Abstract

The cancellation of several words in the draft of  The State Establishment which is known as Jakarta Charter, i.e. the statement says on the obligation of every muslim  to act according the law of Sharia, made great disappointment among Moslems. This fact shows that the eager of Indonesian Muslims to implement their sharia law  is extremely huge. Therefore, during the process of constitution amendment in the refor mation era, there was strong tension among representatives whether this words must be attached or not. Even though the effort also failed to remove back the words in to Pancasila, there are still some chances for hospitalization of the implementation of sharia through the local autonomywhich are getting popular today.

Abstract

The importance of a constitution, as its original character in the western countries, is to determine the limits of power authority, guarantee people rights and  regulate the government system. For that reason, the basic requirements for the process of constitution amendment is must be taken away from any short term political interests, if this the case, the results of the amendment certainly will be a non disputable national consensus. Itwill be a ‘final' amendment which passes some transparent procedures and enough sociaiization, and of course, will be far from fait accompli.

Abstract

UUD 1945 disusun dan ditetapkan dalam suasan revolusi. The founding fathers sangat menyadari bahwa UUD 1945 sebagai UUD Kilat. Proses penyusunan dan penetapan UUD lebih untuk memenuhi syarat formal dalam berdirinya negara. Pembahasan berbagai materi muatan UUD relatif lancar, meskipun kadang dilakukan secara voting. Khusus untuk hubungan negara dan agama yang  mengkristal dalam dasar negara terjadi tarik-menarik yang tajam antara kekuatan nasionalis Islami dengan nasionalis sekuler.

Abstract

Public Service Law  is not merely important, but also useful to sthrengten a good governance and clean government in Indonesia. To make the Public Service Law is an effective legal instrument, it is required to consider several steps. The first is dealt with the important effort to make theoretical review, establish a comprehensive research, identify main problems and  spesify a scope of public servant competency. The second is concerned with efforts of finding relevant arguments on public service that the Indonesian Constitusion 1945, the MPR Decree 1998, the Local Authonomy Law Number 22/1999 have indeed contributed in significant to support the Draft of Public Service Law come into existence. Finally, the Draft of PSL disfunctions to stop the abusive of power or detoumement de pouveir (corruption, collusion, and nepotism)  takes place if the Indonesian government fails to control the application of the government discretion over the rule of law.
