Abstract

Abstract

The ceasefire between Iran and the United States does not necessarily eliminate national security threats; instead, it shifts the escalation of conflict into latent and hybrid forms. As a country with complex socio-political dynamics, Indonesia faces real risks of ideological polarization at the grassroots level and transnational terrorist threats that manifest these global sentiments. This study aims to analyze the necessary reorientation of policing strategies, shifting from a State Security approach toward Human Security through a community security model. Utilizing a qualitative method with a literature review approach, the research finds that post-ceasefire policing strategies require the strengthening of a community-based Early Warning System (EWS) and intelligence synergy between the Indonesian National Police (Polri) and the Indonesian National Armed Forces (TNI). However, the effectiveness of this strategy is vulnerable to maladministration in the management of tactical intelligence funds and the abuse of discretion. This study concludes that community security can only be achieved through policing strategies that are not only adaptive to global dynamics but also internally untainted. Strengthening institutional integrity is an absolute prerequisite to ensure that security policies do not transform into repressive instruments, but rather serve as a safeguard for social stability and national sovereignty amidst global geopolitical uncertainty.

Abstract

The escalation of geopolitical tensions between Iran and the United States consistently has transnational implications that impact domestic security stability in Indonesia. This study aims to analyze the role and strategy of the Indonesian National Police (Polri) within the framework of a responsive-defensive legal-political configuration during the global ceasefire. Using qualitative methods with a literature study approach and policy analysis, this study finds that the Indonesian National Police (Polri) plays a crucial dual role. In the responsive dimension, the Indonesian National Police prioritizes humanist policing through mass action management and cross-society dialogue to reduce ideological polarization. Meanwhile, in the defensive dimension, the Indonesian National Police strengthens security at national vital objects and cyber patrols to mitigate the threat of proxy war and disinformation that could disrupt public order. Furthermore, this study highlights the importance of operational accountability during the security alert period to prevent corruption gaps in emergency budget management. The study concludes that synchronizing an independent and active foreign policy with an adaptive public order and security strategy is key to national resilience amid geopolitical uncertainty.

Abstract

Indonesia, as a state governed by the rule of law, places the eradication of corruption as an essential part of realizing legal certainty and justice. Corrupt practices in government development projects continue to occur through various modes, one of which is the use of Commitment Fees in government construction projects. This study aims to analyze the criminal liability of perpetrators of corruption in the construction project of the Cooperative, Small and Medium Enterprises, and Trade Building through the Commitment Fee scheme based on Supreme Court Decision Number 3201 K/Pid.Sus/2023, as well as to examine the judges’ considerations in deciding the case. The research employed a normative juridical method with statutory and case approaches. The legal materials consisted of primary, secondary, and tertiary legal sources, which were analyzed qualitatively. The findings indicate that the acceptance of Commitment Fees by public officials constitutes an abuse of authority that fulfills the elements of corruption as regulated under Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption Crimes. The judges’ considerations in this case were based on the evidence presented, the relationship between the receipt of money and the official position held, as well as the existence of intentional abuse of authority.

Abstract

Corruption is a criminal act that causes state financial losses and hinders national development. The return of assets resulting from corruption often encounters obstacles when the perpetrator dies, flees, or cannot be prosecuted criminally, making the mechanism for asset confiscation based on a court decision less effective. This study aims to analyze the legal status of asset confiscation without a criminal court decision by the Corruption Eradication Commission (KPK) regarding the proceeds of corruption and its implementation mechanism in the Indonesian legal system. This study uses a normative legal research method with a statutory and conceptual approach analyzed descriptively qualitatively. The results show that the concept of Non-Conviction Based Asset Forfeiture has gained legitimacy through the United Nations Convention Against Corruption, which Indonesia has ratified, but its regulation in national law is not yet comprehensive. The authority of the KPK is still limited to tracing, confiscating, and securing assets, while permanent confiscation without a criminal verdict does not have an explicit legal basis. Current mechanisms only utilize temporary confiscation instruments, civil lawsuits, and provisions on money laundering. This study concludes that it is necessary to establish special regulations regarding the confiscation of assets without a criminal conviction to support the effective recovery of state losses while still ensuring legal certainty, justice, and protection of human rights.

Abstract

Bribery involving judges has more serious implications than corruption offenses in general because it directly affects the integrity and independence of the judiciary. This study aims to analyze the criminal liability of judges who accept bribes and the forms of punishment imposed in Decision Number 105/Pid.Sus-TPK/2024/PN Jkt Pst and Decision Number 106/Pid.Sus-TPK/2024/PN Jkt Pst. This study employs a normative juridical method using a statutory approach and a case approach. Legal materials were analyzed descriptively and qualitatively by examining the provisions governing corruption offenses and the legal considerations contained in the two decisions. The findings indicate that judges, as subjects of criminal law, are not immune from criminal liability. Criminal liability in both cases was established based on the fulfillment of the elements of the criminal offense, the defendants’ capacity to be held responsible, the existence of culpability, and the absence of grounds for justification or excuse. With regard to sentencing, Erintuah Damanik was sentenced to seven years’ imprisonment and a fine of IDR 500,000,000, while Heru Hanindyo was sentenced to ten years’ imprisonment and a fine of IDR 500,000,000. Normatively, the sentences imposed fall within the statutory sentencing range applicable to the offenses. Theoretically, the sentencing is more appropriately understood as an application of the combined theory of punishment with a predominantly retributive orientation, while still incorporating preventive objectives and the protection of the integrity of, and public trust in, the judiciary.
