Abstract

The debate about civic literacy in philosophical discourse in Indonesia is still rare. This paper may have initiated this debate by anchoring philosophical criticism to the research of Armaidy Armawi and Raharjo in the Journal of Philosophy Vol 31, No. 1 of 2021 entitled: "Evaluation of Civic Literacy Socialization Program in the Formation of Young Citizen Ethics." The fundamental aim of this paper lies in the power to critique research that has fragile evidence in the discussion of civic literacy. This study uses qualitative methods with verstehen, trouble mapping, interpretation, and Myra Zarnowski's thought experiments. The research findings: first, the fragility of the evidence occurred in the two researchers due to experiencing the epistemological break. Second, the fragility of the two researchers' evidence is in the content of civic literacy because the evaluation of the two researchers missed by presenting lack of data so that the peak achievement in civic literacy is not directed at the well-inform citizens, but is concerned with the explanatory bias that exists in ethics. The recommendations of this study focus on civic literacy, which contains a structure on reading themes and civic values that can answer the needs of citizens. The implication is sense of the citizens engagement to realizing social justice.

Abstract

This paper is a critical analysis of the text that reads: "This boarding house only accepts Muslim students" based on the philosophy of relationality of Armada Riyanto towards the phenomenon of religious pluralism in Indonesia. Indonesia has various religions. Religious diversity in Fleet Relational Philosophy means acceptance of others in their plurality. The methodology used in this research is Phenomenological Description Analysis (FDA), which examines the text: "This boarding house only accepts Muslim students" in Armstrong's compassionate perspective. The findings of this study are: (1) me and the text. Humans criticize the discriminatory text "this boarding school only accepts students" from the idea of Riyanto's Fleet Relationality. (2) Me and Liyan. Build empathy and dialogue as a 'door' of tolerance. (3) Me and God. Strong faith will further encourage tolerance, not the other way around.

Abstract

The five basic principles of the Indonesian state, known as Pancasila, are non-negotiable state ideologies. Born from the need of the State for fixed values that can unite the plurality of its citizens. Pancasila was born not from mere wishful thinking but from realities that were condensed into stable values. Soekarno, Mohammad Yamin and Soepomo were mentioned as intellectual actors in the birth of Pancasila which was presented at the BPUPKI (Investigating Agency for Preparatory Work for Indonesian Independence) session. The results of the trial were Pancasila which is currently known to all by the people of Indonesia. The purpose of writing this article is to reveal the birth of Pancasila from the perspective of Hegel's Dialectics through an assessment of the social reality at the time of the birth of Pancasila. From the results of the study, it was found that the process of the birth of Pancasila was inseparable from the dialectic between thesis and antithesis so that in the end it gave rise to a synthesis. What is abstract meets reality, whether religious reality or state reality and even social reality, will give birth to values resulting from compromise rather than mutual negation, which Hegel calls Aufgehoben. The journey of Pancasila as a state ideology can be analyzed philosophically. In conclusion, Pancasila is not a doctrine that was born from the arrogance of the rulers, but was born from the needs of the State which was borne by one of them by a very rationalist process.

Abstract

This study aims to conduct a study of the adaptation of the sengker dewasa application in Pakraman Taman Bali Village during the covid-19 pandemic. This research is designed in the type of qualitative descriptive research. This study found three results to provide answers to research problems. First, the adaptation of the application of the sengker dewasa implementation of the pitra yajña ceremony adjacent to the piodalan ceremony at the Kahyangan Tiga Temple during the covid-19 pandemic, its existence is still preserved by limiting the implementation of the pitra yajna ceremony adjacent to the piodalan. Second, the adaptation function of the sengker dewasa application in the pitra yajña ceremony adjacent to the piodalan ceremony at Kahyangan Tiga Temple during the covid-19 pandemic at least four, namely religious functions, social functions, cultural functions, and health functions. Third, the meaning of the sengker dewasa adaptation in the pitra yajña ceremony adjacent to the piodalan ceremony at Kahyangan Tiga Temple during the covid-19 pandemic at least four, namely the meaning of holiness, the meaning of health, the meaning of cultural preservation, and the meaning of solidarity. This study recommends that adaptation in the application of the sengker dewasa is very important because it contains positive potential in people's lives to always establish social relationships because the sengker dewasa is a social agreement of their ancestors which until now can still unite the Pakraman village community.

Abstract

The image of a standard contract that puts forward the determination of contract terms unilaterally becomes the core of the study of the essence of justice in a standard contract, especially from the perspective of Hindu law. The method used is a type of qualitative research with a statutory and conceptual approach. For data collection techniques using literature studies and documentation with reference to the analysis of the application of Aristotle's theory of justice to the unilateral application of standard contract terms. Based on the results of the analysis, it was found that the standard contract is included in the category of sources of procedural law (Sadacara) in Hinduism which must not conflict with Sruti and Smerti as lex superiorioir. In the context of Smerti, the standard contract is included in the Arthasastra section, especially the Manawa Dharmasastra group, so the provisions in the Manawa Dharmasastra also apply to standard contracts such as the provisions of Article 1338 of the Civil Code which has similar arrangements with Book VIII Sloka 46 Manawa Dharmasastra, while the provisions of Article 1320 of the Civil Code have essence similarity with Book VIII Manawa Dharmasastra Sloka 143 (regarding object/achievement/guarantee), Sloka 163 (regarding legal competence), Sloka 164 (regarding halal causa), and Sloka 165 (regarding agreement). Furthermore, regarding the essence of standard contract justice, it is categorized as equal justice (justitia commutativa) as long as it fulfills the legal certainty aspect, namely it does not conflict with the provisions of public legislation such as the fulfillment of the provisions of Article 1338 and Article 1320 of the Civil Code, as well as Article 18 Paragraph (1, 2,3,4) Law Number 8 of 1999 concerning Consumer Protection.
