Abstract

ABSTRACT As a new plain, a naturally emerging land is a plain with the potential and economic values to be utilized. Up to now, the explicit regulation on the control over the naturally emerging land has not yet found in the Indonesian Agrarian Law. The purpose of this study was to examine more about the control over the naturally emerging land according to the customs of local communities, the status of the control over the naturally emerging land, and the steps taken to acquire the right to land related to the control over the naturally emerging land in Rengat Subdistrict, Indragiri Hulu District.This empirical (sociological) juridical study looked at the aspect of legal application in the society or the communities’ behavior generated due to the interaction conducted based on the existing norm system. The data obtained were qualitatively analyzed to provide a clear description on the answer to the problems studied. To draw a conclusion, the result of this data analysis was process through deductive method. Abstract

ABSTRACT One of methods to of obtain a piece of land is buying and selling. Based on article 1358 of the Civil Code, buying aid selling is considered valid when the two parties have agreed on the good and the prices although the goods have not been received and paid by the buyers. In this case, the purchase agreement on the land rights wich is done with installment is used as the preliminary agreement in the practice of a Notary. The process of buying and selling by a sales agreement with installment has not yet been the action of buying and selling and valid as it is intended by the the national land act. However, it is the follow up from the legal act of the sales agreement wich is still in process because it should fulfill the requirement of transferring title, such as the object has not yet been paid off. This is commonly found in the practice of a Notary, especially in the implementation of the buying and selling process; in this case the parties concerned should be protected. Abstract

ABSTRACT Architecture is one of the rights protected in accordance with the provision of Law No.19/2002 on Copyright (known as UUHC). So far, the protection for architecture copyright has not implemented as expected. When a creation of architecture is made in a working relationship, in practice, who has the right of its ownership becomes unclear. In an architecture issue, it is hard to determine who has the right to be called the creator or copyright owner. The result of this study showed that, in Indonesia, without being registered, the copyright keeps being protected. The architects working for a company based on a working relationship are suggested to start to maximally utilize the architecture copyright given by the Law on Copyright to them. Both parties are suggested to always include the clause of architecture copyright ownership in the work agreement the made. Keywords: Status, Ownership, Copyright, Architecture

Abstract

ABSTRACT The legal consequence of the liquidation of cooperative is that its legal entity status continues to exist before its liquidation is registered in the Indonesian National Gazette. Cooperative cannot take legal action unless it is necessasry to settle the assets of the liquidated cooperative, the cessation must be followed with liquidation, the cooperative business is terminated unless it is for liquidation, the authority of administrator and supervisor is deactivated, the authority of administrator is taken over by the liquidator, “the cooperative is under liquidation/settlement”, once the agreement has been run can be terminated, the members of cooperative are no longer allowed to resign. Legally, the distribution of the assets of liquidated cooperative is done by taking action of settlement including listing and collecting the assets of the cooperative, verifying the debt of the cooperative, determining the procedures of distributing the assets of liquidated cooperative, paying the creditor with paying attention to law of guarantee and determining the creditor scale of priority, paying the remaining assets of liquidation proceeds to the members of cooperative capital certificate holders. Abstract

ABSTRACT The role of expatriates is very important for Indonesian national development as a country which is developing. In order to be able to compete in the free job market, Indonesia needs support and aid from foreign countries, including neighboring countries which is realized in the mutual agreement. The essential problem which arises in expatriates is our dependency on foreign investors. One of them is  PT. Toyo Kanetsu which utilizes and employs expatriates; it is one of the foreign companies in Indonesia. Abstract

ABSTRACT The increasing number of population accompanied by facility and infrastructure development as well as the improvement in the field of business and economic activity require the increase of existing electric power as needed. The problem discussed in this study were how the electric power trading agreement was legally implemented between PT. PLN (State Electricity Company) and its customers, what attempts and sanctions were given by PT. PLN (Persero) to the customers who breached the electric power trading agreement, and what constraints were faced by PT. PLN (Persero) in overcoming the breach done by the customers. The constraints faced by PT. PLN (Persero) in overcoming the breach of law on electric power were limited operational cost, less clear official report writing, less complete work equipment brought, less rigorous officers, the people who dared to make their own electricity connection, the field workers with limited understanding of law, and others. Abstract

