Abstract

The purpose of the study was to analyze the handling of public complaint reports that could not be handled properly with the police investigation process and the regulation of the National Police Chief regarding the handling of reports of public complaints against the police investigation process at the level of Polres and Polsek in the future. The problem approach used is normative juridical supported by empirical juridical. The data used are primary data. Analysis Techniques used in normative legal research. The results of the study indicate that officers of the Polres supervision section are expected to be able to serve well every community complaint and be thorough in the investigation process of the National Police at the Polres and Polsek levels. The need for a change in the organizational structure of the Polres supervision section with the addition of a section specifically handling community complaints in the Polres Supervision Sub Section so that it does not overlap with other work.DOI: https://doi.org/10.26905/mlj.v1i1.4292.

Abstract

Efficiency and effectiveness are important factors for the company. To improve efficiency and effectiveness, the company can perform outsourcing system for labor management. PT. Pertamina Hulu Sanga Sanga has business contracts with three Supporting Service Companies, namely PT. PTC, PT. INJ and PT. IRA as a labor support service company. The three supporting service companies have their own policies in managing their employees who provide personnel services in the Pertamina Hulu Sanga Sanga operational area. One of the differences in the implementation of the policy of supporting service companies among the supporting service companies is the collection of health services tax using ASO (Administrative Services Only) services. This difference became a topic of discussion among outsourcing workers and sparked comparisons between support service companies that use the same health services but one company collects taxes, one does not collect taxes, and the other does not collect taxes but cover as if they were paying premium health insurance. . The research method used is through an empirical legal approach, with an analytical perspective with the object of study covering legal theory, and rules for collecting income taxes, especially health benefits tax for outsourcing workers. The primary data sources in this research are facts in the field and tax laws. Data collection techniques are through field orientation and interviews with outsourced workers and management of outsourcing companies and staff of the Tenggarong Tax Office. The results of the study indicate that the application of the principle of justice in tax collection on outsourcing workers has not been implemented. Legal efforts made by employer companies to regulate the equality of health benefit tax treatment have also not been seen. The existing work contracts are very detailed but still need to be clarified, especially regarding the implementation of health service facilities that can be uniformed for all supporting service companies. In addition, supporting service companies must also be wise in managing business contracts so as not to make policies that harm workers due to misinterpretations in determining whether health insurance is taxed or not.DOI: https://doi.org/10.26905/mlj.v2i1.6238

Abstract

Indonesia is a country that adopts the concept of a welfare state. The welfare state refers to the role of the government which is responsible for managing and organizing the people's economy. The state is expected to be able to carry out its responsibility to ensure the availability of basic rights welfare services for its citizens. The provision of subsidies is a government program to ensure the welfare of the people. The research objective is to examine the position of the subsidy program from the perspective of the welfare state and the elimination of fuel subsidies by the government as a welfare state. This research is normative legal research, which deals with the policy of eliminating fuel subsidies from the perspective of the welfare state. The approach used is statutory and conceptual. In a legal concept, the position of the subsidy policy is to help improve people's welfare. The removal of fuel subsidies is a government action that is following the concept of the welfare state because the use of BBM is not included in the basic needs of the community which must be subsidized or intervened by the government.AbstraksIndonesia merupakan negara yang menganut konsep negara kesejahteraan. Negara kesejahteraan mengacu pada peran pemerintah yang bertanggungjawab dalam mengelola dan mengorganisasikan perekonomian masyarakat. Negara diharapkan mampu menjalankan tanggung jawabnya untuk menjamin ketersediaan pelayanan kesejahteraan hak-hak dasar bagi warganya. Pemberian subsidi merupakan program pemerintah untuk menjamin kesejahteraan rakyat. Tujuan penelitian adalah untuk mengkaji kedudukan program subsidi dalam perspektif negara kesejahteraan, dan penghapusan subsidi BBM oleh pemerintah sebagai negara kesejahteraan. Penelitian ini merupakan penelitian hukum normatif, yang berhubungan dengan kebijakan penghapusan subsidi BBM dalam perspektif negara kesejahteraan. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan konseptual. Secara konsep hukum, kedudukan kebijakan subsidi untuk membantu meningkatkan kesejahteraan rakyat. Penghapusan subsidi BBM merupakan tindakan pemerintah yang telah sesuai dengan konsep negara kesejahteraan karena penggunaan BBM tidak termasuk dalam kebutuhan dasar masyarakat yang harus disubsidi atau diintervensi oleh pemerintah. DOI: https://doi.org/10.26905/mlj.v1i2.5533

