Abstract

Divorce is not recognized in Hinduism, but in practice often resulting in divorce child maintenance purposes. In the result, in case of divorce then pemeliaharaan children are often in the hands of his mother without the imposition of allowance of the child's natural father. Maintenance of children due to divorce their parents according to the Law No. 1 of 1974 was in the hands of both parents even if the child is under the care of the maintenance ibunya.Hambatan children whose parents are divorced according to Hinduism economic factors, factors parents remarried, psychological factors, parental factors women are able to provide cost a living child. While efforts to address the maintenance of children whose parents divorced according to the teachings of Hinduism is to increase the role and responsibilities of parents who divorced over religious institutions such as the existence of the Hindu Association of Indonesia (PHDI) and increasing the role and responsibilities of the community and the state for the maintenance of children of divorce parents who are not able to do the maintenance of the child. Abstract

The registration of trademark done by the Directorate General of Intellectual PropertyRights was intended to obtaine legal certainty and legal protection for the right to trademark in accordance with Law No.15/2001. The registration of trademark through constitutive system (First to File) more guarantees the existence of legal certainty for the holder of right to trademark because the one who registered the trademark was given a certificate as a proof of registration and a proof of right to trademark, and at the same time, the registrant is reagarded as the first user of the trademark. The settlement of dispute on Foreign Trademark which is principally or wholly similar to the registered trademark can be carried out based on the civil, criminal and administrative approach. In terms of legal protection, in relation to the existing cases of trademark, legal protection that can be given to the owner of the registered trademark is to file a lawsuit on the cancellation of brand (trademark) considering the constitutive system followed by the Indonesian Law on Brand (Trademark) saying that legal protection is given to the first registrant of trademark. It is expected that the process of trademark registration can be simplified and shortened and the data system and publication of the Directorate General of Intellectual PropertyRights should be improved that the business practitioners will be not in doubt to register their trademarks. To give more legal protection to the holders of foreign trademarks, harmonious cooperation is needed between the government accompanied with adequate regulations of legislation, brand (trademark) inspection apparatuses (the Directorate General of Intellectual PropertyRights), law enforcement officers, community members at large in announcing the information about violation brands and entrepreneurs who will use a particular brand for their products. That, in practice, the First to File registration system can be effectively run and create the alignment of guarantees justice and expediency, because there many brands (trademarks) registered not by their actual owners. Abstract

Marriage is the rights of every  human beings, protected by religion and state. Therefore every citizen must be submissive and obedient to the rules. Law No.1/1974 on marriage states that 1) a marriage is legal if implemented in accordance with the law of respective religion and belief, 2) each marriage is registered in accordance with the existing regulation of legislation. But, in fact, still many marriages are not registered at the Office of Religious Affairs (KUA) or the Office of Civil Registration as the institution of marriage registrar. The consequence is that many unregistered marriages have inflicted problems later, if a marriage cannot be proven by showing a marriage certificate, its itsbat can be filed to the Religious Court and Muslim community members should register every marriage done to obtain legal consequences. The Judges who examine the cases of marriage itsbat should not complicate the itsbat application. The government or judicial institution through the Supreme Court should socialize the Law on Marriage and all of the regulations related to a marriage. Abstract

Patah Titi law is the disconnection of cognates between grandfather/grandmother and their grandchildren because the father or the mother of the grandchild/ren died before the testator. In the traditional culture of Gayo, the beneficiary of this Patah Titi does not receive the property left by his/her grandfather/grandmother at all, and which is more painful is that the family relationship between the beneficiary/grandchildren and their grandfather’s family who experiences Patah Titi. It is true that there is no substitution in Islamic Law, but Islamic Law does not disconnect the cognates, even the grandchildren who have lost their parents still get their parts through grant although the amount they receive is small but they still receive inheritance from their grandfather. One of the concepts of Islamic InheritanceLaw Reform is the Compilation of Islamic law widely socialized through Presidential Instruction No.1/199. The Compilation of Islamic Law in its Article 185,  gives the right of a heir who has passed away to his/her descendants who are still alive. Abstract

