Journal of al-Rasῑkh, is a journal published by the department of Shariah at Darullughah Islamic Institute Waddawah Bangil Pasuruan. This journal is published twice a year, November and July. Journal Al-Rasikh is a journal that accommodates several articles either the results of research or the concept of the study of Islamic Law, especially kesyarihan Islam. The Islamic Sharia covers some of the related Shariah areas such as Law, Judge, and Religious Courts that can be observed from several disciplinary perspectives. It is expected that with the publication of Al-Rasikh journal will add to the repertoire of scholarship about the study of Islamic Studies, especially the study of sharia.

Abstract

Penelitian ini membahas tentang paya damai yang di lakukan hakim dalam meminimalisir kasus perceraian di Pengadilan Agama Manado. Adapun masalah yang diangkat dalam penelitian ini adalah, Bagaimana tugas dan wewenang hakim di Pengadilan Agama Manado? dan bagaimana upaya hakim dalam meminimalisir terjadinya perceraian di Pengadilan Agama Manado? bertujuan untuk mengetahui Bagaimana upaya damai oleh hakim dalam meminimalisir kasus perceraian serta pelaksanaanya di Pengadilan Agama Manado. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian lapangan (Field Research ), dengan mengambil lokasi penelitian di Pengadilan Agama Manado. Metode pengumpulan data yang digunakan dalam penelitian ini adalah dengan melakukan wawancara terhadap subjek penelitian. Adapun yang menjadi subjek penelitian dalam skripsi ini adalah hakim di Pengadilan Agama Manado yang menjadi hakim mediator dalam tahapan mediasi di Pengadilan Agama Manado. Hasil dari penelitian ini yaitu upaya yang dilakukan hakim mediasi dalam membantu meminimalisir perceraian di Pengadilan Agama Manado ditempuh dengan beberapa metode yaitu pertama melalui bimbingan individual yang meliputi wawancara mendalam dan mediasi satu persatu/ face to face. Kedua melalui bimbingan kelompok yang meliputi pemberian nasihat/solusi dan sharing.

Abstract

Islam is a religion that upholds the rights and obligations of all human beings and cares for all the aspects needed in life. Some of the most important aspects of life that must be fulfilled are the distribution of libido properly and in accordance with the provisions of applicable norms. This is where Islam nenata and strictly regulates the concept of marriage. As for the ins and outs of marriage, especially regarding the boundaries of blood marriage or close relatives, the researcher specializes in the conception of Imam Nawawi's perspective as the main reference for research, especially in the context of the consequences of the marriage law and what is the status of the inheritance rights of the children resulting from the marriage. Some general findings regarding this research, the majority of the Ashabul Mazdhab found that as long as there was no intentional element, the marriage was classified as wath' syubhat and the child resulting from the marriage was a tabi' child, namely obtaining full inheritance rights from both parents. Based on Imam Nawawi's perspective, the consequences of inbreeding marriage are grouped into several points: if there is an intentional marriage the two are fasid and both are punished with death and their property is confiscated as is the law of the origin of adultery against a mahrom, if it is based on mutual ignorance both of them are punished with wath' syubhat, but if one of them Among them there are those who hide the truth, so for them they are killed and their property is confiscated, while the status of children's inheritance rights follows the marital status of their parents.

Abstract

This research discusses the slaughter of broiler chickens according to the rules that have been regulated by the Religious Shari'a, especially for adherents of the Imam Syafi'i school of thought. Moreover, Indonesia is a country where most of the people are guided by the Imam Syafi'i School. The research method used is descriptive qualitative research, namely data collected in the form of words, and pictures, not numbers. In the process of data analysis, the researcher used descriptive analysis by presenting data related to the Syafi'i school of thought regarding the slaughter of broiler chickens. In carrying out the slaughtering process, the person who slaughters must be a Muslim who is rational and has reached puberty or a mulatto and all the slaughtering processes are following the provisions and regulations of Shari'a law. And if it is not slaughtered following the regulations of the Shari'at law, then the animal is unlawful for consumption and is considered carrion because according to the Syafi'i School, animals that are haraam for slaughter are animals that are slaughtered by mentioning a name other than Allah's name or without mentioning it. The conclusion is that from the perspective of the Syafi'i School, it is permissible for a chicken to be slaughtered to be halal, just two jugular veins, namely hulqum and mari', are considered halal.

Abstract

This research discusses the process of customary events that occur in Lombok about marriage, namely merariq marriage or elopement that is ingrained and difficult to change, and disni discusses how to overcome this custom so that the marriage is in accordance with the shari'a that has been determined in Islam in accordance with the shafi'iyah madzhab. This study would like to reveal the marriage traditions Merariq in Kampung Arab Ampenan Lombok and Know the Practice integration of religion and marriage customs merariq in Kampung Arab Ampenan Lombok. The type of research used by the authors in this study is qualitative research. Data were collected using inteinterviews, observation, and documentation techniques that took place at the crime scene. Data analysis techniques consist of data reduction, data model and, conclusion verification. The results of this study show that this merariq marriage process has indeed become a custom and generation from the ancestors with a sacral customary process and must be carried out according to predetermined rules that do not violate predetermined norms. The result of the perspective of the madzhab shafiiyah or in the religion of marriage is sunah Rasulullah then it should be done with the conditions that have been established by Shari'a so that in the implementation of the Marriage merariq does not deviate from the shari'a and customs that have been running in the middle of the community
