c). This of course also has implications for KHI, which only provides a living for the ex-wife only until the 'iddah period, and providing a living for the ex-wife who has been divorced can be given but by looking at these various criteria.

Abstract

Abstract:Marriage is a legal aspect and involves legal action. Everyone wants the family to be happy and live, But in the community around a husband and wife who are not harmonious in the household, they take steps to divorce. The divorce is done through the District Court for Indonesian citizens who are non-Muslim and through the Religious Courts for Muslim Indonesian citizens. This research was conducted at the Kraksaan Probolinggo Religious Court. This study uses normative juridical methods or legal norms that apply in the State of Indonesia. The results showed that the factors causing the high divorce due to lack of harmony in the household were caused mainly by economic problems such as the husband's lack of monthly spending money to his wife. The Religious Courts more widely accept divorce claims than other cases. The religious court examines the application for divorce and divorce, which is intended by the parties requesting divorce by fulfilling the requirements stipulated in the law. Key words: divorce, Religious Courts, Kraksaan. Abstrak: Perkawinan merupakan aspek hukum dan menyangkut perbuatan hukum. Setiap orang pasti menginginkan agar keluarganya bahagia dan langgeng, tetapi dalam fakta yang ada di masyarakat terdapat beberapa pasangan suami istri yang tidak harmonis dalam rumah tangga, sehingga mengambil langkah untuk mengakhiri perkawinan mereka yang disebut perceraian. Perceraian dapat dilakukan melalui Pengadilan Negeri bagi warga negara Indonesia yang beragama non Islam, dan melalui Pengadilan Agama bagi warga negara Indonesia yang beragama Islam. Penelitian ini dilakukan di Pengadilan Agama Kraksaan Probolinggo. Penelitian ini menggunakan metode yuridis normatif atau norma-norma hukum yang berlaku di Negara Indonesia. Hasil penelitian menunjukkan bahwa faktor penyebab tingginya perceraian karena tidak adanya keharmonisan dalam rumah tangga yang kebanyakan disebabkan oleh masalah ekonomi seperti kurangnya uang belanja bulanan yang diberikan suami kepada istrinya. Perkara cerai gugat lebih banyak diterima oleh Pengadilan Agama Kraksaan dibandingkan perkara-perkara yang lainnya. Pengadilan agama memeriksa permohonan cerai gugat maupun cerai talak yang dimaksudkan oleh pihak-pihak yang memohon cerai dengan memenuhi persyaratan yang diatur dalam undang-undang. Kata Kunci: Perceraian, Pengadilan Agama Kraksaan.

Abstract

Absract: A common treasure isa treasure acquired during a marriage, apart from gifts and inheritances. The idea is that both the possessions are acquired through the business of husband and wife. The Shared division of property resulting from the law after a divorce both husband and wife would be concerned about the property of a "marital union" or would also be referred to asa "marital treasure." Under "1974's no. 1 bill on marriage ", however, it has not been described in more detail as to what number each is. Each of the divisions of property entitled to each one's being more modest and is discussed only in 3 chapters, that is, chapters 35-37. Whereas in a compilation of islamic law or commonly called khi the matter of mutual property is discussed more fully by describing it in 13 chapters of 85-97. The kinds of research methods used in writing this scientific work are normative legal methods and use law approaches. In this case, a judge's consideration would be most needed in resolving this cost-sharing problem between husband and wife after a judicial and reasonable divorce. Maksudnya, adalah baik harta tersebut diperoleh dari usaha suami maupun istri. Pembagian harta bersama akibat hukum setelah terjadinya perceraian baik pihak suami maupun istri akan mempermasalahkan mengenai harta “gono-gini” atau juga biasa disebut harta bersama pada saat masih dalam ikatan perkawinan. Berdasarkan “Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan”, namun belum dijelaskan lebih rinci mengenai berapa jumlah masing-masing pembagian harta yang berhak diterima oleh setiap orang karena bersifat lebih sederhana dan hanya dibahas dalam 3 pasal saja yakni pasal 35-37. Sedangkan dalam Kompilasi Hukum Islam atau biasa disebut KHI masalah harta bersama dibahas dengan lebih lengkap dengan menguraikannya dalam 13 pasal yakni pasal 85-97. Jenis Metode penelitian yang digunakan dalam penulisan karya ilmiah ini adalah metode hukum normative serta menggunakan pendekatan perundang-undangan. Dalam permasalahan ini, pertimbangan hakim sangat diperlukan dalam menyelesaikan permasalahan pembagian Harta bersama ini antara pihak suami dan istri setelah terjadinya perceraian dengan rasa keadilan dan sewajarnya. Pembagian harta bersama di Pengadilan Agama Kraksaan berdasarkan pertimbangan majelis hakim dalam memutuskan perkara nomor 1487/Pdt.G/2019/PA.Krs menggunakan ketentuan yang terdapat pada Pasal 97 Kompilasi Hukum Islam, dimana pembagian dalam pasal tersebut menyebutkan bahwa janda atau duda cerai hidup masing-masing mendapat 1/2 dari harta bersama. Kata Kunci: Harta Bersama, Undang-Undang No. 1 Tahun 1974, Kompilasi Hukum Islam (KHI).

Abstract

Abstract: The rise of disability fiqh studies in several universities is inversely proportional to the study of fiqh in pesantren. The pesantren, known as the place of tafaqquh fi al-din, did not hear its role in guarding the study of disability fiqh. This study tries to find out the understanding of santri in Probolinggo, East Java, about the disability fiqh and the factors that influence the understanding. The results of the study concluded that the understanding of santri in Probolinggo East Java on disability jurisprudence positions persons with disabilities as centers of study, has formal legal character, denies the ethical-moral approach, and is trapped in the discourse of rukhsah or the provision of dispensation. This understanding is influenced by reading material that is used as a reference, understanding that is transformed by teachers and senior santri, lack of experience in dealing with persons with disabilities in daily life and experience in following studies of disability with multiple perspectives.Keywords: Islamic School and Disability Fiqh

Abstract

Islam does not regulate the age of marriage. Explanations of the minimum age limit for a person to marry are not found in the Qur'an, Sunnah, or the books of classical jurisprudence. The minimum age limit for marriage is only found in some regulations (al-qanun) in countries where the population is Muslim. In Indonesia, the minimum age of marriage is regulated in Law No. 1 of 1974 Article 7 Paragraph 1 and article 15 paragraphs (1) and (2) of the Compilation of Islamic Law. The law has the binding power to be obeyed by all citizens. In reality, there is a waiver of the minimum age limit by the Act. In some community groups, such as the Kampung Nelayan community in Saletreng Village, Situbondo Regency, this neglect still occurs with the rampant practice of marriage at an early age. Based on the results of this study, the practice of underage marriage was carried out for economic reasons. The presence of new members in the family is believed to help ease family work and can have an impact on strengthening the family economy. This practice became widespread because it was supported by the availability of access to manipulation of age data on brides-to-be by related parties.