The fisrt conclusion is that the shift of the principles of in heritance in Malay adat in Nongsa subdistrict can he seen from the fact that the heirs in Malay community in Nngsa subdistrict have the right to receive inheritance but the priority is for the members of nuclear family (husband, wife, children) unless the heir is still single and has no child, Inheritance distribution system which used to based on faraid law changes into the inheritance distribution using the way deliberation and concencus to seek justice that receive the sama amount. The second was that the factors influencing the development of inheritance law of Malay adat in Nongsa subdistrict Kepulauan Riau province werw the significant impact of modernization on kindship relation, Islamic law compilation and jurisprudence The third was that the role of adat institution in Nongsa Subdistrict, kepulauan Riau Province was more prioritized to settle the inheritance disputes rather than through the court of lawMeaning that family relationship in Nonsa subdistrict is still very strong and the advice of adat leader and the Islamic scholars is still used as guidance in settling the problems occurred, The adat institution also plays an important role in improving the brotherhood relationship that has been damaged by dispute. Abstract

Under Law No. 28/2009 on PDRD (Regional Retribution and Tax), BPHTB (fees for acquisition of land and building rights) becomes state and local tax. It have the uncertainty of the payable tax is because Article 90, paragraph (1) point d of Law No. 28/2009 does not specify the will certificate, bequest certificate, or the deed of grant made by PPAT; it is the determinant of the payable BPHTB. The uncertainty of the amount of payable tax is related to Article 95, paragraph 4 which does not implicitly specify Perda (Regional Regulation) in regulating the reduction of BPHTB to bequest. It is recommended that article 90, paragraph (1), point d of Law No. 28/2009 on PDRD which regulates the payable BPHTB, states that the bequest should be revised to be the date it is made and signed of  the deed of acquisition of land and building rights. Meanwhile, Article 95, paragraph 4 on reducing tax in certain area (including BPHTB), which can be regulated by Perda on state and local tax, should comply with legal provisions by eliminating Article 95, paragraph (4) and amended it to Article 95, paragraph (3). Abstract

Since the enactment of Law No.28/2009 on Local Taxes and Levies has resulted in the problem in the implementation of collecting the duty obtained from the Right to Land and Building in the city of Pekanbaru. The problem occured because the City Mayor of Pekanbaru established the Local Regulation No.10/2011 on the System and Procedure of Collecting the Duty Obtained from the Right to Land and Building by doing the verification before signing the deed on the transfer of right to land and building before the Land Certificate Issuing Officer/Notary. Law No.28/2009 on Local Taxes and Levies or the Government Regulation No.91/2010 on Kinds of Local Taxes Collected Based on the Determination of Head of Region or Paid by the Taxpayer Himself has regulated that the collection of tax of the duty obtained from the Right to Land and Building should be done through Self  Assesment System and does not regulation verification. Abstract

In Minangkabau community, tanah pusaka tinggi (adat heirloom land) is prohibited to be sold or mortgaged. Mortgaging an adat heirloom land must fulfill four requirements: ‘mayek tabujua di tangah rumah’ (a corpse stretches out in the living room), ‘rumah gadang katirisan’ (Family house is leaking), ‘gadih gadang alun balaki’ (a spinster), and ‘mambangkik batang tarandam’ (striving for success). The impact of the development of the requirements for mortgaging adat heirloom lands in Agam Nagari Kamang Mudiak District has decreased since there are many of them have been mortgaged by the community. The research used judicial sociological method with descriptive analytic approach. The implementation of mortgaging adat heirloom lands in Nagari Kamang Mudiak always goes along, and its status is still there although today the National law (Article 7 of Law No. 56/Prp/1960) is in effect.  However, this National law is not used by the people in Nagari Kamang Mudiak; they only use their own adat (customary) law.   Keywords: Mortgage Condition, Land Belongs to the Property of High Heritage

Abstract

Both the Land Office and the Forestry Service have authority to handle land administration. This type of authority which exists in every region has brought about conflict which has an effect on the process of regional economic development such as what happens in Padang Lawas Utara District. A claim on a tract of land by the Forestry Service consider that it is a forest area, based on the Decree of the Minister of Forestry No. 44/Menhut-II/2005 on the Indication of Forest Area in North Sumatera Province in the area of ± 3,742,120 hectares. Along with that, the Land Office also has the right to do land administration, based on the Government Regulation No. 24/1997 on Land Registration. In 2007, Land Certificate was issued in Padang Lawas Utara District. According to SK No.24/Menhut-II/2005, the land was located in forest area. In 2012, the certificate became the collateral in PT. Abstract

Changes in Batak Adat Inheritance Laware marked by the release of the jurisprudence of the Supreme Court of Republic Indonesia No. 179 / K / SIP / 1961 on the equal rights to inherit between sons and daugthers. These changes where the son is the heir, while the daughter is not an heir. Based on the above background, it is important to conduct a study onthe effectiveness of the application of jurisprudence of the Supreme Court of the Republic of Indonesia Number 179 /K/SIP/1961.
