Abstract

A child is the world’s life ornament who becomes the parents’ pride as it is stated in Al-Quran (QS, AL-Kahfi:46), “Wealth and children are an ornament of life of the world. But the good deeds which endure are better in thy Lord’s sight for reward, and better in respect of hope”; therefore, we have to obey the command of Allah to take care, raise, and educate our children. The research was judicial normative and descriptive analytic, based on general legal theory which was applied to explain a set of other data. The theory used in the research was the theory of legal protection for under-aged children (before mummayiz), looked after by their guardian. The cancellation of the right to look after under-aged children is because the parensts are considered not legally capable so that the judge abolishes their rights, the judge appoints the priority of the family who has the rights to look after under-aged children. It is recommended that psychological factor and the security of the children who are looked after by their guardian should be considered, the Religious Court’s Ruling should be implemented according to the prevailing procedures by putting forward the principle of negotiation and consanguinity in the transferring of the rights. Abstract

It is not so easy to achieve a peaceful condition in a family life because there will always be a small problem which can become a big one between a   husband and a wife. If it happens, it will be a great effect like a divorce; therefore, it has to be solved immediately. A divorce, in turn, will eventually have an effect on children, joint property, family relationship, and so on. The role of a Notary is highly needed since the deed he has drawn up is final and conclusive and can accommodate the conflicting parties because after and before the divorce occurs they can have a deed drawn up by mentioning the joint property which will be divided evenly or not. An extra action from the court is needed in making the verdict since joint property is very complicated. The problem is that before the verdict is made, the source of data about the property, whether it has been bought during the marriage or before the marriage. By considering these data, the court can make a verdict on the case of the joint property, whether it is a real joint property or not

Abstract

Brand registration provides exclusive right and legal protection and certainty for the first owner of brand registration. Even though brand has been registered in the Directorate General of HKI; in practice, other people always imitate the brand or register a brand which has similar in substance to the previous registered brand. The problems of the study were as follows: how about the status of a registered brand which was similar in substance to the previous registered brand, how about the legal responsibility of the Directorate General of HKI on registering a brand which was similar in substance to the previous registered brand, and what attempts were made by the owner of the brand to protect him when there was a registration of a brand which has similar to the previous registered brand. Abstract

Buy and sell on a building, along with its land, in Batam, by using a Notarial deed is commonly done by foreign citizens since residence, usually constructed by developers, is based on management rights. Governmental Regulation No. 41/1996 requires foreign citizens who have residence to register their building rights as the right of use. Lack of their legal knowledge of the right and obligation in owning residence in Indonesia becomes one of the factors which cause them to lose their right of use on their residence; in this case, they have not registered the right of use in one year since the transact was done. This case can be seen in the Ruling of the Supreme Court No. 673K/pdt/2010. Every individual has the right to get legal protection and so do foreign citizens who own residence in Indonesia.  Legal protection should be in accordance with the responsibility. In general, foreign citizens consider that sale contract signed by a Notary can become evidence of full ownership of building. Actually, it has to be followed up by making sale contract before PPAT (official empowered to draw up land deeds) as the legal basis for registering the right of use. A Notarial deed is authentic evidence which is used as an analysis when there is a problem with sale contract owned by foreign citizens and with supporting document which will be used by them as evidence when they have transferred the building and its land to the other parties. Abstract

The dispute in inheritance in the Case No. 297/Pdt.G/2012/MS-BIR among the heirs occurred because of the delay in distributing it which causes the mixture of the inheritance with personal property of one of the heirs. the research showed that adat law recognizes and allows to delay the distribution of inheritance by certain reasons, but the Islamic law prohibits it because the mixture of inheritance with personal property will cause ambiguity in the inheritance, the rights of the other heirs are not in line with the Islamic law, and the legal act is legally defective in the third party. It is recommended that the Islamic society distribute inheritance by making inventory so that there will be no dispute n it. The Ruing of the Bireuen Sharia Court No. 297/Pdt.G/2012/MS-BIR has been in accordance with the prevailing rules in the Qur’an and Sunnah of the Prophet Muhammad and with the Indonesian national law. Abstract