Abstract

This study aims to analyze the efforts of prosecutors in investigating corruption crimes and to examine and analyze the obstacles faced by prosecutors in investigating corruption crimes and the efforts to overcome them. Methodologically, this research belongs to the type of criminological research where this approach is intended to find out the causes and efforts of prosecutors in investigating Corruption Crimes as well as the obstacles faced by prosecutors in Corruption Crime Investigations and efforts to overcome them. Using an interactive analysis model or Interactive Model of Analysis, it was found that the prosecutor's efforts were carried out in investigating a corruption case, carried out through a series of processes in the form of Notification of the Commencement of Investigation so that no one corruption case was investigated by two different agencies. the investigation can run efficiently, effectively and well, the collection of evidence, exposure will determine the conclusion drawn whether the criminal case will be forwarded to the prosecution stage or an additional investigation will be carried out to complete and perfect the investigation until the submission of files to the public prosecutor. In the case of corruption, the investigating prosecutor faces several obstacles, namely: Time management, coordination, and the resistance from the perpetrators of corruption.DOI: https://doi.org/10.26905/mlj.v2i2.7158

Abstract

Collective Labor Agreement (PKB) is the result of negotiations between trade unions and employers, which contains the terms of employment, rights, and obligations of both parties. PKS PT. Indolakto Pandaan for the period 2019-2021, whose content is limited in scope and regulates general matters. Employers, trade unions, and their members knowingly, have good faith and are responsible for implementing the contents of the PKS: in financial and non-financial contexts, both express and implied. Employers and workers have done this following the contents of the PKS. There are even some things that are better implemented. Entrepreneurs put forward a sense of humanity in making decisions. Workers have understood their obligations and rights. In the event of an employment problem, employers and trade unions agree to resolve the problem and always prioritize the spirit of deliberation in the bipartite cooperation institution to reach the best consensus. An agreement with upholding and respecting the values of harmonious industrial relations, following the prevailing laws and regulations in the Republic of Indonesia so that there will be no actions that harm both parties.AbstraksPerjanjian Kerja Bersama (PKB) merupakan hasil perundingan antara serikat pekerja dan pengusaha, yang memuat ketentuan kerja, hak dan kewajiban kedua belah pihak. PKS PT. Indolakto Pandaan periode 2019-2021 yang isinya dibatasi ruang lingkup dan mengatur hal-hal umum. Pengusaha, serikat pekerja dan anggotanya dengan sadar, beritikad baik dan bertanggung jawab dalam melaksanakan isi PKS: dalam konteks finansial dan non finansial, baik tersurat maupun tersirat. Pelaksanaannya telah dilakukan oleh pengusaha dan pekerja sesuai dengan isi PKB. Bahkan ada beberapa hal yang lebih baik diterapkan. Pengusaha mengedepankan rasa kemanusiaan dalam mengambil keputusan. Pekerja telah memahami kewajiban dan hak mereka. Jika terjadi masalah ketenagakerjaan, pengusaha dan serikat pekerja sepakat menyelesaikan masalah selalu mengedepankan semangat musyawarah di lembaga kerjasama Bipartit untuk mencapai mufakat yang terbaik. Kesepakatan dengan menjunjung tinggi dan menghormati nilai-nilai hubungan industrial yang harmonis, sesuai dengan peraturan perundang-undangan yang berlaku di Republik Indonesia sehingga tidak terjadi tindakan yang merugikan kedua belah pihak.DOI: https://doi.org/10.26905/mlj.v1i2.5492

Abstract

This study aims to determine the position of the agent in a syndicated loan agreement, and the agent's responsibility when the debtorexperiences an achievement. This research is a normative juridical research which is a procedure to find the truth based on scientific logic from the normative side. The approach in this research is legislation and conceptual approach. The results showed that the agent's relationship with the creditors was the power relationship with the power of attorney. If a dispute arises between the agent and the parties in the syndicated loan agreement, the settlement is based on the provision of power of attorney in the syndicated credit document. The responsibility of the agent is divided into two, namely the agent who also participates in the syndication participant, and the agent outside the syndicated loan participant. Agents who are also creditors in syndicated loans, if debtors default, then the agent is responsible. The responsibility of the syndicated loan agent outside the syndicated loan participant is only as a liaison between the creditor and the debtor. Abstract

