In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. Abstract

ABSTRACT: This article aims to explain the role and function of NAD regional police in the law and order function in the specific autonomy in Aceh Province. NAD regional police not only responsible in the national law enforcement, but also responsible in the islamin law enforcement (Islamic Law) as a implementation specific autonomy consequency in Aceh Province. Abstract

ABSTRACT : Berdasarkan Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh, dalam Bab XII dan XIII diatur tentang Lembaga Wali Nanggroe dan Lembaga Adat. Pasal 98 Undang-undang ini menyebutkan lembaga adat berfungsi dan berperan sebagai wahana partisipasi masyarakat dalam penyelenggaraan pemerintahan Aceh dan pemerintahan kabupaten/kota di bidang keamanan, ketentraman, kerukunan dan ketertiban masyarakat. Pada ayat berikutnya dalam pasal ini, menyebutkan tentang penyelesaian masalah sosial kemasyarakatan secara adat, ditempuh melalui lembaga adat. Lembaga Adat seperti yang disebutkan di atas, meliputi : Majelis Adat Aceh, Imeum Mukim atau nama lain, Imeum Chik atau nama lain, Keuchik atau nama lain, Tuha Peut atau nama lain, Tuha Lapan atau nama lain, Imeum Meunasah atau nama lain, Keujruen Blang atau nama lain, Panglima Laot atau nama lain, Pawang Glee atau nama lain, Peutua Seuneubok atau nama lain, Haria Peukan atau nama lain dan Syahbanda atau nama lain. Dalam pasal 99 Undang-undang Pemerintahan Aceh ini, disebutkan bahwa pembinaan adat dan adat istiadat dilakukan sesuai perkembangan keistimewaan dan kekhususan Aceh yang berlandaskan pada nilai-nilai Syariat Islam dan dilaksanakan oleh Wali Nanggroe. Selanjutnya disebutkan, bahwa penyusunan ketentuan adat yang berlaku umum pada masyarakat Aceh dilakukan oleh lembaga adat dengan pertimbangan Wali Nanggroe. Untuk lebih lanjut, hal diatas diatur dengan qanun tersendiri. Kebutuhan manusia akan keteraturan melahirkan adagium “Ibi Ius Ibi Sociales”, artinya dimana ada masyarakat di situ ada hukum. Adagium ini juga menunjukkan bahwa setiap masyarakat mempunyai hukum tersendiri yang dapat saja berbeda dengan masyarakat lainnya, sesuai dengan filosofi yang dianut oleh masyarakat tertentu. The Existence of Customary Law in Special Autonomy

Abstract

ABSTRACT: Increased attention to the problem of efficiency and equity in the provision of medical equipment and limited people's choice to make health care reform the health sector become an important agenda in many countries. Although health policy implications into the discourse of prominent intensity in the academic literature, however, health policy implications are not commonly found in developing countries. It is difficult because of the exchange balance (trade off) between on the one hand the efficiency and equity on the other side. Decentralization became a kind of necessity, the sine qua non, in connection with the idea of democratization in the administration of state power. Decentralization is one of the pillars of constitutionalism is the idea of power sharing in a vertical / spatial, but on the other hand, decentralization / autonomy turns out to complicate the implementation of the functions and duties of government in general and specifically in health problems (if not based on an institutional Virtue) for the government and the regions. Policy and Health Issues in the Context of Regional Autonomy

Abstract

ABSTRACT: This research is to investigate and evaluate the implementation of special autonomy as it is regulated in the act No. 11, 2006 on the Government of Aceh. Data far this research was gathered by library resources, such as primary, second, tertiary law resources. Field study by interviewing some parties who were related this research was done in order to support secondary resources. The research findings show that the special autonomy in Aceh did not effectively implementation yet, this factor was caused by procedures of implementation (peraturan pelaksanaan) was not fulfilled by the center government. Special Autonomy Implementation in Province Aceh based on the act Number 11 of 2006

