Jurnal Hukum & Pembangunan (JHP) is one of the oldest published law journals in Indonesia. Published in 1971 by the Faculty of Law, Universitas Indonesia originally titled "Hukum & Pembangunan". JHP adopts a double-blind peer review policy, and focused on various subdisciplines of the legal science, among others: Basic principle of jurisprudence Private law Criminal law Procedural law Economic and business law Constiutional law Administrative law International law Law and society In addition to these fields, JHP also accepts texts covering topics between law and other scientific fields such as legal sociology, legal anthropology, law and economics, and others. Published 4 (four) times a year in March, June, September and December. Each issue contains 15 articles, both conceptual articles and research articles. JHP is published in Indonesian, but an English text is also accepted.

Abstract

This article evaluates the Environmental Protection and Management Law (UUPPLH) as amended by the Omnibus Law on Job Creation (UUPPLH-Ciptaker) and its implementing regulations. The evaluation uses the normative framework of the principle of non-regression to assess whether the provisions of the UUPPLH-Ciptaker and its implementing regulations represent a setback compared to the legal conditions prior to the enactment of the Omnibus Law. This paper argues that the changes introduced by the UUPPLH-Ciptaker indicate several regressions in Indonesia’s environmental law, particularly in the following areas: a) the weakening of provisions on Environmental Impact Assessment (AMDAL) and Environmental Management and Monitoring Efforts (UKL-UPL); b) the weakening of public participation in AMDAL-related decision-making; c) the replacement of environmental permits with environmental approvals, which results in uncertainty regarding the nature of this instrument—whether as an object of administrative dispute, supervision, or administrative sanctions such as suspension and revocation; d) setbacks in clarity regarding administrative supervision and sanctions, especially in relation to environmental approvals, technical approvals, and what is referred to as PB-related-to-PL; e) the dismantling of strict liability, particularly through Government Regulation No. 22 of 2021; and f) unnecessary decriminalization and conflicting formulations of criminal provisions. If sustainable development remains a goal of national development, the non-regression principle requires that the UUPPLH be removed from the scope of the Omnibus Law.

Abstract

The idea of implementing asymmetric regional elections (Pilkada) in Indonesia is not a new concept. However, to date, there has been no effort to provide a design for the implementation of Pilkada in an asymmetric manner, considering the specific needs of each region and its alignment with the 1945 Constitution. This article aims to implement Pilkada in an asymmetric manner by first mapping the asymmetry models of each region based on their specific needs. This research uses a doctrinal and socio-legal approach. The results of this research indicate a need to implement Pilkada asymmetrically in Indonesia. This urgency arises due to issues such as vote-buying, horizontal conflicts, electoral fraud, manipulation of results and processes, the lack of neutrality among State Civil Apparatus (ASN), and various other problems that characterize the implementation of Pilkada in multiple regions. The implementation of asymmetric Pilkada is carried out by first mapping the region's needs. There are four options for models of asymmetric Pilkada: political asymmetric Pilkada, special administrative asymmetric Pilkada, general administrative asymmetric Pilkada, and political-administrative asymmetric Pilkada. In the classification of these models of asymmetric Pilkada, the general administrative asymmetric Pilkada and political-administrative asymmetric Pilkada derive their asymmetry based on the Human Development Index (IPM) and the financial capacity of the region. Regarding the constitutionality of asymmetric Pilkada, there are three primary considerations: First, asymmetric Pilkada can strengthen the idea of a unitary state, given the consideration that the unitary state practiced in Indonesia involves aspects of asymmetric decentralization, of which asymmetric Pilkada is a derivative. Second, the democratic element of implementing Pilkada remains guaranteed, as the interpretation of democracy does not limit itself to the form of direct Pilkada alone. Third, the implementation of asymmetric Pilkada does not contradict the principle of "direct" as stated in Article 22E of the Constitution NRI 1945, since the original intent of this principle is meant to apply to the entirety of elections.

Abstract

The rapid advancement of information technology has intensified the risks of personal data breaches and violations of privacy rights. Although Law Number 27 of 2022 on Personal Data Protection (PDP Law) has established a comprehensive legal framework for personal data protection in Indonesia, its effective implementation remains constrained by the absence of the Personal Data Protection Supervisory Authority (PDP Authority). This institutional absence creates a structural authority vacuum that weakens preventive measures, law enforcement mechanisms, and alternative dispute resolution in personal data protection. Through normative legal analysis using Hans Kelsen’s Stufenbau Theory, Nonet and Selznick’s Responsive Law Theory, and Satjipto Rahardjo’s Progressive Law, this study argues that the establishment of the PDP Authority is a crucial institutional bridge between abstract legal norms and their concrete implementation. A comparative overview of personal data protection authorities in Thailand, Singapore, and Malaysia is employed as a supporting argument to demonstrate how preventive functions can be effectively exercised when a dedicated authority is operational. This study concludes that the urgency lies not in the lack of normative regulation, but in the absence of an effective institutional mechanism to enforce preventive data protection measures. Therefore, the establishment of an independent PDP Authority is essential to ensure legal effectiveness, prevent data breaches, and strengthen public trust in personal data protection governance.