The purpose of this study is to analyze the role of mediators in the me-diation process for efforts to settle civil cases and examine the obstacles faced by mediators in mediating efforts to resolve civil cases. This re-search is an empirical legal research because it identifies the role of mediator. The results show that the effectiveness of the mediator's role in the settlement of civil cases in the Pasuruan District Court has been running well. Mediators consisting of judges and substitute clerks can bridge, reconcile and mediate the problems of the two disputing parties. Based on data in the field, the obstacles that cause failures in the media-tion process are as follows: mediators are still not proactive in carrying out mediation tasks, among others; the disputing parties, outside medi-ators do not understand the mediation procedure in accordance with applicable regulations, there are often disagreements between the dis-puting parties because they focus on winning and losing alone, not a win-win solution for the common good. The mediator must really un-derstand his role as a mediator so that deadlocks or obstacles are not found in the mediation process.DOI: https://doi.org/10.26905/mlj.v2i1.6254

Abstract

In the implementation of fintech lending services, it cannot be denied that there is a possibility of default by one of the parties. In particular, the lender has a greater risk, namely the risk of default due to the failure of the loan recipient to perform his / her performance. Therefore, legal protection is needed for lenders to create a sense of security and create legal certainty. The issues discussed in this study are how the legal protection for lenders (lenders) in the implementation of Financial Technology when there is a default and how to resolve disputes in the implementation of Financial Technology for lenders (lenders). The results of this study are that one of the legal protections for lenders is also regulated in Article 29 of the Financial Services Authority Regulation Number 77 / POJK.01 / 2016 concerning Information Technology-Based Lending and Borrowing Services, including the Principle of Transparency, fair treatment, reliability, confidentiality, and data security and user dispute resolution in a simple, fast and affordable manner and the Operator is obliged to provide compensation to the party that has been injured due to the Operator's mistake or negligence.DOI: https://doi.org/10.26905/mlj.v2i1.6255

Abstract

This study aims to analysis implementation of Article 20 Letter C of Law No. 10 of 2009 concerning Tourism in Malang Regency and Analysis of Legal Protection and Security of Tourism Service Users in Malang Regency. Research that uses this type of juridical empirical research by conducting research based on laws that is adjusted to experiences that occur in society to better understand and understand law as a set of regulations or positive norms that apply. This research is also called qualitative legal research. The research data were collected by means of field studies and legal materials related to this, then processed and analyzed with a community approach and invitation. The results of this study indicate that people who use tourism services, especially in Malang district, have legal and security guarantees. However, this rule is not used as a reference based on the government in management in Malang Regency. Abstract

The government has begun to carry out reforms in all fields, including labor law. There has been a violation in the application of the Fixed Time Work Agreement (PKWT) system. The specified time working agreement (PKWT) which is implemented does not comply with or does not even refer to the PKWT rules stipulated in Law Number 13 of 2003 concerning Manpower. This research is normative legal research, namely a research method using finding the truth based on the law seen as a practice. In this study, primary data were used. The approach method used is an empirical juridical approach. The type of work agreement can be distinguished by the length of time agreed upon in the work agreement, which can be divided into PKWT and Indefinite Work Agreement (PKWTT). Supervision constraints occur as a result of the weakness of existing legal regulations, one of which is about work contracts. The work contract does not explain in detail what work was carried out, making it difficult to carry out supervision in the field.AbstraksPemerintah mulai melakukan reformasi dalam segala bidang, termasuk bidang hukum ketenagakerjaan. Telah terjadi pelanggaran dalam penerapan sistem Perjanjian Kerja Waktu Tertentu (PKWT). Perjanjian Kerja Waktu Tertentu (PKWT) yang dilaksanakan tidak sesuai atau bahkan tidak menga-cu kepada aturan PKWT yang diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian ini merupakan pene-litian hukum normatif, yaitu metode penelitian dengan cara menemukan kebenaran berdasarkan hukum dilihat sebagai prakteknya. Dalam penelitian ini digunakan data primer. Metode pendekatan yang digunakan adalah pendekatan yuridis empiris. Jenis perjanjian kerja dapat dibedakan atas lamanya waktu yang disepakati dalam perjanjian kerja, yaitu dapat dibagi menjadi PKWT dan Perjanjian Kerja Untuk Waktu Tidak Tertentu (PKWTT). Kendala pengawasan yang terjadi sebagai dampak dari lemahnya aturan hukum yang ada, salah satunya tentang kontrak kerja. Dalam kontrak kerja tidak dijelaskan secara rinci pekerjaan apa yang dilakukan, sehingga menyulitkan untuk melakukan pengawasan di lapangan. DOI: https://doi.org/10.26905/mlj.v1i2.5493
