Abstract

ABSTRACT Bank as one of the financing institutions, which help streamline of debtors’ business through lending an amount of money in the form of credit, has the main function in the economic growth. The theory used in the research Legal Certainty (Rechtssicherheit) theory. The bank as the holder of Hypothecation, when the period of the validity of the Building Rights certificate ends, which is located on the Management Rights, which is still a collateral, initially has the position as preferential creditor and the holder of hypothecation because the Deed for the Giving of Hypothecation (APHT) as the collateral has absolute, droit de suite, droit de preference, specialty, and publicity principles. There are some obstacles related to the annulment of the Building Rights Certificate as the collateral for a certain debt which occurs to the Bank as the holder of hypothecation in which the annulment of the Building Rights Certificate on the Management Rights becomes the Bank’s collateral. Abstract

ABSTRACT Based on the result of the research, it can be concluded that with the registration of the land rights by individuals and by legal entity legally, and the publication of land certificates, the government will guarantee the security of the land ownership. In order to be used optimally and to fulfill the public need for land, the government has applied one of the philosophical elements of the Agrarian Law that says: “the National Agrarian Law should provide the possibility for the realization of the functions of land, water, and air for the benefit of the Indonesian people and should be appropriate for the progress of time in the agrarian problems.” This statement becomes the reason for the request for the land rights (escalation process). The legal problem of the escalation status of the right of use of the guarantee from the cultivating right to the property right is the lack of information about the benefit of the escalation of the rights, the lack of education and knowledge of the people, and the incompleteness of dossier to fulfill the administrative requirements in the process of the escalation of the rights. Abstract

ABSTRACT Land trading deed made before a public notary in a conditional agreement to bind the parties who have made the agreement in order to implement the main agreement which is the trading deed made before PPAT (Official Empowered to Draw up Land Deeds). This research was judicial normative. The factors which caused the cancellation of land trading deed was the agreement of the parties because the requirements of cancellation as it is stipilated in the clause of purchase agreement hass been fulfilled. The legal consequences of the cancellation of the land trading deed made before a public notary was compensation, cancellation of agreement, and cancellation with compensation. The legal complaint can be brought to the Court (litigation) afterthe warning (somatie) has been filed by the party that is harmed to the party that has cancelled it or those have breeched the land trading deed.   Keywords: Cancellation, Land Trading Agreement, Notary

Abstract

The land rights regulated by the Law of the Republic of Indonesia No.5/1960 on Basic Regulation of Agrarian Principles holding the principle that all of the land rights  have their social function. Therefore, the owner of the land rights have to release their land rights when the land acquisition activity is being implemented, no exception for the land rights being imposed with Collateral Right which guarantees to pay off certain debt to the bank. The problem appeared when the compensation were entrusted to the local District Court, the land rights were declared to be void, that the bank  as the holder of the collateral lost special guarantee. The protection effort that can be taken by the bank is the inclusion of a clause granting power of attorney to the bank to withdraw the compensation money in the District Court related to the credit agreement mutually agreed by the debtor and the bank. Abstract

Pekanbaru is the biggst townhe capital of Riau Province. The expansion is based on Law No. 32/2004 on Regional Autonomy and on the Government Regulation No. 19/1987 on the Revision of the Territorial Borders between Pekanbaru and Kampar District. The type of the research was judicial normative and descriptive analytic. The area of expansion of Pekanbaru has to be in line with the regulation stipulated in Law No. 32/2004 on Regional Autonomy and with the Government Regulation No. 19/1987 on the Revision of Territorial Borders between Pekanbaru and Kampar District. The implementation of the area of expansion of Pekanbaru which is substracted from a part of Kapar District are Siaulu PW Subdistrict and Kampar Subdistrict in Kampar District. The legal consequence is that there is the alteration of the composition of regional authority in both of these Dati II areas. Besides that, there is also the change in land registration in the Land Office and in the Office of PPAT (Official Empowered to Draw up Land Deeds) in their areas. Abstract

