Abstract

AbstractContract is an agreement made by the parties in a written form. Agreement is an act thatbinds one person or more to one or more persons. The results of this agreement is a legal relationshipbetween the parties, which includes the existence of rights and obligations. Contract usually containsby the rules of insistence or known as force majeur (overmacht). The rules of force majeure is due toprotect the debtor when carrying out its obligations to the creditor an event that occurs outside theauthority of the party concerned. Force majeure can be in the form of earthquake, fire, flood,landslide, war, military coup, embargo, epidemic, and so on. During the corona pandemic which iscurrently struck out whole of the world, it certainly has an impact on the implementation of businesscontract. This study examines about force majeure in an agreement that occurred during the coronavirus pandemic cannot automatically be used as a reason for canceling business contract, but can beused as a way to negotiate in canceling or changing the contents of the contract.AbstrakKontrak merupakan perjanjian yang dibuat oleh para pihak dalam bentuktertulis. Perjanjian adalah suatu perbuatan yang mengikat antara satu orang atau lebihterhadap satu orang atau lebih. Peristiwa tersebut mengakibatkan suatu hubunganhukum antara para pihak, yang di dalamnya mencakup adanya hak dan kewajiban.Dalam suatu kontrak biasanya berisi mengenai pengaturan keadaan memaksa atauyang dikenal dengan istilah force majeur (overmacht). Pengaturan atas force majeur ini adakarena untuk melindungi debitur manakala dalam menjalankan kewajibannya kepadakreditur terjadi suatu kejadian yang berada di luar kuasa pihak yang bersangkutan.Keadaan memaksa atau force majeur dapat berupa gempa bumi, kebakaran, banjir,tanah longsor, perang, kudeta militer, embargo, epidemik, dan lain sebagainya. Dalammasa pandemi corona yang saat ini sedang melanda seluruh belahan dunia tentunyaberdampak pada pelaksaan suatu kontrak bisnis. Kajian tulisan ini menelaahmengenai keadaan memaksa atau force majeur dalam suatu perjanjian yang terjadidalam masa pandemi virus corona tidak dapat secara otomatis dijadikan alasanpembatalan suatu kontrak bisnis, namun dapat dijadikan jalan untuk bernegosiasidalam membatalkan atau mengubah isi kontrak tersebut.Kata kunci: force majeur, keadaaan memaksa, kontrak, perjanjian.

Abstract

Pre Project Selling is a sale before the project is built where the property being sold is just a picture or concept. This concept of marketing has become a trend in the modern era, especially for developers. The principle of freedom of contract in an agreement is a must-have foundation in the case of an agreement in a pre-project selling transaction. In consumer contracts made in standard written form prepared in advance by the developer. This means that all terms and conditions are made by the developer himself, so the consumer will only do so need to approve or reject the contract without the ability to change or add anything to PPJB content. The agreement generally does not consider enough the interests of other parties so that it is being questioned whether it still gives freedom to consumers. The absence of rules regarding Pre Project Selling in the applicable laws and regulations makes controlling consumer protection not optimal. The Government needs to make regulations on this matter.

Abstract

Anak merupakan anugerah yang harus dilindungi oleh negara, masyarakat, keluarga dan semua pihak. Hal ini penting dilakukan mengingat anak merupakan penerus kehidupan dan peradaban. Itulah sebabnya anak perlu dibekali dengan beragam kemampuan ilmu, iman dan akhlaqul karimah. Sayangnya karena anak dalam berbagai situasi, ternyata sering tidak aman dari berbagai macam ancaman kejahatan. Parahnya karena predator anak berasal dari lingkungan eksternal dan internal, bahkan tidak jarang predator anak diperankan oleh orang yang terdekat dengan anak itu sendiri. Ironisnya karena meski sanksi hukum yang diancamkan oleh peraturan perundang-undangan terbilang berat bagi pelaku kejahatan seksual terhadap anak, namun efek jera tak juga surut. Tak salah jika akhirnya pemerintah bersama parlemen memberlakukan ancaman pidana kebiri kimia kepada para pedofilia sebagai pidana tambahan. Tragisnya karena pemberlakuan pidana kebiri kimia tersebut, menimbulkan pro kontra karena dianggap melanggar HAM, bahkan Ikatan Dokter Indonesia menolak untuk dilibatkan sebagai eksekutor dengan alasan kebiri kimia bertentangan dengan sumpah dokter.

Abstract

The family has been around for thousands of years. As the smallest unit in society, it has survived and is able to grow in line with the needs of its people. The rights and obligations of individuals in a unique (and culturally related) family make the family deserve to be an endless unit of research analysis. The conclusion of this study is the concept of Maqāṣid Syarī'ah in the family according to Ţahir Ibn 'Asyur: the family is the basis of human civilization and the orderliness of the order of society. In connection with Ibn 'Asyur's view of the application of the Maqāṣid Syarī'ah in the family: Islām Regulates the distribution of sexual desires, for there are adverse and destructive effects if not regulated. Meanwhile, custody in marriage is a form of protection against both parties. Wedding announcements generally aim to achieve two main goals: caring and mutual respect. The great concern of the Syari'ah regarding the protection of the noble is to prevent all the causes of the disputes it causes

Abstract

In the growing business world is balanced by the development of technology which is also increasingly rapid. Evidence in the field can be seen on the online trading site. The point is that in buying and selling online there is a process which then arises an agreement that is poured online or electronically. This electronic agreement if analyzed in the world of Notaries and the National Law domain indirectly also influences. The validity of the agreement is still questionable, because none of them are clearly stated in the provisions of the law. In the national law based on the law governing the deed itself, namely the Law of Notary Position and the Civil Code, the application of these provisions will not yet be clearly regulated in both laws. The principle of confidentiality that must be upheld in Article 16 of the LawJN must still be carried out even in making electronic deeds. This study uses a normative juridical method, which describes, explains and at the same time explains the notary liability in upholding the principle of confidentiality in the making of an electronic notary deed. be an authentic deed or not. Notary liability does not uphold the principle of confidentiality according to Article 16 of the UUJN, the notary must be responsible for all the contents of the deed.