ABSTRACT In Addition to the basic principles as a consequence of the legal protection for the Bank as creditor with collateral right as the quarantee, the legal action taken by the Bank for the dispute of basic occured is a somasi to debtor, a law suit against the debtor through State Court Uitvoer Bij Voorad, the execution of court decision, the execution of debt acknowledgment, execution of collateral right, parate of execution of collateral right, execution against the quarantor,  forced-agency institution ang bankruptcy through the Commercial Court. The solution taken by the Bank as the holder of collateral right of the conflicton the basic right functioned as debt quarantee is loan restructuring, facility transfer, and partly or wholly repaymnet of debt. Bank can also fight the State Court back, file a law suit against the plaintiffs, the defendants, National Land Board and the Police who have carried ot the execution of the object served as debt quarantee with a burden of collateral right.   Keywords :  Legal Protection, Bank, Basic Right Conflict, Collateral Right

Abstract

ABSTRACT Law No. 27/2007 on the Management of Coastal Area and Small Islands states that what it means by Reclamation is people’s activities to improve the use of land resources, viewed from environment and socio-economy by filling up the land with soil and drying the land or drainage. The Government Regulation No. 46/2007 is on Batam Free Area and Free Trade in which the government stipulates that Batam is functioned as Free Trade Area and Free Port. It is also stipulated the transfer from HPL of Batam Authority to HPL of Exploiting Body of Batam Free Trade Area and Free Port because institutionally Batam Authority, with this government regulation, transfers Batam Authority to the Exploiting Body of Batam Free Trade and Free Port, including HPL of Batam city Administration which was “transferred” to HPL of the Exploiting Body of Batam Free Trade Area and Free Port. It means that at that time there was the establishment two dualism of the government authority. It is recommended that the Batam city Administration and Batam Authority make correct joint regulation, agreed by both of them to manage the reclaimed land because both parties, according to the Government Regulation No. 8/1953, the Presidential Degree No. 41/1973, in conjunction with the Presidential Decree No. 94/1998, are HPL subjects.   Keywords: Management Rights of Batam city Administration, Reclaimed Land

Abstract

ABSTRACT Land has a high value, viewed from any single point of view. It is used as a place for dwelling, making a living, having offspring, and performing traditional and religious rituals. Since there is a close relationship between people and land, this harmonious relationship between people and land needs to be taken care of, based on the same perception. All at once, it is a token of being grateful to God’s blessing so that land grows to be the root of prosperity which is dreamed either by individuals or by community. Land is so valuable that man as social beings will defend their land with all kinds of efforts. In an adat law community, people and land where they dwell in is very closely related, and this relationship is based on religious magic.  People’s right on land is called landlordism or communal right of disposal. The nature of adat land in Indonesia is communal which means that it is owned by all members of adat community. In reality, the implementation of communal right of disposal or the other rights of adat law community still exists, but when communal right of disposal comes to an end, it is no longer validated. Adat land can be extinct or abolished when there are no more offspring or no connection with their land anymore, but the conversion of the land rights can be requested to be administered to the local Land Office in order to obtain legal protection for legal certainty on the land ownership. Abstract

ABSTRACT The implementation of the Foreclosure Sale of the goods is stipulated in the Regulation of the Minister of Finance No. 93/PMK.06/2010 on the Operational Manual of Auction and the Regulation of the Director General of the State’s Property No PER-03/KN/2010 on the Operational Manual of the Implementation of Auction. Uncontrolled goods is the goods which has been informed its customs but is not removed from the Temporary Depot in the harbor area within 30 (thirty) days since it was kept, the goods which is not removed from the Temporary Depot outside the harbor area within 60 (sixty) days since it was kept, goods which is not removed from the Supplementary Bonded Depot whose license is suspended within 30 (thirty) days since the suspension, and goods which is sent via mail, rejected by the receiver, and not able to be resent because of the rejection or not arrived at the right address, and not settled by the sender within 30 (thirty) days since the information by the Post Office. The result of the research showed that the Regulation of the Minister of Finance No. 93/PMK.06/2010 on the Operational Manual of Auction has accommodated the implementation of auction, including the auction of uncontrolled goods.