The ownership of the Right of Use No. 765/Pusat Pasar certificate on behalf of Medan City Administration on July 1, 1996 which was legally given by the Land Office of Medan could be cancelled by the claim of Hin An Hui Association (Perhimpunan) in 2007, based the Ruling of the Supreme Court No. 981K/Pdt/2009. The research was descriptive analytic with judicial normative approach.The data were gathered by using library research and analyzed qualitatively. The conclusions of the research were as follows: 1) the factors which cancelled the certificate were a) the Association was legally established according to the prevaling law, b) the Association could give evidence about the grounds of its claim, and c) the ceding land rights had proved that the Association had controlled and used the disputable object based on the sales agreement on February 12, 1957, 2) The reason of the cancellation of the certificate, based on the Ruling of the Supreme Court, was legal since it was not contrary to law, and 3) legal protection for Medan City Administration  was by cancelling all verdicts of Medan District Court, Medan Higher Court, and the Supreme Court. Abstract

Inheritance law is a law which regulates the transfer of right in inheritance (tirkah) to an heir, determines who will have the right to be the heir, and determines the shares of each heir. The research was descriptive analytic with judicial normative method. Wasiat wajibah (a will which has to be fulfilled) is a will which is intended for an heir or the relatives who do not obtain the shares of the dead man’s inheritance because of the religious prohibition. In the Islamic point of view, a non-Moslem heir does not get inheritance from a Moslem family, and a non-Moslem is prohibited to bequeath an inheritance from a Moslem, based on the provision in the Koran and Hadits. The reason for giving a wasiat wajibah to a non-Moslem is that people analogize the giving of the right for wasiat wajibah to an adopted child/adoptive father as humanitarian basis and love because of heredity relationship. The Supreme Court’s view on the Ruling No. 0140/Pdt.p/2012/PA. Sby is that an apostate child cannot get inheritance from his Moslem parents, but he can get wasiat wajibah because of justice only. Abstract

Aceh adat community constitutes basic culture in Islamic law, including unregistered marriage which is know by Acehnese Moslems in Aceh because of the development of Islam in Aceh so that marriage is always related to Islamic Fiqh. In Aceh adat, unregistered marriage is valid in the Islamic law although the process is ot before PPN (marriage clerk) in Subdistrict Religious Affairs Office. In thiscase, there is no dichotomy abaout the validity of the marriage between the Islamic law and Law No. 1/1974 in Marriage and between the Islamic law and KHI (Compilation of Islamic Law) as the positive law in Indonesia. Therefore, a valid marriage is a marriage which has fulfilled all requirements without any obstacles.In the Aceh adat, the position of woman who performs an unregistered marriage according to the Islamic Fiqh is equal to woman who has registered marriage. Abstract

Article 66 paragraph (1) of Law of Notary Position No.30/2004 is a form of legal protection provided by the legislation for notary as public official. The research was a descriptive analytical normative juridical. The result of the research showed that the revocation of Article 66 paragraph (1) of Law of Notary Position No.30/2004 had the consequence of calling and examining a notary in a criminal case by the police investigators directly without getting any permission from the Notary Honorary Council. The revocation of Article 66, paragraph (1) of Law of Notary Position No. 30/2004 had caused the authority  o f the Notary Honorry Council in giving the lisence in a written form the investigators and judges in the process of calling and examining the crimninal case which had been revoked its authority.  The enactment of Law of Notary Position No: 2/2014 containing legal protection for the notaries who are called and examined in a criminal case has not been able to be implemented yet because the Notary Honorary Council with authority in giving permission to call and examine a notary in a criminal case has not been established. Abstract

The current use of water gallon with registered brand belongs to AMDK has raised a problem in the legal domain of Intellectual Property Rights. The brand which is owned and registered  by a party should not be used by the other party for the item with the same kind and class, but in practice, the gallon with registered brand is frequently used by the refill drinking water depot. The use of the AQUA brand gallons of drinking water by the refill drinking water depot businessmen can be categorized as trademark violations if the gallons with registered brand are deliberately prepared by the refill drinking water depot businessmen for sale, while the constraints faced by the owner of the registered brand are internal and the external. Of the efforts to prevent the incident of trademark violation were done by providing sustainable and periodical trainings to optimalize the existence of transporter and distributor partners to actively supervise the use of the AQUA brand gallons of drinking water, and to educate the transporter and distributor partners about brand provisions, performing comprehensive efforts with law enforcement officers and other efforts by actively making several approaches to related agencies such as industry and trade services and the refill drinking water depot businessmen.
