Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Abstract

The task of the judge in realizing justice is inseparable from the decisions that are made. A qualified judge's decision is obtained through the judge's thought process through a choice of judges that reflects judicial activism. The problem in this research is how judicial activism is used by judges in issuing decisions and how the implementation of judicial activism in decision making. Judicial Activism is the choice of decision making by judges in order to realize justice. Judicial activism in the Indonesian judicial system is regulated in Article 5 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power. The law requires judges to explore the law and sense of justice that lives in society. The implementation of judicial activism is carried out by judges through means of legal discovery. Through means of legal discovery, judges play an active role in realizing justice as a law that lives in a dynamically developing society.

Abstract

Tapping in a human rights perspective is a form of limitation of the right to privacy. As an effort to guarantee human rights protection, tapping as a part of The Interception of Communication Bill arrangements must be following the principles of human rights restrictions. Some of the anomalies in The Interception of Communication Bill appear in vague forms and open up the broad ways of potential violations of individual rights. For this reason, the principles of legality and prudence as a form of control over government actions need to offset the urgency of tapping. Data collection methods use discussions and interviews to enrich and test secondary data findings. This research stipulates that The Interception of Communication Bill use tapping as an induced instrument in criminal law enforcement. At the same time, tapping is regulated regardless of the readiness of the legal apparatus; this naturally raises technical problems in the matter of implementation and opens the door to abuse of authority. Furthermore, based on the need for comprehensive regulation, it is necessary to look at a comprehensive regulatory scheme in the legal system. The functional control that is in line with the tapping mechanism needs to look at the character of the Indonesian criminal justice system.

Abstract

Pemberian konsesi oleh pemerintah kepada investor telah menimbulkan banyak konflik pertanahan antara investor-investor pemegang izin, lisensi ataupun konsesi dan masyarakat hukum adat. Data konflik yang telah dicatat oleh Komisi Nasional Hak Asasi Manusia, Aliansi Masyarakat Adat Nusantara maupun Sawit Watch telah mencapai 500-800 kasus konflik tanah antara investor-investor tersebut dan masyarakat hukum adat. Tehadap konflik-konflik tersebut Mahkamah Konstitusi Indonesia kemudian telah mengeluarkan putusan yaitu dalam Putusan Mahkamah Konstitusi No. 35/PUU-X/2012 yang memutuskan bahwa eksistensi hutan adat tidak lagi masuk sebagai bagian dari hutan negara. Artinya Pemerintah harus mengakui eksistensi tanah adat bukan merupakan tanah negara. Menjadi pertanyaan adalah bagaimana kebijakan pemerintah dalam memberikan izin konsesi kepada para investor yang akan mengelola sumber-sumber daya alam dan mineral di atas tanah adat dengan tetap menghargai hukum adat setempat. Penelitian penulisan konseptual ini adalah normatif yuridis dengan pendekatan teori yang dilakukan oleh Lon L. Fuller, yang menyatakan bahwa hukum tertulis yang tidak didasarkan pada hukum adat yang telah mengalami saringan, tidak akan mempunyai basis sosial yang kuat dan menjadi hukum yang tidak efektif serta mengakibatkan merosotnya wibawa hukum. Hasil kajian ini diharapkan pemerintah yang diberikan Hak Menguasai Negara dapat melakukan kewenangannya sesuai konstitusi khususnya dalam membuat kebijakan pemberian konsesi pemanfaatan sumber daya alam di atas tanah adat kepada investor, tanpa menimbulkan konflik hukum dengan Masyarakat Hukum Adat.

