Abstract

ABSTRACT Law No.42/1999 on Fiduciary Collateral (UUJF) is stipulated to meet legal need and to give legal certainty and legal protection for any stakeholders, particularly for financing companies as creditors and for consumers as debtors. The result of the research showed that financing companies as creditors complied with the regulation stipulated by the government through the Regulation of the Minister of Finance No. 130/PMK.010/2012 on the Registration of Fiduciary Collateral for Financing Companies which Finance Consumers in Buying Motor Vehicles with Fiduciary Collateral as the Mortgage. So far, this case has run smoothly since it is obeyed by financing companies.   It is recommended that the Government socialize the meaning and function of fiduciary registration to financing companies and to all people who use the service of financing companies so that the implementation of law enforcement in UUJF can be done in order that the sense of comfort and fairness can be carried out. Abstract

ABSTRACT ‘Pauseang’ is one of the types of gift before and after a daughter gets married. A profound research on the giving of land through ‘pauseang’ needed to be conducted since nationally the position of a daughter today tends to be equal to that of a son. Besides that, land as a gift cannot be separated from the prevailing rule of marga land. The research on the giving of land through ‘pauseang’ was conducted to find out the reason for giving land through ‘pauseang’ and to find out the status of a daughter’s ownership of the land. The research used judicial empirical analysis with descriptive analytic method. Based on the result of the research, it was found that the giving of land through ‘pauseang’ was done because the factors of love and affection, economy, and land as the identity for kinship and for family honor. The development of a daughter’s position as an heir nationally did not cause her to have property rights on land, given by her parents; she only had the right of use. Abstract

ABSTRACT Guardianship is very important for the viability of children (young children) or children who cannot take care of themselves, such as displaced children who are not able to take care of their property or their own environment. In other words, they have not yet been able to act legally; therefore, someone or a group of people are needed to take care of and guide them as guardians for the sake of their safety, their survival, and their property. Guardianship is an institution which attempts to take care of young children’s interest, either their personal interest or their property. A guardian is responsible for children’s welfare and for taking care of their property. A guardian can be sued by the children’s families or by the children themselves when he harms them. Although there is a regulation on guardianship, it has been ignored after the incident of tsunami so that there are many legal problems which cannot be solved. Specifically, Acehnese have simple characters that tend to think and to carry out something which is not difficult and complicated. Since they lack of understanding about guardianship, and the lack of control by the parties or the guardianship institutions that have the right to become the guardian/supervisor, and the lack of coordination among the institutions, the guardianship of children, either its management or its supervision, at Gampong (villages) cannot be controlled effectively. Abstract

ABSTRACT A certificate is strong evidence of the right which means that, as long as it cannot be proved either by physical or judicial data attached on it, it has to be accepted as valid data. In the ownership of a certain object, the person has to prove that it is his, as it is stipulated in Article 1865 of the Civil Code. The land rights, used as the issuance of the land ownership certificate in the Land Office, is a proof which can be used as a means of judicial evidence of ownership or the control of a piece of land, either in the written form or based on the witness’ statement. The objective of the research was to analyze the Ruling of the Supreme Court No. 1339/Pdt/2009 on the Issuance of Certificate which comes from a letter of notification which is later considered as forgery. The result of the research shows that the existence of an underhanded letter as the basis for the issuance of an Ownership Certificate is recognized in the Government Regulation No 24/1997 on Land Registration. Nevertheless, in order to be used as the right to issue the Ownership Certificate and to have legal force for evidence, the underhanded letter must meet the procedure and requirement stipulated in Article 24, Paragraph PP No 20/1997. Abstract

ABSTRACT Build Operate Transfer (BOT) Agreement is a kind of unanimous agreement (onbenoemdeovereenkomst). The research used descriptive analytic approach with the source of primary and secondary data. In answering the formulation of the problems, the researcher used theoretical framework as the means of analysis; that is, the theory of legal certainty. The data were gathered by conducting library research and interviews and analyzed by using qualitative analysis method. The main legal basis for the implementation of Build Operate Transfer (BOT) of Ramayana Department Store, TebingTinggi is Government Regulation No. 6/2006 on the Management of State’s/Region’s Owned Property and the Decree of Minister of Internal Affairs No. 17/2007 on March 21, 2007 on the Technical Guidance for the Management of Regional Government Property. Mutual agreement between TebingTinggi City Administration and PT. IntiGriya Prima Sakti No. 644.I/2296/Bapp/2008 and No. 037/IGPS-SMG/TTG/III/08 were signed on March 5, 2008 with the object of the land ex-Bus Terminal, TebingTinggi which was known as Pondok Sri Padang (PSP) JalanJendralSudirman in the area of ± 8,535 square meters for the period of 25 years. Abstract

