Abstract

The European Union (EU) issued a regulation on deforestation, known as the European Union Deforestation-Free Regulation (EUDR), which has caused upheaval in the global commodity industry. Starting December 31, 2020, the EUDR regulation enforces due diligence on companies placing goods linked to deforestation and forest degradation on the EU market. These goods include beef, chocolate, coffee, palm oil, rubber, soy, and timber. Under the EUDR, these seven commodities and their related products must meet requirements related to deforestation and forest degradation to be sold or exported to the EU market.According to Roscoe Pound, a legal expert from the Sociological Jurisprudence school of thought, law should be viewed as a social institution that functions to meet societal needs. He argued that the task of legal science is to develop a framework that maximizes the fulfillment of social needs so that the law can serve as a means of social change. Therefore, a legal study on the application of the EUDR to Indonesia's trade with the EU should assess whether it aligns with the principles of law formation according to Roscoe Pound's Sociological Jurisprudence perspective.

Abstract

The handling of narcotics abuse cases in Indonesia, especially those involving an expedition driver who uses drugs for work, requires special attention from the National Narcotics Agency (BNN). This study aims to analyze the process of handling narcotics abuse by expedition spires in BNN Surabaya City starting with a focus on the legal process, factors that encourage drug use at work, and the role of BNN in rehabilitation and recovery. The method used is a qualitative approach with interviews and documentation studies as data collection tools. The results of the study showed that people involved in drug abuse were often caught up in job pressures that required them to use drugs as physical and mental stimulants. BNN Surabaya City has carried out handling procedures involving investigation, rehabilitation, and legal assistance. But the biggest challenge is the lack of awareness of the dangers of drugs among workers in the transportation sector. This study provides important insights into the importance of preventive and rehabilitative approaches in overcoming narcotics abuse involving drivers.

Abstract

The main function of the state in the legal system that prioritizes the defense and enforcement of human rights, especially children's rights, is the protection of children. Because they are the future of the country, children need extra attention to reach their full potential. Referring to Article 23 Paragraph 1 of Law No. 17/2016 concerning the Second Amendment to Law No. 23/2002 concerning Child Protection (PA Law), the State, Government, and Regional Governments are obliged to ensure the protection, maintenance, and welfare of children while still paying attention to the rights and responsibilities of parents, guardians, or other persons who are legally responsible for children. Children's basic rights to life, safety, growth and development and engagement are protected by each of these devices. However, there are still other practical problems, such as limited reach and lack of collaboration between local governments. To ensure that the child protection system functions fairly, comprehensively, and effectively, the right of children of criminal offenders to obtain legal protection and the right of child victims to obtain restitution must be a top priority. Increased public awareness, institutional coordination, and law enforcement are needed to create a comprehensive and sustainable child protection system in Indonesia.

Abstract

This study aims to analyze the obstacles in implementing the integrated assessment process as a basis for determining rehabilitation or criminal prosecution for drug users, with a case study at the Surabaya City National Narcotics Agency (BNN). The integrated assessment serves as a crucial mechanism to distinguish drug abusers eligible for rehabilitation from those who should face legal prosecution. However, in practice, its implementation encounters several challenges, including procedural delays, limited human resources, and lack of coordination among law enforcement institutions. Using a juridical-empirical approach and descriptive qualitative methods, the study reveals that these barriers affect the quality of assessments, lead to inaccurate recommendations, and increase the risk of over-criminalization. The study recommends cross-sectoral training, enhanced inter-agency coordination, and improved assessor capacity to ensure the integrated assessment is conducted effectively, fairly, and in line with restorative justice principles and the recovery-oriented approach for drug users.