Abstract

According to the sharia point of view, sharia capital market is muamalah product. Capital market transactions are allowed as long as it does conflict with the terms outlined by sharia. The rapid development of Indonesia sharia capital market results in the increasing number and variety of potential legal problems. It takes two legal efforts in strengthening the legal framework for sharia capital market. First, preventive measures to minimize the legal issues occurrence, such as the establishment of islamic law regulations in order to produce stability and good atmosphere of sharia capital market law enforcement. Second, efforts in sharia capital market mediation which is done through support the religious court as the only judicial institutions having the absolute authority in resolving sharia capital market civil cases. We need to increase the judges and religious courts officials competencies, make guidelines, jurisprudence and the references of sharia capital market dispute resolution in Indonesia.Keywords: legal framework, sharia capital market, civil dispute, religious court

Press is manifestation of public soverignty to the power. Press control function covers critic, analytic, and information to the public, so all the activities which are from branches of power based on the public wish and hope. Freedom of press is limited by the press law and code of conduct. The freedom of press can not be used for humaliation, harassment, or interference of judicature process. Abstract

Regulations under Laws which is the output of political and bureaucratic processes need to be supervised with a review mechanism by judicial power. Supreme Court as a judicial body have an authority to conduct the judicial review. The issue of the effectiveness procedures for judiical review regulation under law in the Supreme Court became the main topic of this research. This research is conducted through normative research methode, descriptive by studied legislation and other relevant library materials. The study concluded that the regulation and implementation for the judicial review application in the Supreme Court do not support the principles of transparency and accountability. Therefore, it is necessary to make revisions to the Supreme Court Regulation No. 1 Year 2011 on the Rights of the Judicial Review. Abstract

Countries agreement contained in an international agreement in the form of bilateral agreements, regional and multilateral agreements that are binding on the parties and a law for that entered into an agreement (pacta sunt servanda). International agreements that have been agreed and validated in a ratification by a country, then the agreement is valid and binding upon all be a source of law for the enforcement of law in making decisions. This is true also in Indonesia. Any international agreement that has been followed by Indonesia, which is contained in a ratification requirement or not, still have the force of binding for both parties. Abstract

Masalah arbitrase merupakan salah satu isu hukum yang cukup aktual dan menarik untuk dibicarakan, karena memiliki peran penting dalam kaitannya dengan dunia bisnis yang semakin berkembang pesat akhir-akhir ini. Dalam dunia usaha dan lalu lintas di bidang perdagangan, baik di tingkat nasional maupun internasional, para pelaku usaha dalam kontrak bisnis mereka umumnya lebih menyukai lembaga arbitrase dari pada lembaga peradilan dalam menyelesaikan sengketa bisnis yang terjadi di antara mereka, sehingga penggunaan lembaga arbitrasepun semakin populer dan meningkat jumlahnya. Suatu sengketa bisnis yang diajukan oleh para pihak melalui lembaga arbitrase seperti halnya pengadilan selalu diakhiri dengan putusan, dan putusan tersebut harus pula dapat dilaksanakan atau dieksekusi. Suatu putusan, tidak ada artinya jika tidak dapat dilaksanakan. Akan tetapi kerapkali terjadi, meskipun putusan sudah ada, pihak yang kalah atau termohon eksekusi tidak mau melaksanakan putusan arbitrase secara sukarela atau dengan iktikad baik (in good faith). Dalam hal yang demikian, maka atas permohonan pihak yang menang atau pemohon eksekusi, Ketua Pengadilan Negeri dapat melaksanakan putusan arbitrase tersebut secara paksa (execution forcee).The arbitration problem is one of the legal issues that are quite actual and interesting to research because it has an important role in rapid business growth. In national or international levels business and trade, the stakeholder in their business contracts generally prefer arbitration agencies rather than judiciary institution to resolve business disputes, so the need of arbitration institutions is popular and increased in number. A business dispute filed by the parties through arbitration, as well as the court, always ends with an award, and the final decision must also be executed or executed. An award will become meaningless if it can not be implemented. But often, even if the verdict already exists, the losing party or the executioner will not commit arbitrary decisions voluntarily or in good faith. In such cases, at the request of the victor or the execution applicant, the Head of the District Court may execute the arbitration ruling by force (execution forcee).

