Abstract

This study aimed to analyze the measures the Government in strengthening the sovereignty of Indonesia in the border region, which includes the strengthening in the areas of national defense, science and technology, as well as strengthening in the field of foreign policy. Indonesia's national sovereignty repeatedly at stake in the face of the world when it happens to border disputes with some neighboring countries, namely Malaysia, Singapore, and the Philippines. As for the problem within the borders of sovereignty is related to a claim made by Malaysia against some of the areas that became the border area between the Republic of Indonesia and Malaysia. There are at least three cases of border disputes that make the relationship between Indonesia and Malaysia heats up, the Ambalat case, Sipadan-Ligitan, and recently is happening is Tanjung Datu. Indonesia and Malaysia border disputes does not necessarily happen. Dispute Indonesia and Malaysia on the border line in the waters of Sulawesi following a change in the ownership status of the islands of Sipadan and Ligitan, the border line on the island of Borneo (Ambalat), and the latter case that has yet to be resolved by the construction of the stake by Malaysia in Tanjung Datu (West Kalimantan). It is a trigger factor rift diplomatic relations the two countries.In this regard, there needs to the appropriate strategy with regard to strengthening the sovereignty of the Homeland border region is the duty of the Government in an effort to protect the people and maintain the territorial integrity of NKRI. Some recommendations dispute resolution sovereignty border areas studied in this paper, including: (1) Establishing institutional aspects of defense and security by providing strong security of island-outer islands, (2) Establishing institutional aspects of science and technology to conduct training on the management and conservation of resources natural resources (SDA) and the building of infrastructure and transport, as well as (3) to strengthen aspects of foreign policy with increased foreign cooperation with neighboring countries, especially with Malaysia.Keywords: Dispute, Border, Defense and Security, Science and Technology,

Abstract

Sebagai konsekuensi dari melekatnya fungsi servis publik (bestuuszorg), maka administrasi negara makin dipaksa untuk menerima tanggung jawab positif dalam hal menciptakan dan mendistribusikan tingkat pendapatan maupun kekayaan, serta menyediakan program kesejahteraan rakyat. Dalam pemenuhan servis publik negara melibatkan aktor-aktor bukan negara. Dalam mewujudkan kesejahteraan rakyat kemungkinan akan  mengakibatkan pelanggaran HAM  yang merugikan   rakyat. Bagaimana menangani aktor-aktor bukan negara (non-state actors) yang bisa melanggar hak-hak asasi manusia atau menghalangi pemenuhan  HAM?HAM. Indonesia sudah mengimplementasikan beberapa prinsip Paris melalui hukum domestiknya. Bahkan pada draft KUHP sudah dituangkan beberapa pasal yang menempatkan korporasi sebagai pihak yang bertanggungjawab  secara pidana terhadap suatu perbuatan yang dilakukan untuk dan /atau atas nama korporasi, jika perbuatan tersebut termasuk dalam lingkup usahanya.  Namun dalam beberapa kasus dan sistem hukum di Indonesia belum mampu mengadili kasus-kasus yang sensitif secara politik dan menjamin standar pengadilan yang adil terkait dengan pelanggaran HAM oleh korporasi yang seringkali melibatkan aparat Negara.

Abstract

Merti Code  is one of the local culture that has a high value in the philosophical field of environmental preservation in the city of Yogyakarta, which should be preserved . Values contained in the Merti Code local culture is very noble, because Merti Code is an activity for "memerti" ( maintain ) the river environment , so that the balance of the river ecosystem to be awake . It is rarely done by people in the modern city today . Merti Code is maintained by the local cultural communities in Bantaran  Kali Code, but it also has the distinctive feature of the ceremony held each year and the tourism event in the city of Yogyakarta . For that we need a proactive attitude of the local government to protect aspects of folklore in the city of Yogyakarta, which is an asset for tourism in Yogyakarta considerable potential. Protection do not only cover the legal protection , but from non aspect law can also be given protection, in addition to fixing the Tourism Regulation relating to the follow-up to the local culture in Yogyakarta, for non-law asepek can be done with the inventory process, documentation and abstraction of the local culture . The next step is to make an agreement between the custodian Benefit Sharing with third parties that take advantage of the wealth of local culture .

Abstract

The purpose of this research is to find a benchmark in producing legislation legislative elections based on Pancasila Democracy, as well as to determine the legislative election laws in every election is always different characters, prouk laws are made in order to meet immediate needs only.This research was conducted by the research is a research library and we also do field research. In the research literature to use the means of study documents for secondary data, while the field research was conducted to obtain primary data with qualitative approach with interviews.The results showed that: the formation of Law political field is not using the model as described in figures and tables, so it is not in accordance with the concept of rule of law as mandated in the constitution (Constitution NRI 1945) and not in accordance with the ideology of Pancasila as the foundation of philosophical. Keywords: Pancasila democracy, legislative elections, benchmarks

Abstract

 Pembangunan nasional bertujuan untuk mewujudkan suatu masyarakat adil dan makmur yang merata materiel dan spiritual berdasarkan Pancasila dan Undang-Undang Dasar 1945.  Di Era Globalisasi, dimanatercipta satu kesatuan dunia yang bersifat tanpa batas di antara negara (non borderless) telah mempengaruhi hampir seluruh aspek kehidupan manusia di berbagai negara, termasuk Indonesia yang tengah melaksanakan pembangunan nasional. Globalisasi dalam bidang ekonomi  dipengaruhi oleh sistem ekonomi globalisme (liberal-capiltastic).Bagaimanakah pengaruh globalisasi dalam bidang ekonomi dan bagaimanakah implikasi hukumnya? baik aspek pembentukan maupun fungsinya.  Tulisan ini merupakan kajian yuridis normatif, yang menekankan pada analisa terhadap peraturan perundang-udangan yang berkaitan dengan bidang perekonomian. Globalisasi sangat mempengaruhi pembangunan bidang ekonomi, sebab pembangunan ekonomi yang semula mendasarkan pada Pancasila dan UUD’45, dengan berasaskan kebersamaan dan kekeluargaan telah bergeser ke arah faham Globalism yang mendasarkan pada Liberlism dan Individualism.  Pengaruh tersebut telah berimplikasi pada pembentukan hukum bidang ekonomi, dimana seluruh peraturan perundang-undangan (hukum) di bidang ekonomi (Hukum Ekonomi) telah mendapat pengaruh dari faham liberalisme/kapitalisme. Hukum menjadi berfungsi sebagai alat atau sarana untuk mengekploitasi Sumber Daya Alam dan Sumber Daya Manusia, guna mendapatkan keuntungan ekonomi secara individual, dengan mengesampingkan kepentingan bersama bangsa dan negara.
