Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Jurnal Hukum dan Peradilan comes out three times a year in March, July, and November.

Abstract

This Article entitled " the State law of Indonesian" is the result of a study on the conception of characteristic of law states of Indonesian that distinguish the conception of the state laws in other countries. Based on the research results, can be explained even get the effect of various thoughts, but conception of law state of Indonesian different with conception the rule of law and rechtsstaat. This can be search from basic of philosophy, the nature of sovereignty, the powers of state organs, and human rights. There are six main elements of Indonesian law states, namely: 1) Pancasila; 2) supremacy of law;; 3) democratic 4) restrictions and dispersal of state power; 4) independent judiciary; 6) protection of human rights. the statement of Indonesia as a democratic rule of law based on Pancasila then should all forms of civic and social action must be based on the law.Keywords: Pancasila, State of law (the rule of law, rechtsstaat), Democracy, Human Rights

Abstract

Appeals is a remedy that can be used by the taxpayers during the tax dispute with the tax authorities, having previously filed Objection. Philosophy of remedies is a means of seeking justice to fight for their rights as equal before the law, it should be an option that gives freedom for the taxpayer to use or not use. Anomaly occurs, where the Act Number 28 of 2007 on General Provisions and Tax Procedures seeking justice requires to pay the administrative sanction a fine of 100% of Appeals were denied or granted in part. In the middle of the threat of sanctions, taxpayers are dealing with a lower ability of court to produce a fair Judgment for the parties. Therefore, the realization of the Tax Judiciary functions as a conduit of Fairness should be questioned and examined. Keywords: Appeal, Objection, Fine, Judiciary, Fairness

Abstract

Protection of victims of crime is part of the protection of human rights as a whole. The protection that provided was the responsibility of the state that has been manifested in a criminal law policy. The ultimate goal of the criminal law policy is the social defence to achieve the overriding goal of social welfare. Criminal law policy is basically also an integral part of social policy. Criminal Law Policy in Indonesia contained in implementation of the criminal policies through the establishment of statue such as the Penal Code, Criminal Procedure Code, and other organic laws which governing the criminal provisions in it. Criminal Law Policy was emerged from political law which integrated into the criminal policies that embodied in laws governing the criminal provisions. This essay is trying to discuss how criminal law policy in Indonesia that has been implemented, and how the criminal law policy in providing the protection of victims of crime through the criminal justice system in Indonesia. Currently, the criminal law policy regarding the protection of victims of crime has been regulated. But the provisions have not fully provides protection to victims of crime. It can be seen in Act No. 8 of 1981 on the Code of Criminal Procedure Act which gave more protection to the suspect than to the protection of victims. Furthermore, Law No. 13 of 2006 on the Protection of Witnesses and Victims provide better protect witnesses than victims. This is due to the Act appears to provide protection to witnesses incorruption cases. Keywords: the criminal law policy, the criminal justice system, protection of victims of crime.

Abstract

Handle civil disputes in general, for many the sense how the courts considered too laden with procedures, formalistic, rigid, and slow to make a decision on a dispute. Presumably these factors can not be separated from the judge's perspective on a very rigid laws and normative-procedural law in doing concretization. While a judge should be able to be living interpretator captures the spirit of fairness in society and not bound by the normative-procedural rigor present in a legislation, because the judge is no longer a la bouche de la loi (law funnel). There are indications that the judge did not have enough courage to make decisions that are different from the normative provisions of the law, so that substantial justice is always difficult to achieve through a court verdict, because the judges and the courts will only give formal justice. Assessment of fairness in general terms only from one side only, ie those who receive treatment. The seekers of justice in general, defeated parties in the case, will always provide an assessment that the unjust verdict. It can not be denied is one result of the function and role of the trial run has been oriented towards the success of efforts to support and programs set by the government or the executive. Abstract

Coverage, insight and understanding of illegal fishing are understood and adhered to in Indonesian positive law is stealing fish and have a big impact on the economy of the country. Therefore, the essence of regulation and prosecution of illegal fishing in Indonesia should be understood in the prosecution of large-scale illegal fishing, which is generally carried out by foreign fleets, foreign vessels are illegal, which has also resulted in harming the country's economy (Indonesia) trillions of dollars each year. With the model and the type of large-scale theft and harm the national economy, the handling of the regulations should be directed at / to overcome the evils of large-scale and complicated (sophisticated), which belong to the type of crime white collar crime or corporate crime. Know and understand the ins and outs as well as the existence of corporate crime, for law enforcement is a necessity in this modern era, this paper therefore focuses on two keywords (key word) illegal fishing and corporate crime. Knowing and understanding the concepts and regulations surrounding corporate crime and illegal fishing be an important contribution in the process of law enforcement. With the understanding of illegal fishing and corporate crime will be a strong foundation for any legal practitioner, especially of law enforcement in the event proceeds and determine the type and classification of appropriate criminal and law enforcement especially true for judges to dare and did not hesitate to impose sanctions on each involved in illegal fishing or corporate offenders. With a firm and clear sentences, and certainly, the law enforcement officers not only enforce the law and justice but also has saved the country's economy, by preventing potential loss of national wealth, as the implementation of the function of law as an instrument of social engineering. Abstract

The existence of the Administrative Court in the judicial system in Indonesia as a manifestation of the commitment of the state to provide legal protection of individual rights and the rights of the general public so as to achieve harmony, harmony, balance, and dynamic and harmonizing the relationship between citizens and the State. But the execution of the decision of the Administrative Court which have permanent legal force by the State Administration officials are not fully effective, although the mechanisms and the stages of execution has been carried out. Factors causing poor execution of the decision of the Administrative Court, among others; absence of rule of law that forced the officials to implement the State Administrative Court's decision: the commandment of the judge's decision that dare not include the forced payment of a sum of money when the state administration officials concerned did not implement the decision of the Court; factor and compliance officials in carrying out the State Administrative Court decision. Abstract

Islamic law of inheritance is, to be followed by all Muslims, but its implementation is not in accordance with the provisions of Islamic law, this is caused by lack of understanding of Islamic inheritance law. In the application of the Islamic law of inheritance can be different from the norms of Islamic law itself, which is done by reconciliation or peace, which is not in accordance with the provisions of Islamic law, but through the application of such a method of interpretation. Interpretation in the application of the law of inheritance is possible in an understanding of the heirs any other alternative that contains the values of justice and peace among the heirs and families. Abstract

Plastics contain hazards that can endanger consumers' health. This thesis discusses the problems faced by consumers due to the use of plastic products as food packaging, consumer protection law violations by the business, and the role of government in order to control the use of plastic products by businesses. Results of this study concluded that the problems faced by consumers is the use of plastic products by dangerous business as a packaged food. By using dangerous plastic product, businesses have also violated provisions of the law of consumer protection. Furthermore, the government should monitor the use of plastic packaging, provide counseling to consumers and businesses, and require businesses to include the symbol and code information on the triangle and plastic packaging.