Abstract

This paper aims to learn how the Qanun of Aceh, particularly Qanun No. 4 on Mukim and Qanun No. 5 on Gampong Government enforce Gampong as a government body. It further compares the hierarchical relationship between the qanun and the higher regulations in Indonesia such as Village Government Act No. 32 of 2004, Privileges of Aceh Act No. 44 of 1999, Special Autonomy No. 18 of 2001 and Aceh Government Act No. 11 of 2006. The study found that the Qanun integrates Acehnese identity coupled with the Islamic values into the Gampong institution. The Qanun on Gampong Government, in fact, does not negate any higher regulations in the Indonesian constitution. The principle of decentralization implemented post-Orde Baru requires a massive change in the government system in Indonesia from the centralized system of local state government, to local self-government and finally the decentralized system of the local community. The Qanun on Gampong government is in line with the local community spirit due to greater public participation channeled through Reusam Gampong. Reusam Gampong is the public aspiration, and its application shall not conflict with the higher regulation. In its cultural manifest, Resuam Gampong is an instrument that promotes the marriage between culture and religion into a single government body.

Abstract

AbstractThe problem of judicial review of regional regulations in the Supreme Court is a serious academic and practical issue that needs to be resolved after the issuance of the decision of the Constitutional Court Number 137 / PUU-XIII / 2015. There are two problems in this paper, first, the legal implications of the Constitutional Court Decision Number 137 / PUU-XIII / 2015 on institutional and legal procedures for judicial review of regional regulations in the Supreme Court, secondly, how is the concept of the Supreme Court judicial review carried out through renewal of procedural law Trial Judicial Review in the Supreme Court? Based on the discussion above, we can conclude two things, first, the legal implications of the Constitutional Court Decision Number 137 / PUU-XIII / 2015 on the institutional and legal procedures for judicial review of regional regulations in the Supreme Court are the stronger and increasing authority of judicial review in Supreme Court. This decision ended the dualism of review of local regulations from judicial review by the Supreme Court and executive review of regional regulations by the Ministry of Home Affairs to only a judicial review by the Supreme Court, also potentially increasing the number of cases of judicial review in the Supreme Court. Second, the concept of the implementation of a judicial review by the Supreme Court is carried out through legal renewal of the judicial review proceedings in the Supreme Court by including several important substances, related to hearings that are open to the public, the existence of a preliminary examination, hearing, verdict and decision making that are more open and fair.Keywords: Regional Regulation, Judicial Review, and Reformation  ABSTRAKProblem judicial review Perda di Mahkamah Agung menjadi persoalan akademik dan praktikal serius yang perlu dipecahkan pascakeluarnya putusan Mahkamah konstitusi Nomor 137/PUU-XIII/2015. Terdapat dua masalah dalam tulisan ini, pertama, implikasi hukum Putusan Mahkamah konstitusi Nomor 137/PUU-XIII/2015 terhadap kelembagaan dan hukum acara judicial review perda di mahkamah agung, kedua, bagaimanakah konsep pelaksanaan judicial review perda oleh mahkamah agung dilakukan melalui pembaharuan hukum acara persidangan judicial review di mahkamah agung?. Berdasarkan pembahasan di atas maka dapat disimpulkan dua hal , pertama, implikasi hukum Putusan Mahkamah konstitusi Nomor 137/PUU-XIII/2015 terhadap kelembagaan dan hukum acara judicial review perda di mahkamah agung adalah semakin kuat dan meningkatnya kewenangan judicial review di mahakamah agung. Putusan ini mengakhiri dualisme review perda dari judicial review oleh MA dan executive review perda oleh kemendagri menjadi hanya judicial review oleh Mahkamah Agung, juga berpotensi meningkatkan jumlah perkara judicial review perda di mahkamah agung. Kedua, konsep pelaksanaan judicial review perda oleh mahkamah agung dilakukan melalui pembaharuan hukum acara persidangan judicial review di mahkamah agung dengan memasukan beberapa substansi penting, terkait sidang yang terbuka untuk umum, adanya proses pemeriksaan pendahuluan, pemeriksaan persidangan, pembuktian dan pengambilan putusan yang lebih terbuka dan fair.Kata Kunci : Peaturan Daerah, JudicialReview, dan Pembaharuan.