ABSTRACT Marriage agreement after the marriage is an agreement between husband and wife to regulate the consequence inflicted by the marriage law against their property which is made after their marriage through the Decision of State Court. Marriage agreement after the marriage issued under the decision of State Court is made based on the agreement of the parties involved and the authority of justice stating that the Court is not allowed to reject any incoming application. The purpose of the making of marriage agreement after the marriage is to regulate the legal consequences against the property, debt and accounts receivable and the agreement on the other important issues after the date of issuance of a legal marriage agreement. Legal consequence resulted from the marriage agreement made after the marriage inflicts legal consequence to the those who made it, the property obtained during marriage, and to the related third party. Abstract

ABSTRACT Trade system without documents (scriptless trading) constitutes a new trade system applied in the Indonesia Stock Exchange. Trade without documents is done by computerization. This system not only deals with trade but also with the resolution of the trade itself. In this system, the stocks are changed to electronic data which are saved in computer. Scriptless trading or trade without documents is a trade system which has the mechanism of resolution and storage of stocks electronically. The problems which arise in the implementation of using scriptless trading in the Indonesia Stock Exchange is how about the validity of the transaction of stocks without any documents (scriptless trading) in the Indonesia Stock Exchange and how about the legal protection for investors in scriptless trading in the Indonesian Capital Market. Abstract

ABSTRACT Inheritance occurs when someone who is married legally dies. The distribution of inheritance is closely related to the family structure in Indonesia which has three types: patrilineal family structure, matrilineal family structure, and parental family structure. If someone dies, there will be a correlation between him, the person who is still alive, the heir, and the inheritance. In the case of inheritance, there are adat law and the Islamic law, and these laws are in effect on Batak Toba people who are Moslems, they have to comply with the Islamic Law on Inheritance. The result of the research showed that the implementation of the Islamic law on Inheritance in Batak Toba community in Medan had not yet used the Islamic law completely, for some of the still used adat law. The awareness of law should encourage Batak Toba community in Medan to use the Islamic law because the implementation of the Islamic law is a part of their belief and becomes their obligation to comply with. The dispute which occurs to heirs of Batak Toba in Medan is usually consulted to one of the family members who are considered the oldest member. Abstract

ABSTRACT Child adoption (tabanni) in Indonesian community has several purposes which among other things to continue descendants if a marriage fails to give offspring. The problem of tabanni (child adoption) practices by the community in general is by removing the status or relationship between the adopted child and his/her biological parents or deliberately, the adopted parents do not tell their adopted child that he/she is not their biological child. Child adoption which removes the blood relationship (nasab) is not allowed in Islamic Law while what is allowed is the child adoption in sense of taking care of the child without removing the child’s blood relationship with his/her biological parents. According to Law No. 23/2002 on Child Protection, child adoption is the transfer of the rights of a child from his/her biological parents to his/her adopted parents for the best of the child adopted. The procedure is that child adoption can be done in Religious Court or State Court (for non-Muslim). What is trasferred is only the right of guarduanship of the child.  In relation to inheritance, the child adopted based on court decision has the right to receive inheritance from his/her adopted parents under the wajibah will. The protection for the child adopted based on the court decision is that his/her legal guardianship and the distribution of inherited property from his/her adopted perents are guaranteed. Abstract

ABSTRACT Wakaf, based on the Islamic Law, is submitting a plot of land or other objects which can be used by Moslems without damaging and wearing out them; they are given to a person or a legal entity for the benefit of all Moslems. On the other hand, wakaf, based on the Agrarian Law, is the transfer of title permanently. The consequence is that the land is permanently institutionalized, and it cannot be transferred to other parties, in the form of buying and selling, transferring, gift, etc., unless there is legal basis for its validity. The result of the research showed that the problems of the registration of wakaf land (A Case Study in Percut Sei Tuan Subdistrict, Deli Serdang District) were as follows: 1) people’s lack of understanding in Percut Sei Tuan Subdistrict, especially about the registration and the certification of wakaf land; they believe that when the wakaf land has been reported to the Religious Affairs Office/Official Empowered to Draw up Wakaf Avowal (PPAIW), there will be no problem anymore, 2) Wakaf cannot indicate legal basis for a wakaf land; therefore, the National Land Board Office cannot issue the certificate for the land although it has been avowed in the Religious Affairs Office (KUA) by the Official Empowered to Draw up Wakaf Avowal, and 3) the lack of personnel who handle wakaf land in the Religious Affairs Office and in the National Land Board Office so that there are a lot of wakaf lands which have not been processed, either in its avowal or its registration in the National Land Board Office. The role of the National Land Board in registering wakaf land is as the provider, place for complaint, information about land cases, the settlement of land dispute, and legal act in the implementation of the Court’s Ruling. Meanwhile, the role of KUA in registering wakaf land is as the motivator, facilitator, regulator, and public service. Keywords: Wakaf, Problems, Registration of Wakaf Land