Dalam dunia pasar modal terdapat banyak fasilitas yang ditawarkan oleh sekuritas. Antara lain margin trading dan short selling. margin trading merupakan salah satu fasilitas yang diberikan perusahaan pialang kepada investor. Dalam margin trading transaksi pembelian efek dilakukan nasabah dengan dibiayai oleh perusahaan efek. Sehingga para investor dapat bertransaksi melebihi jumlah uang yang dimilikinya. Sedangkan short selling adalah transaksi jual saham yang bersifat khusus. Kekhususan dari transaksi ini adalah transaksi jual saham dilakukan investor tanpa memiliki saham yang ditransaksikan. Namun nasabah meminjam saham tersebut terlebih dahulu dari perusahaan efek. Dalam transaksi short selling resiko terjadi gagal serah lebih besar dibandingkan transaksi jual beli umumnya. Penggunaan fasilitas ini menimbulkan pertanyaan bagaimana mekanisme dan perlindungan hukum margin trading dan short selling. Keyword : Margin Trading, Short Selling, Legal Protection

Abstract

A child is a trust given by God, therefore, he should have full attention and good care. But the birth of a baby in a family doesn’t always bring happiness, an illegitimate child will be a complex problem and cause alarm for the woman who delivers him, his biological father, and the community who live in the vicinity of the house. The rulling of the constitutional court of the Republic of Indonesia no. 46/PUU_VII/2010 has caused the problem for an illegitimated child to become apparent by the acceptance of the request for judicial review of the provision in article 43 pragraph 1 of law on marriage, related to the recognition of the illegitimate child. The consideration of the Constitutional Court in enacting the rulling is merely for the sake of the righteousness for the rights of an illegitimate child to be treated humanly and to guarantee his equal rights to the other children. Abstract

A foreign citizens cannot be ignored to be an heir as stipulated in Article 26, paragraph 3, Article 30 paragraph 2, and Article 36 paragraph 2 of UUPA the legal consequence of violating it is that the ownership will be cancelled. The result of the Case of the Supreme Court’s Ruling No. 1134 K/Pdt/2009 research shows that the procedure if signing a  will before a Notary for a foreign citizen in making a certificate should pay attention to the spa of time of the land rights by checking the identity of the foreign citizen and the other supporting documents. The list of data at the Sub-directorate of Estate in the Ministry of Law and Human Rights by giving the copy of the Will which has been made in Indonesia. The legal status of the Ownership certificate registered in the name of the defendant is recognized as the defendant’s since the land has been registered sporadically and transparent in the name of the defendant, based on the will and the man empowered to receive the will. It is also approved be the authorities such as Subdistrict Head, the National Land Board, and witnessed by the neighbors. Besides that, the defendant has changed his citizenship before the certificate is issued. The judge’s consideration in the Supreme Court’s Ruling No. 1134 K/Pdt/2009 does not give legal certainty in the administrative process of issuing the certificate. Abstract

Nominee structure is a structure resulting in a beneficiary has the power to controls the nominee, where a nominee is only as a registered owner of an object, and the beneficiary as the real owner is the one who controls, manages and earns benefits from that object. Nominee structure is often applied in the ownership of shares in a limited liability company in Indonesia. The data for this normative juridical study were obtained through documentation study in which the data obtained were systematically arranged and analyzed through a qualitative scientific logic procedure. The form of nominee shareholder structure in Indonesia is divided into direct nominee structure and indirect nominee structure. Basically the validity of a nominee shareholder structure is depends on the validity of the underlying agreement. A public notary as the competent authority who creates an authentic deed as the underlying of a nominee structure is responsible to make sure that the deed he made must comply to and does not breach the prevailing laws and regulations. It is suggested that a clear and strict regulations about the nominee shareholders should be governed in the Company Law in order to create legal certainty. Nominee shareholder structure should be allowed with special supervision and certain restrictions, considering the using of a nominee is basically indispensable in order to transact effectively and efficiently, particularly in capital markets. Abstract

Right of Management is the Right of Use given by a nation which the implementation authority is delegated partially to the rights holder. The authority includes the right to use the land for the sake of a business and the authority of handover parts of the land to a third party. The need of land in order to increase a business activity is getting higher. Therefore, a right is needed to give high authority to the right holder to plan the allocation and use of land in question of his business growth.Legal guarantee is covering status, subject and object of right of management. The guarantee of legal protection covers the security of rights holders to use the land without geting any interference or claim from other parties. This research aimed to know the implementation of the release of right of use space which was Kuala Namu International Airport’s right of management to the third party by PT. ANGKASA PURA II.
