Abstract

For a long time, Indonesia has been facing the complexity of corruption cases. Corruption turns out to be more than just a legal issue. It is also a violation of people's economic and social rights. Poverty, significant social disparities, and overall state losses are also the result of corruption, so Indonesia must always find solutions to rampant corruption. The Follow the Money approach is one of the approaches used in Indonesia to combat corruption today. This approach also uses the main concept of the Corruption Eradication Law (UU PTPK), namely the concept of "state loss recovery" as a legal basis. The return of assets resulting from corruption in the realm of public and civil law is an important part of combating corruption in restorative efforts. Thus, it is expected that every legal source used in Indonesia can optimize the process of asset forfeiture to restore state losses caused by corruption, both in public and civil law.Keywords: Corruption; Corruption Eradication Committee; Confiscation of Assets

Abstract

The sale and purchase transactions of apartments in fact cause many problems between developers and consumers, so that the construction of apartments as the ultimate goal of providing housing is not achieved. This juridical normative research intends to examine a number of decisions regarding cases of disputes settlement over apartments’ unit transactions both through the court and outside the court. The main conclusion of this research is type of dispute over the apartments’ unit transactions (lawsuits qualification) determines the choice of dispute resolution and its consequences.

Abstract

This study examines the legal aspects of the Meikarta project's construction in Indonesia from the perspective of consumer protection. Large-scale real estate development Meikarta has drawn attention because of claims of anomalies and violations of consumer rights. This essay attempts to evaluate the legal environment around the Meikarta project by looking at pertinent Indonesian laws and regulations concerning commercial agreements, consumer protection, and real estate development. Additionally, it assesses any effects on consumer rights and recourse options for impacted parties. Abstract

The enactment of Law Number 1 of 2011 concerning Housing and Settlement Areas (the Housing Act) since 2011 raises several counter-productive potentials for the housing sector in Indonesia. There are new problems related to the application of the Indonesian National Standard and it has implications for housing developers both in terms of technical and juridical aspects, which are interesting to examine in depth. What are the possibilities faced by a housing developer if the requirements for fulfilling the requirements of the Indonesian National Standard must be met by a housing developer? How is the application of Article 32 paragraph (2) and (3) of the Housing Law when faced with realities on the ground? The normative research method is used and is intended to criticize several articles in the Housing Law regarding their implications for housing provision by housing developers with the obligation to use domestic products that must meet the Indonesian National Standard (SNI).

Abstract

In the contemporary landscape, traffic accidents stand as distressingly common events on our highways, carrying the potential to inflict significant harm on both individuals and property. Despite being frequent occurrences, traffic accidents can result in significant material and non-material losses. While the Criminal Code lacks specific regulations about traffic crimes, Law Number 22 of 2009 concerning Road Traffic and Transport (UULLAJ) addresses these issues. The research focuses on three main areas: 1) Unlawful Acts in Traffic Accidents, 2) Compensation as per Article 1365 of the Civil Code, and 3) the Settlement Process and Determination of Compensation. Abstract

Although the positions of the Supreme Court and the Constitutional Court are parallel as stipulated in Article 24 paragraph (2) of the 1945 Constitution, these two institutions are still limited by different demarcation lines of authority. However, on a practical level, there are often conflicts between the boundaries of their relationship and authority, for example related to judicial review. This polemic stems from the Constitutional Court Decision Number 34/PUU-XI/2013 which in its decision annulled “Article 268 paragraph (3) of Criminal Procedure Code. As for Article 268 paragraph (3): "a request for review of a decision can only be made once". Historically and philosophically, judicial review was born as a form of state responsibility in protecting the interests and restoring justice and the rights of prisoners who have been illegally confiscated by the state. With the Constitutional Court's Decision, judicial review can be carried out more than once, which has the potential to make the trial process protracted and not in accordance with the litis finiri oportet principle (every case must have an end). Following up on the juridical implications, the Supreme Court issued a Supreme Court Circular Number 7 of 2014 which again contradicted the Constitutional Court's Decision Number 34/PUU-XI/2013 by allowing the judicial review to be submitted only once. The purpose of this study is to describe the relevance of the Constitutional Court Decision Number 34/PUU-XI/2013 and Supreme Court Circular Number 7 of 2014 regarding the Judicial Review in the perspective of justice and legal certainty and its implications for the litis finiri oportet principle in criminal procedural law in Indonesia. Sources of legal materials used in this research are primary legal materials in the form of legislation and court decisions as well as secondary legal materials in the form of legal literature and research results.

