Welfare State Jurnal Hukum merupakan jurnal ilmiah yang diterbitkan secara berkala oleh Program Studi Ilmu Hukum Fakultas Hukum Universitas Islam Jember. Welfare State Jurnal Hukum dibentuk bertujuan untuk menjadi sarana yang efektif dalam upaya meningkatkan budaya penelitian dan publikasi karya ilmiah bagi akademisi dan praktisi hukum yang sesuai dengan standar mutu nasional. Abstract

Advances in information and communication technology have accelerated the use of digital contracts in cross-border commercial transactions, raising legal challenges regarding choice of law and jurisdiction. This study examines the nature of choice of law and jurisdiction in cross-border digital contracts within the Indonesian legal system using a normative legal methodology with a statutory and conceptual approach. The findings indicate that Indonesian law has recognized the principle of party autonomy in international electronic contracts through Article 18 of the ITE Law; however, its effectiveness is limited by mandatory legal norms and public policy. Therefore, clear and balanced contractual clauses are necessary to ensure substantive legal certainty in cross-border digital transactions.

Abstract

Delegation of authority through delegation and mandate mechanisms constitutes a strategic instrument in public administration to support the effectiveness and efficiency of public service delivery. This study aims to analyze the practice of authority delegation within government institutions and examine its juridical implications for accountability and the quality of public services. The research employs a normative juridical approach by reviewing statutory regulations and their practical implementation. The findings indicate that although the regulation of delegation and mandate has been normatively established in Law Number 30 of 2014 concerning Government Administration, its implementation still faces various challenges. The primary issues lie in the unclear distinction between delegation and mandate, as well as the ambiguity of legal accountability. Furthermore, the use of mandates without substantive transfer of responsibility leads to delays in public service processes. Weak supervisory mechanisms over the delegation of authority also contribute to decreased efficiency and responsiveness. Therefore, there is a need for clearer technical regulations and the strengthening of government officials’ capacity to ensure that the delegation of authority is carried out in an accountable, effective manner and in accordance with the general principles of good governance.

Abstract

This study aims to analyze the structural barriers that hinder the optimization of village government authority within the framework of decentralization as stipulated in Law No. 6 of 2014 on Villages, specifically Articles 18–20. Normatively, villages are granted the authority to regulate and manage their own interests; however, in practice, this has not yet been fully realized. This study employs a normative legal research method using the statutory approach. Additionally, it utilizes the analytical approach and the historical approach. The research results indicate several structural obstacles to the optimization of authority, namely: (1) low understanding among village officials regarding the concept of village authority; (2) an inability to formulate Village Regulations (Perdes) based on community potential and needs; (3) weak coordination between levels of government; (4) strong intervention by local governments in village affairs; and (5) a tendency toward re-centralization.This study contributes to a critical understanding of decentralization practices at the village level and recommends strengthening institutional capacity and reformulating the relationship between local governments and villages. Additionally, legal and technical assistance is needed in drafting Village Regulations so that villages can exercise their authority independently and accountably.