Abstract

Zoning System of New Student Admission (PPDB) is a newbreakthrough in the national education system. This system isregulated by the Ministry of National Education (MONE)Number 17 of 2017 jo Number 14 of 2018. In this paper, theauthor examines the PPDB zoning problem in the constitutionallaw perspective in Bantul Regency of Yogyakarta province in2018. This paper is the result of a field research in BantulRegency, by taking example at the State Junior High School(SMPN) 1 of Banguntapan Bantul Regency. The results showedthat the implementation of PPDB in Bantul Regency was carriedout based on the Regulation of the Head of the Bantul RegencyEducation, Youth and Sports Service Number 120 of 2018 jo142 of 2018. The zoning was divided into two, namely the schoolenvironment or zoning with 500 meters (zoning ring) and widezoning districts that will be divided into several zones withadditional points. The implementation of PPDB at SMPN 1Bantul is in accordance with the regulation of MONE Number14 of 2018 by implementing zoning pathways by achievementpaths. Abstract

Garbage is a problem that is currently being a bywordin various local and long-distance media. Indonesia is evenreferred as the second largest contributor of plastic waste in theworld after China. Yogyakarta is a city with a variety ofinteresting tourist destinations as well as known as studentcities. Many migrants come and stay temporarily inYogyakarta. This has implications for the number ofmushrooming Islamic boarding schools. The number of Islamicboarding schools is of course directly proportional to theamount of waste generated. The relationship with waste,actually there has been a Yogyakarta City Regulation Number10 of 2012 which regulates Waste Management. However, theproblem is that the majority of pesantren residents aremigrants who are likely not aware of this regulation. Thisproblem which is discussed in this paper.

Abstract

Indonesia is a legal state. To ensure the continuityof the balance of relations between the citizen, legalrules are needed that aim to create order within thecommunity as stipulated in the Law. Although it hasbeen regulated in the Law, there are still manyviolations carried out by layers of society. Especially ifthere are no legal regulations. Including thephenomenon of transsexual. Along with thedevelopment of technology and the times, many peoplecarrying out sex reassignment operations for the sakeof health or just follow the trend causing pro and contraamong the community in responding to transsexual dueto the absence of laws specifically regulating whetheror not totranssexual. However, even though there is alegal vacuum, based on Article 10 paragraph (1) of LawNumber 48 Year 2009 concerning Judicial Power, thejudge may not reject the case that goes to court. So,how do judges use the law in considering theirdecisions?This type of research is library research bymaking library materials as the main data source. Thetheoretical framework used is the theory of judges'consideration which includes the theory of legalcertainty, the theory of justice, and the theory ofexpediency. While the approach theory used isnormative juridical, namely the method used in legalresearch conducted by examining existing librarymaterials.The results of this study indicate thatalthough there are no specific legal rules regardingtranssexual, the judge must be able to explore, follow, and understand legal values. Yogyakarta District Courtjudges in granting transsexual requests only considerpositive law, while Boyolali District Court judges ingranting transsexual requests not only consider positivelaw but also use Islamic law and MUI fatwa’s. In thecontext of Maslahah, both Yogyakarta District Courtjudges and Boyolali District Court judges, bothconsidered problems or benefits for applicants totranssexual. As for the transsexual request in the courtit turned out to be requested after the sex operationwas carried out so that the function of the court wasonly as a formal legality towards the practice oftranssexual. Supposedly if the law has a function as anengineering so that the behavior of citizens is orderlyand in accordance with the value of health, then thefunction of the court can assess whether thetranssexual is legally acceptable or not.

Abstract

The result of the research shows that the debtorswho use joint and several liability system agreementhave individual assurance, debtors who doinappropriate default of contract and against 1839Indonesian Civil Code article’s. The practice of legalprotection for debtors who have obligation is theprotection through 1839 Indonesian Civil Code article’s,It is not maximally work in protecting the debtors andthe practice of injustice happens between the debtorswho have obligation and the debtors who do default ofcontract. Legal efforts carried out by debtors who bearthe obligations in the joint responsibility system are tohold group members' meetings, collect directly andreport to local village officials with the aim of obtainingcompensation from debtors who conduct defaults.Keywords: Legal Protection, Debitor, Joint and SeveralLiability, and Legal Effort

Abstract

The birth of Law Number 11 of 2012 concerning theCriminal Justice System for Children (SPPA) brought a breathof fresh air in the development of child criminal law inIndonesia. Therefore Law Number 3 of 1997 concerningJuvenile Court is no longer valid. The Children's JudicialSystem Law currently adopts many international agreementswhich are expected to improve and bring about changes in thehandling of child criminal cases. The policy of penalties in theSPPA Act now pays more attention to the protection of therights of children in conflict with the law at every level ofjustice, one of which is evident from the reduction in the periodof detention of children in the judicial process from 200 days toonly 110 days. In addition, a new policy emerged in the world ofjuvenile justice, namely the concept of diversion and restorativejustice. Diversity and Restorative Justice are policies that canbe taken by law enforcers to shift the process of handlingformal cases to non-formal (without using criminal law). Withdiversion and restotarive justice policies, it is expected to beable to eliminate the adverse effects of children when enteringthe criminal justice process and the perpetrators can realizemistakes, give a sense of suspicion for the actions committedand not repeat their actions