Abstract

ABSTRACT: This research aims to explain the percentage of the contribution of Regional Own Revenues to Local Government Budget. In every establishment of new autonomy region, it is assumed that it would make the community prosperous by exploring and using all available resources. Apart from that, this research also aims to describe the steps that have been taken by the governments in improving Regional Own Revenues. The research finds that the realization of the budget in 2006, 2007 and 2008 shows that the percentage of such contribution to local government budget is very little compared to the contribution comes from other sources. As a result, the income of such areas is mostly depended on the budget given by central government through the balancing budget known as the General Allocation Grant. According to the data of the realization of Regional Own Revenues for the Local Government Budget in 2006, 2007 and 2008, there was no district or municipality which the contribution higher than 10%. The average contribution during the years had been 5.04%. Ideally, all local government budget especially the regular budget, should be similar to the Regional Own Revenues. This lack of contribution indicates that such local governments were really strongly depended on central government in terms of regular budget and budget for development through the balancing budget. In other words, it could be said that the local governments that are unable to balance between the regular budget and the Regional Own Revenues do not deceive to be called as autonomy governments.        The Contribution of Regional own Revenues as a Success Indicator of Regional Autonomy’s Implementation

Abstract

ABSTRACT: This research to present whether economic democration as Stated in the 1945 Constotution, Article 33, has been able to be operationalized in to the Qanuns of Aceh for developing production athmosphir. This research refers secondary data, such as primary, secondary, tertiary resources. However emperical data was also used for quiding analysis of the research. Research finding shows that the effort of developing production athmosphir in case of the special authonomy in Aceh through regional and procedures regulation was not effectively achieved. This was indicated by unability of Aceh Government in constructing legislations product either for implementing obligation affairs or section of choices as there were mentioned in law Number 11, 2006 on Government of Aceh. Abstract

ABSTRACT: Penananaman modal mempunyai arti penting dalam pembangunan ekonomi suatu bangsa. Penanaman modal yang mudah dan murah merupakan idaman dan kebutuhan yang diidamkan oleh penanam modal. Dalam perjalanannya, penyelenggara penanaman modal di Indonesia dapat dilihat dan dibedakan pada sentralisasi penyelenggara penanaman modal dan desentralisasi penanaman modal. Sesuai dengan semangat reformasi, yaitu kehadiran otonomi daerah, dimana pemerintah daerah diberikan kewajiban dan kewenangan untuk mengatur dan mengurus urusan masyarakat dan pembangunan di wilayahnya. Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal yang lahir pada era reformasi, seyogyanya memuat materi yang sesuai dengan semangat reformasi. Abstract

ABSTRACT: Article 165 verse (2) of Law Number 11 on Governing of Aceh states that the Government of Aceh and the government of district and municipality based on its authority may provide license related to investment, both domestic and foreign, by reference to national standard operational procedures. Article 165 verse (5) adds that further stipulations concerning the license will be regulated in local laws (qanun). For this purpose, the Aceh Qanun Number 5 of 2009 on Investment has been promulgated. However, there are still legal obstacles in developing both domestic and foreign investment in Aceh. The purpose of this review is to understand and elaborate several stipulations in central government legislation and regulation which are potentially hindrance the investment in the Province of Aceh and also to understand and elaborate several  stipulations in provincial government legislation and regulation which are potentially hindrance investment in Aceh. Data for this review were obtained through juridical legal research. Besides, as additional, researcher/reviewer also conducted interview with informants. The finding shows that stipulations in legislation and regulation of central government which are hindrance investment can be found in various sources  including UUPM, UUKPB PBS, UUPT, UUK, UUKeh., UUP, UUPAg, and Permenkeu. Whereas, stipulations in provincial government legislation and regulation which are hindrance investment can also be found in various sources including QAPM, QPK, QPPK and QPPSDKP. Special Autonomy in Investment and Related Legal Issues

Abstract

ABSTRACT: This article aim is to describe any considerations that form the background done amendment toward the act Number 22 of 1999 and explains regarding the development current authonomy concept and its relation to the dynamic of regional people needs, especially under the act Number 32 of 2004. Through the study shows that the main consideration promulgating the act Number 22 of 1999 is caused many changes in social, and political aspect in the community life, beside that the present of this act also as an effort in responding regional area needs. It occured caused available independent and innovation challenge under impleneted decentralization in regions area. Beside the impact emerged in the act Number 22 of 1999 aplication as the background enacted revision toward this act, the revision challenge to this act emerged in the global perspective caused strategic, in which the economic globalisation and free trade which challenge competitive efisiency of the regional people. Therfore, the changes stipulation of the autonomy issue from day to day as stated above is concreat evidence that exist the dynamic of regional people needs move away routinely. This fact must be noted by the law maker and other related stakeholders so that in law making process must be sensitive and carefull in overseeing the dynamics. For the future, Expected, every single law level in relation to autonomy issue can adapting with the regional people needs and globalization factor.               Autonomy Spirit and Regional Needs