Abstract

There are certain obstacles in implementing Desa Mandiri Concept since Covid-19 Pandemic enacted as global disaster. This article aims to explain the effort of village to become Independent as reflected in Desa Mandiri Concept. In order to explain its practice in the society, this article is based on the research conducted in Sukanalu Village. This research uses social legal methods, which is interdisciplinary in nature able to explain legal issues more meaningfully theoretically and practically explains the operation of law in the daily lives of citizens. The results of this study indicate that the synergy between the village government and the community will facilitate the sustainability of development in Sukanalu Village. The goals that were built from scratch will be realized. From the research findings, it can be seen that the ability of the village of Sukanalu is quite a lot, namely budget assistance from the central government through village funds, assistance from local governments, and having a reliable community for guarding posts and disseminating central government policies and area. Therefore, it can be seen that the village government's strategy through utilizing its capabilities has gone well in accordance with the prevailing policies in dealing with the Covid-19 Pandemic.Keywords: Desa Mandiri, Sukanalu Village.

Abstract

Mediasi penal dilaksanakan di lingkup Polres Metro Bekasi sebagai metode diversi untuk anak berkonflik dengan hukum (ABH) terkait perkara kekerasan seksual (KS). Sanksi terhadap KS yang dilakukan oleh anak tidak diatur secara khusus dalam KUHP. Untuk memberikan perlindungan terhadap ABH, maka pemerintah mengaturnya di dalam Undang-Undang Sistem Peradilan Pidana Anak UU SPPA). UUSPPA memberikan amanat untuk penyelesaian tindak pidana oleh ABH agar mengutamakan konsep keadilan restoratif melalui metode diversi. Namun dalam UUSPPA terdapat syarat untuk diversi. Hal ini bisa membuat ada perlakuan berbeda terhadap anak pelaku tindak pidana KS yang ancaman pidananya di atas 7 tahun sehingga tidak dapat melalui proses diversi. Polres Metro Bekasi menerapkan mediasi penal sebagai usaha perwujudan keadilan restoratif untuk ABH yang tidak memenuhi syarat diversi. Penelitian ini menggunakan metode yuridis empiris untuk melakukan kajian terhadap justifikasi implementasi pelaksanaan mediasi penal, yang masih belum memiliki landasan hukum kuat (baru berupa hukum in concreto jika dibandingkan dengan diversi), dalam lingkup Polres Metro Bekasi. Hasil penelitian menunjukkan bahwa mediasi penal efektif dalam menangani kasus tindak pidana KS oleh anak di wilayah hukum Polres Metro Bekasi. Polres Metro Bekasi dapat mencapai keadilan restoratif yang melindungi hak anak berhadapan dengan hukum dan hak korban dari tindak pidana KS yang terkait.

Abstract

This study examines the impact of mergers and acquisitions (M&A) on company performance in emerging markets, using Indonesia as a case study. By analyzing data from the Business Competition Supervisory Commission (KPPU), it observes a significant rise in M&A activity during the pandemic. Unlike previous research, this study evaluates both short- and long-term effects on company performance, emphasizing the role of managerial ability (MA) in M&A success. While M&A offers benefits like diversification and access to new markets, it also poses risks such as unclear goals and cultural disparities. Abstract

Humans as legal subjects have rights and obligations in the eyes of the law, having consequences in every action taken by them. The law of criminal procedure (KUHAP) in Indonesia is contained in Law No.8 of 1981, KUHAP, in Article 1 Number 21 where detention is process in the criminal justice system which aims to prevent the perpetrator of a criminal offense from escaping from the place where the perpetrator committed the criminal offense. The research analyses the application of process detention of person who has been named as suspect by investigators does not meet justice from community point of view, because the legal certainty of detention is not equally applied to the community. The case of alleged molestation committed by suspect DC in Bandung and the case of alleged premeditated murder by suspect PC. The suspects have fulfilled all the elements of detention in KUHAP, but the investigators still did not make legal efforts to detain them. The method used is a qualitative approach. Based on the results of the research, the existing detention rules in KUHAP have not evenly provided justice for the community and legal certainty, because the existing legal rules are still multi-interpretation in their application.Keywords: Detention,Investigator, Justice
